people for the 9/11 fund, but will give money to the families of those
  who were in this country ILLEGALLY and working at the World
Trade Center. How CONVENIENT for you to ignore the law for those

Objection to Federal victim'Comp Program
My name is .
I am the Widow of , who
lost his life saving others at WTC Tower One on 9/11/01.
He was 39 yrs old, taught at the . He made a conscious
choice to jump in a patrol car through the Holland tunnel to respond at
(9:15am).
I received a cell phone call before he went in that he was NOT going to "just
watch."
He had to find a way out for others. The tower collapsed 90 minutes later. He
saved thousands of lives.
We have 6 children and he was an only child. His parents also depended on him
financially. His body to date is NOT recovered.
It is unjust & unfair to our entire family that you deduct his benefits from
any award given for his great sacrifice. How many Billions of dollars & lives
did he save the Government alone? Rescind the restrictions to deduct ANYTHING
from any reward.
You are actually making families chose to sue through this restriction.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.

Why?
I would like to know why on Sunday morning's "Meet the Press," Kenneth
Feinberg, the head of the September 11 Victim's Compensation Fund (a
program of the US Dept. of Justice), is planning
on limiting what kind of compensation goes to gay and lesbian victims of
the September 11 terrorist attacks. And the way the rules read, gays
and lesbians will probably get nothing.
Forget that
, a gay man, was one of the heroes who brought United Flight 93 down in a field
in Pennsylvania instead of on top of the US Congress, where it was
supposedly headed. And forget that NY Fire Department
was gay, as was the
of the plane that flew into the
Pentagon. No, according to John Ashcroft's Justice Department,
apparently some heroes are more equal than others.
But on today's six month anniversary of
's horrible death, and the
nation's greatest tragedy in decades,
(in addition to other
gay heroes of September 11) is now officially being declared a lesser
kind of hero because he was gay.
In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the
Press," Kenneth Feinberg, the head of the September 11th Victim
Compensation Fund (a fund created by Congress and run by the Department
of Justice), said that gay partners of the heroes of September 11th will
not necessarily be eligible for the same compensation as heterosexual
family members who lost their loved ones.
According to Feinberg, lots and lots of people will receive compensation
under the plan, including children, babies, and even fetuses. And as an
indication of how generous the fund will be, even illegal aliens, who
aren't American citizens and who are in the US in violation of federal
law, will
receive benefits. Feinberg even says that the Attorney General has
promised that if undocumented aliens come forward, they won't be kicked
out of the country, and their employers won't be penalized. "The
attorney general, in consultation with Immigration, etc., undocumented
aliens who
come forward, the families will not suffer any consequences. They are
covered by this program. They will get a check. The employer, where we
need the economic information about the
undocumented alien, will not be penalized," Feinberg told "Meet the
Press."
Yep, the Attorney General is himself willing to overlook US law so that
the victims of September 11 can be compensated.
But when it comes to gay Americans who lost a loved one to Mohammad Atta
and his band of thieves, that's when Feinberg and the Department of
Justice suddenly do an about face:
"[Gays and lesbians are] left out of my program to the extent that their
own state doesn't include them. I cannot get into a position in this
program, which has a one-and-a-half or two-year life start
second-guessing what the state of New York or the Commonwealth of
Massachusetts or the state of Virginia or New Jersey, how they treat
same-sex partners, domestic live-ins, etc. I simply say this: What does
your state law say about who is eligible? If your state law makes you
eligible, I will honor state law. If it doesn't, I go with the state.
Otherwise, Tim, I would find myself getting sued in every state by
people claiming that I'm not following how the state distributes money.
I can't get into that local battle. I've got to rely on state law." -

