The following are my objections to the Victims Compensation Fund:
My husband's life insurance policy, which he paid for, which would pay
off my mortgage, should not be deducted from any benefits I may receive.
This was purchased privately and has nothing to do with any government,
state or city benefits that I would/could receive because of this
tragedy. (Collateral source deductions are not required in court
cases.)
The proposed awards for non-economic damages ($250,000) per victim are
only one-tenth the level paid in comparable cases. For example, a
spouse was awarded $5 million in non-economic damages in a lawsuit
arising out of Lockerbie. Congress explicitly enumerated a broad range
of non-economic damages for which victims and their families shall be
compensated and DOJ ignored this.
