Sept 11 Victims Compensation Fund
The offset provisions contained in the legislation should be eliminated.
They are inequitable. They penalize some families and not others.
Furthermore, offsets for life insurance paid for by an individual and
offsets for 401Ks have no counterpart in the tort system. Certain rights
under the tort system were taken away from us by the "Airline Bailout" bill.
Ken Feinberg himself has stated that the statute "stacks the deck" against
litigating. It is completely unjust that we should be deprived of our full
constitutional rights as potential litigants, and also be deprived of the
full amount of our damages when forced to submit to the supposedly equitable
alternative-the 'Victims Compensation Fund'.
