Something is wrong when I, an Amerucan citizen, begins to feel
unsafe and threatened by my own government
Dear Sirs:
Did I misunderstand Mr. Feinberg, as a representative of my government
(United States of America), say that gay partners of the fallen heroes of
9/11 would not be eligible to receive monetary relief? Has my government
gone insane as well as become biased and bigotted? I am beginning to feel
threatened by my government and unsafe in my own country. I am a straight
woman, 4 children and 4 grandchildren. AND I DO NOT AGREE WITH ANYONE WHO
DISCRIMINATES AGAINST ALL AND ANY OF THE HEROES FROM 9/11. And I really have
a problem with arrogant people who discriminate against people who are
different than themselves. All the heroes who died 9/11, regardless of their
orientation, religion, political views gave their lives for this country.
ALL of their loved ones have a right to receive monetary relief, regardless.
As a registered voter, I will not stand for this kind of discrimination. It
is my belief that the American people had a rude awakening after the last
presidential election, and certainly after 9/11. People who are eligible to
vote but have never voted are expressing a desire to have a voice in how
this country is run -And they will vote in the next election. Don't count on
a lot of peeple continuing to sit on the fence or being disenfranchised. One
drop of water can't do much, but look to the strength of a tidal wave. Mr.
Feinberg might be looking for a new job after he runs for office next time.
I am a very straight-forward and out-spoken woman. I can be polite and well
mannered but rarely to people who are hell bent on disgracing themselves and
all American citizens. Mr. Feinberg, in my view, is a disgrace as well as a
bigot. I am happy to say that he is in the minority and that most Americans
don't agree with him. I guess he hasn't seen the lastest polls concerning
the views of my countrymen concerning gays and lesbians. My dad taught me
that there is one.race, the human race. The Constitution of the United
States of America says we are equal. Try re-writing that, Mr. Feinberg.
And while I'm at it, I would like to express my disapproval of President
Bush at the opening ceremony of the Olympics. He and the First Lady looked
like stone mountains when representatives of countries that did not meet
with their approval came into the stadium. That display was a disgrace to my
country and was seen as such by people around the world. The young athletes
did not deserve that kind of welcome to MY country. May I remind you that
this is a country with LIBERTY AND JUSTICE TO ALL. As host to these
athletes, one would expect they would be welcomed on equal footing with all
the other athletes, regardless of personal views. Mr. Bush might not be
aware that one of the purposes of the Olympics is to bring people of our
world closer together. Making war isn't to everyone's liking. Certainly,
killing other people isn't a good thing on the best of days. And going to
visit other countries and then insult them is not done, Mr. Bush. You undid
a lot of positive work done by the South Koreans with the North Koreans.
Say what you will about the Clintons, they were good Ambassadors for our
country. I would suggest you find out what ordinary people in the world
think, rather than listening exclusively to people who are paid to "read
your lips".
Someone told me recently that it has becojme dangerous to disapprove of
anything this White House does. To that I must say that I will continue to
live dangerously because my forefathers guaranteed my right to have my
opinions and to express them as such. As an American citizen, it is my duty
to express my opinions and to vote. Mr. Trent Lott is welcome to call me a
traitor, too, if not believing that every word uttered by my government is
holy. As such, I would feel honored to be put in the good company with Mr.
Tom Daschle.

As a heterosexual American that made a contribution to the victim's fund, I
am offended that bigotry has again prevailed! ALL victim's loved ones
should be compensated equally, and gay people's partners should not be
excluded! I would not have donated if I had known this was going to be the
policy.