That's a long-winded way of saying that if state law discriminates
against gay people, then so will Feinberg and the 911 Fund. The problem
for gay Americans who lost loved ones on September 11 is that most
states do not legally recognize gay relationships, and the very few that
do tend to do so only for state employees, not for citizens at large.
And while a handful of cities do in fact recognize such relationships,
under Feinberg's formula, it's the state's law that counts, not the
city's.
So, in the end, pretty much everyone who died - including people who
aren't even American citizens and were living in the US illegally - will
be honored by the September 11th Fund as deserving of America's special
recognition and thanks. The sole exception will be gay and lesbian
Americans, because Feinberg and the 911 Fund wouldn't want to do
anything contrary to US law. (Unless of course it involves an illegal
alien who isn't even American - then apparently it's okay to bend the
rules.)
On this six-month anniversary of the attacks on the World Trade Center
and the Pentagon, Kenneth Feinberg and the September 11th Fund are
telling the American people that regardless of whether a gay man was one
of the four heroes on United Flight 93 who saved the US Congress and the
White
House from utter annihilation, the 911 Fund plans to discriminate
against an American hero because most of the country sanctioned such
discrimination prior to September 11.
If September 11 has taught us anything, it's that our patriotism and
love of country transcend our differences and unite us all. It would be
ironic if the generosity of so many Americans in giving to the September
11th Fund were used to further divide us as a people, and send the
message to all that some American heroes are more equal than others.

Gay Heroes
If the story going around the Internet is true that the Victim's Compensation
Fund will not recognize partners of Gays and Lesbians who died in the
tragedies of 9/11, yet it will indeed be recognizing illegal aliens, then
please send me directions on how Gays and Lesbians can get back their money
from all the funds to which we have donated to help all the victims.
If Kenneth Feinberg did indeed say that he will ignore Federal Law about
illegal aliens, but obey State Law about gay men and women, then I wonder
which side is he working for: The Side which is trying to stir unrest in
America, or the side which stands up to the plate when the need is there.

Victims Compensation
I thought we gave millions to the various charities to compensate the victims of 9/11. I just don't understand why the taxpayers are now giving them more.
This sets a dangerous precedence. The 9/ll victims are getting vast amounts of compensation and other victims of terrorists attacks received little or nothing. Now all of them will be suing the government. Also, we do not know what other victims there might be in the future and surely the government cannot afford to compensate them in a similar fashion.
The victims of 9/11 are becoming multi-millionaires. I pray there aren't any victims in the future because they will suffer more. People won't be as willing to give to the various charities...where did that money go??? And the government won't have the money to be as generous as they were this time.

"Pricetag on Life"
Why do we feel the need to compensate the victims of
terrorists from foreign lands, as opposed to victims
of gang violence, riots, tornadoes, or U-Haul trucks
in Oklahoma City? Do we draw the line when the action
or attack is meant to send a message to our
government? Mr. McVeigh directed his attack on our
government, yet we aren't paying victims this large
amount of money. I am truely sorry for your loss,
however we have to protect ourselves from bailing
everyone out of their problems.
Why does the family of a firefighter seek: $250,000
on 9/10, but more on 9/11? I feel for these families
the most. Killed in the line of duty to save other
people is the greatest sacrifice of all. However, the
memory of the victims that these firefighters were
there to save should not be tarnished by their
survivors. Stop looking to others for accountability.
Please take what you have...... and be thankful.

Please decide not to increase the benefits provided
by this bill. Show the country that everyone is
important, and refuse to place a higher pricetag on

Sept. 11 Fund
Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Equal Access to Crisis Relief

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Exclusion of Gays

If the USA truly does stand for justice for all, then there is NO ROOM TO
EXCLUDE ANYONE in the disbursement of 9/11 funds, or in any other matter.
All sorts of people, many American citizens, lost their lives and some lost
them so that others could be saved. Gays and many other "slices of life" are
counted among the dead.
If anyone is excluded, then the equality that America was founded on is
absolute hypocrisy.

