These comments are submitted in response to the 911 Compensation Fund as it is currently written.  As a family who has been directy affected by the tragic events of Sept 11th and who lost a very close friend, we hope that his family will be taken care of.  As such, the statute as it is currently written does not go far enough to protect the victims of Sept 11.  These proposed comments should be incorporated into the Fund to better care for the victims and their families. 

1.  The families should have the right to Appeal any decision made for them with respect to the compensation they will be receiving.  It most situations, individuals have a right to appeal a decision made in a court of law.  A judgment rendered against a party in a court of law is appealeable and as such, a finding by the Special Master should similarly be appealeable. 

2.  With respect to the actual payment of the monies to the families, each individual family should be able to determine how their funds will be paid to them.  Some might prefer an annuity while others would prefer a lump sum.  This decision is one which should be left to the families and not to the Federal Government. 

3.  The victims and their families WILL NOT tolerate a cap on earnings that the deceased individual would have earned over his/her lifetime.  Many families lost loved ones just starting out in their careers with infinite potential.  The government CANNOT begin to speculate as to what they would have and could have earned over their lifetime.  

4.  The age of retirement should be increased to between the ages of 65-68.  It should not be assumed that our loved ones would have retired at an earlier age simply because of where they were employed and for the fact that they worked on WAll Street.   The 911 Compensation Fund has been created to deter lawsuits and at the same time to take care of the victims and their families.  Although our loved ones cannot be brought back, with the inclusion of the above proposed suggestions, their families will receive some compensation for their pain and suffering. In addition, we hope that once these claims are settled in their best interest, they will be able to close the chapter to this horrific part of their lives.    Thank you,