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Re: Comments: Victim Compensation Fund
Dear Mr. Zwick:
As parents who tragically lost      on Sept 11th, we would appreciate the Dept. of
Justice to consider our comments in order that we as a family be treated with honesty and
fairness relative to the intent of Congress to compensate the families for their loss.
My recommendations are threefold:
1) Utilize the methodology established but eliminate the cap,i.e. using the 98 percentile.
On December 17th before some 1300 victims' families the Special Masters indicated
with clarity and emphasis that there would be "no cap". A few days later the Interim
Final Rule was issued that A) Clearly indicated a "de facto" cap by adopting a 98
percentile ceiling. This is totally inappropriate because out of approximately 3000
victims there will be some 300-400 victims who earned six figures and dozens who
earned a seven figure salary. Note well that while money is being expended from
public funds, these individuals have been paying significant income taxes over the
years and have been creating jobs because of their production as well as buying goods
and services providing for additional jobs. A jury in a court of law would reward the
families substantial awards because of such earning capacity. What is most disturbing
is the Special Master's comments that an award of over $3,000,000 would be
extraordinary. This gives the families an impression that is a contradiction. Congress
has imposed no caps or stated that any or all awards would be extraordinary or rare.
2) Allow the claimants a choice of using 1999-2001 as a base of earning capacity vs
1998-2000. This would give those families' loved ones who just started their careers
in the work force a more fair compensation methodology. It is also more contemporary and
meaningful to utilize for both new and experienced employees.
3) Non-economic losses should include an award of a minimum of $1,000,000 per
family with additional payments of $100,000 for each dependent for the families who
had multiple losses.
There should be fairness and CONSISTANCY in any applied methodology and there
should be a guaranteed minimum. Finally, we endorse all those comments and
recommendations that will be proposed by      .

compensation for the families of gay and lesbian terror victims
It would be unconscionable to deny the rights of survivorship to the families of gay and lesbian victims of the terrorist attacks. This is a time in our country's development for compassion, not a time for pushing the political agenda of the far right. Taxpayers all over this country have gay and lesbian children, parents, relatives and friends. None of us want to see them potentially marginalized by making them less valuable than other American citizens. Imagine, maybe someone on Sept. 11 was rescued by a gay fireman, maybe one of the heroes on the Pennsylvania plane was helped or comforted by a lesbian. Shocking! Would that make their sacrifice less worthy? Children of gay and lesbian parents, as well as their long-term partners, deserve the same consideration as others. How could you contemplate that they do not!?

Victims Compensation Fund
I believe that the figures on this chart do not accurately reflect people who worked in the financial industry. My husband was 49. He did not receive a 5 or even a 4% (after 51) raise each year. He was what one would call a "late bloomer". He was increasing his salary the last three years by 75%. How can I possibly accept an award based on 5%.
Also, the figures are based on "line of duty". My husband did not sign up for "line of duty". He went to work to support his family. The Government did not protect him or anyone else who was in those buildings on 9/11.
My children also deserve much more than $50,000 for their pain and suffering and so do I. I have lost my best friend, my supporter, my lover, my life. I have nightmares since 9/11. I have to stop my mind from thinking about the pain and suffering my husband went through that day. THAT IS CERTAINLY WORTH MORE THAN $250,000.
Please reconsider these amounts. I would give up every dime if it could be September 10, 2001 again. I am sure all the victims would give up any amount of money to have their loved ones back. BUT WE CANT. Please do not victimize us twice.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

equal benefits for tragedy victims

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Dear Mr. Zwick,
Thank you for your offer for public comment on forthcoming regulations
re: the Sept 11 Victim Compensation Fund. To exclude anyone because of
sexual preference is truly a despicable act. That would be to say that
the gay couple who died in the plane crash at WTC with their adopted son weren't victims. Or that the gay man known to have joined in on the resistance to the hijackers on the Pennsylvania plane wasn't a hero. Surely we have suffered enough without the hatred of small minds
poisoning a fund meant to provide some small solace to the bereaved. Gay people and their families die, they are heros, they grieve deeply. They should compensated and treated like everybody else.

Thank you very much for out and out discriminating against Lesbians and Gays through the distribution of the 911 funds.
I am gay and I have been consistently discriminated against by this administration. Any attempts to rectify such discrimination has been blocked by such creatures as John, (cooking oil) Ashcroft. I write a dozen or more letters each week protesting any and all discrimination of Gays and Lesbians anywhere. I seldom hear back and mine is often the only letter or the one among few that anyone has taken time to write.
Through your blatant and unceremonious discrimination you will cause many, innocent, Lesbians and Gays to suffer. That in turn will build anger. That in turn will influence voters. That in turn will throw your asses out no the street and back to Texas where you belong.
Again I thank you for blatantly discriminating as you are.

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Dear Director Zwick:
I would like to ask that rules developed by the Department of Justice
regarding the victims' compensation fund include gay/lesbian life partners
and children of those partners. In many cases, long-term committed
partners are not able to jointly adopt children they are raising, and so a
child may be, from a legal standpoint, considered a stranger to the parent
they have lost. And of course, gay and lesbian couples are not recognized
by federal law in most cases.

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