Dear Mr. Zwick:
The member companies of the American Council of Life Insurers
commend the Department of Justice in their public outreach in the
initial determination of the structure of the September 11th Victim
Compensation Fund 2001 (the "Fund"). The American Council of Life
Insurers is the principal trade association representing the life
insurance industry. We have 426 member companies, which account
for 80 percent of the life insurance premiums and 81 percent of
annuity considerations in the United States among legal reserve
life insurance companies. After review of the Notice of Inquiry
and Advance Notice of Rulemaking published in the Federal Register
on November 5, 2001, our members would like to contribute their
thoughts in connection with payments to be made from the Fund.
It is our understanding that Congress intended that this Fund
provide assistance to victims and families of victims and that the
amounts to be awarded are based, in part, on the future economic
losses sustained as a result of the injury or death. In light of
this purpose, we would suggest that the Special Master making the
awards be permitted to order that the amount be paid as an annuity.
The use of an annuity in payment of compensation intended to
replace future income or provide for future expenses is well
established and is customarily utilized in a variety of similar
situations, including awards and settlements under the Federal Tort
Claims Act and the National Vaccine Injury Compensation program (42
USC Section 300aa- 15(f)). In addition, annuities are often used
in settlement of state personal injury claims.
An annuity is an excellent means to provide for future expenses.
The periodic payments replace the lost income. The payments are
made in a predictable manner upon which the victims families will
be able to rely. As articulated by the Claims Court in Lov V.
Secretary of Dept. of Health and Human Services, 22 Cl.Ct, 430
(1991):
An annuity insures that the beneficiary receives a steady stream of
income throughout his entire life. An annuity protects the trust's
corpus from mismanagement or waste by the parent of guardian.
Thus, an annuity eliminates any fear that the compensation might be
invested in an unprofitable manner.
In Lewis v, Secretary of Health and Human Services, 90-968V, U.S.
Claims Court, Office of the Special Masters (July 9, 1992), 1992 WL
178640 (Cl.Ct.), the Special Master determining the form of a
compensation award under a vaccine case noted that:
An annuity, however, does provide a guaranteed level of benefits
for the life of the beneficiary, regardless of fluctuations in
rates of return in investments. A conservator cannot provide this
assurance. Thus, where the award is turned over to a conservator
to manage, it is conceivable that the beneficiary may outlive the
trust corpus if projected rates of return are not realized or if
she exceeds her projected actuarial life expectancy. An annuity
provides protection for the beneficiary that is not otherwise
available. With an annuity, the benefits are provided for the
entire life of the beneficiary, regardless of the duration of that
life. A steady stream of payments for the beneficiary is ensured.
The corpus of the award is essentially secure from any putative
mismanagement or unforeseen investment error.
Annuity issuers are mindful of the need for prompt resolution of
claims made under this Fund. They are prepared to work with your
Department in arranging expeditious payments for annuity awards.
Annuity issuers are experienced in making periodic payments to
annuity beneficiaries. They have the mechanisms in place to manage
the payment streams and to assist payees with their payments over
a long period of time. Annuity issuers provide lifetime guarantees
of both payments as well as customer service. Our members suggest
that permitting the Special Master to make awards using annuities
will greatly benefit the families and will facilitate resolution of
the claims from this national tragedy.
We would like to work with you in connection with the use of
annuities in the September 11th Victim Compensation Fund. Thank
you for your attention to this issue.

Dear Mr. Zwick:
I am writing in response to the Department's request
for public comments regarding the forthcoming
regulations for implementing and administering the
"September 11 Victim Compensation Fund." I strongly
urge the Department to draft regulations that ensure compensation is
available to all victims of the attack, including the committed partners
and the non-biological children of gay and lesbian victims. It is
unquestionable that the devastating grief and economic losses suffered
by the families of gay and lesbian victims are no less than that of
other families. Just as the terrorists drew no lines in choosing their
victims, our country must draw no lines in compensating those who
suffered the most personal of losses from these horrific attacks.
Many Americans lost their lives on September 11, each
of whom left behind loved ones. I urge the Department
to honor these bonds by treating the families of gay
and lesbian victims as you would any other.

9/11 Fund to Discriminate Against Gays

I received the below e-mail and find it extremely disturbing.....If these
facts are substantial, the implicit aquiescence to bigot-based States law
and policy by our National leaders is disquieting, to say the least. As a
cancer researcher, who has employed several homosexual individuals who have
made as great or greater contributions than many others in the fight against
cancer in children, I find such discrimination not only distasteful but
highly counter-productive to our National ethic.
represents a symbol of what the USA stands for. To treat him
(and his) any differently from others of the same character and integrity
degrades us all.
