Thursday, January 17, 2002 11:26 AM (no subject) Dear Mr. Zwick, My name is . My husband, , worked at and was killed on 9/11/01. We have two small children ages 6 and 4. I am writing to you to explain that as the victims compensation fund now stands it will not help me at all. After deducting my collateral assets, I would not benefit with the plan. Please understand that social security now pays half my bills and investing our other assets i.e.: Life insurance and my husbands self-funded 401K plan I will not be able to make up the difference. I do not understand why congress has made the statutes for this plan to subtract these collateral assets made by prudent, caring husbands and fathers like actually count against us and leave us netting nothing from the plan. Why would I and many like me sign away all our rights so that we can walk away with what Ken Feinberg is now saying is the floor of $250,000? Is this fair? I feel that the plan must be revised by the special master to increase the $250,000 on the non-economic side and to use up-to-date New York tables on the economic side. I also feel the congress and senate should revise the statutes to remove life insurance and social security as a collateral asset since it is never deducted from settlements in tort law suits. It is also extremely unfair for us to have to go into this fund blind, not knowing what our exact compensation is until we have signed away all our rights and then find out we would not benefit and have no other recourse. Please help to make changes to the Victim's Compensation Fund so that all victim's families will get what is rightfully coming to them.
