To help us do so, a lot of the outward prejudices towards everyone were dropped. For the first time, we all looked at each other as the same, as equals. We no longer saw each other as Native Americans or African Americans or Italian Americans or Heterosexual Americans or Homosexual Americans, we were simply Americans. I thought that was progress. Now it seems, you are revoking that feeling. Tell me why the gay and lesbian partners of the people who died on September 11 are not going to receive the same benefits as heterosexual partners. Is it now that the aftermath seems to have calmed down, you show us that you simply lied? That we should only come together and be equals when there is a crisis? Article 1 Section 8 states that "The Congress shall have the Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States;..." Giving this money does not pay a debt, since the people receiving the money have not provide the US Government with a product or service, nor is it for the general welfare of the United States. Per the Webster Dictionary, general means "all," and since we all don't have access to the funds, the funds are not for the general welfare. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. It is only fair that all the heroes are recognized and all their families treated and helped equally. To discriminate against gay and lesbian american heroes is wrong. Monday, January 28, 2002 3:38 PM Liberty Fund as the mother of a WTC widow and the grandmother of a 3-year-old who lost his father, I want to take this opportunity to say that the proposed compensation is unfair at best. My daughter and her husband struggled to retain an independent insurance policy which will now be deducted. As a child of divorce and all its attendant financial ramifications, my daughter was vehement about this type of fiscal responsibility. They could have easily used the hundreds of dollars each month for recreation, purchases, travel, etc. but chose to do otherwise. For this to be held against her when others' portfolios, home equity, etc. are not, is an arbitrary decision. No, the government and Mr. Feinberg cannot adjudicate each and every case, but some consideration can be given those for whom their insurance was their only investment. I would appreciate someone down there hearing this plea. I have always been proud to be an American and firmly believe that justice will be done thoughtfully and carefully. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
