We need to properly compensate all victims and survivors of this terrible tragedy. This is a chance to help everyone in need and especially those most effected by this tragedy: the families of low-wage workers. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate and not only suffer the loss of a partner, but endure the tragedy of trying to support a life without that person. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Because it was important for Congress to act speedily, the legislation of necessity sets out broad guidelines and leaves to you and your department the job of providing specificity so that these funds can be distributed fairly and expeditiously. I write to express my view on one aspect of this important set of questions which is before you - namely, we urge that in creating the category of those who qualify as "survivors of someone lost in the crashes," (Topic 5, Notice of Inquiry), we can best carry out the intent and spirit of the law by compensating all those who suffered both grievous emotional loss from these murders, and significant financial loss as well. The federal government should provide such compensation as is appropriate to all of those who had a close relationship with the murdered victim and whose own financial position will be seriously adversely affected by the death. Relevant proof of such a relationship include shared residence, shared bank accounts, joint membership in a health plan, a significant sharing of living expenses, etc. Obviously, this will cover a wide range of different personal relationships, and I believe that this coverage is wholly appropriate in this instance. This is the approach taken by New York State Governor George Pataki, where many of the victims live. The act Congress passed was not an effort to regulate any set of personal relationships, nor to encourage or discourage people following any particular pattern in their living arrangements. It was simply a prompt response by the Congress to the terrible murders inflicted on America on September 11th; in particular by doing what they could to come to the aid of those who were particularly victimized by the deaths of people close to them. Monday, March 18, 2002 10:21 AM Inquiry about benefits Hi, I would like to know if it is true that some of the partners of our homosexual heroes of 9/11 will not be receiving any benefits. As the long term partner (20 years) of a New York native, I would find that to be particularly insulting. While I can see that there could be some concern about fraud, since most states do not allow legal documentation of these relationships. However, that is no excuse to pour a pound of salt into gaping wound. I'm sure that there cannot be more than two hundred of these cases. Whatever investigation is necessary should be done to ensure that fraud does not occur. For example, joint ownership of bank accounts or real estate could be verified. To ignore the loved ones of those who died would be almost as inhuman as the act itself. At the outset, please know that I appreciate the hard work you, your staff, and the Justice Department put into assembling the interim final rules. I also appreciate the fact that, under the interim final rules, charitable contributions to persons injured in the September 11th terrorists attacks or the relatives of those who lost their lives in this tragedy will not offset Fund awards. On behalf of the families most gravely impacted by the events of September 11th, I strongly and respectfully request that the interim final rules be modified to provide truly full and fair compensation to victims of the September 11th terrorist attacks and their loved ones. Unfortunately, I do not believe the interim final rules achieve this objective. Most importantly, those directly affected by the September 11th terrorist attacks consider the interim final rules to be seriously deficient and are, quite understandably, angry, hurt, and frustrated. A combination of unjustifiably low presumed non-economic damages awards, a flawed presumed economic damages formula, the collateral source offset rule, and an inappropriately steep evidentiary hurdle to securing modifications to presumed Fund awards will operate in many instances to prevent victims and their loved ones from receiving full and fair compensation-and, on occasion, any compensation-through the Fund. This would frustrate Congress's intent, deprive some families of resources critical to their economic security, encourage litigation, and send entirely the wrong signal to these families regarding our government's and society's estimation and appreciation of the magnitude of their loss. In the airline relief and airline security bills, Congress limited the courtroom liability of airlines, the airline industry, the World Trade Center, and other parties. It recognized that these liability limits, operating alone, might deprive victims of the September 11th terrorist attacks and their loved ones of full and fair compensation for the terrible harms they have suffered. Thus, Congress created a government-funded program to provide such full and fair compensation to victims and their loved ones. Notably, it did not subject the program to the annual appropriations process. Rather, it funded the program through mandatory spending. In other words, the manifest intent of Congress was to ensure that the program provided full and fair compensation to victims and their loved ones-federal budgetary and cost considerations notwithstanding. Indeed, this would not only benefit victims and their loved ones but also reduce litigation arising from the September 11th attacks. Along these lines, the fact that courtroom litigation may be less attractive to victims and their loved ones due to the liability limits imposed by recently enacted federal law certainly does not support awarding compensation through the Fund that is significantly lower than what one would secure in a successful courtroom action (apart from the award of punitive damages, which the Fund may not award under its governing statute). Those liability limits instead make it particularly imperative that compensation through the Fund be full and fair. Again, this is not only good policy but also the clear intent of Congress. To achieve this objective, I respectfully urge you to modify the interim final rules to increase presumed non-economic damage awards to amounts that fully reflect the damages that Congress listed as compensable, correct any and all methodological and statutory interpretation flaws in the setting of presumed economic damages, and allow increases to presumed awards based simply upon a showing that such awards do not accurately reflect the damages incurred by victims and their loved ones (as opposed to requiring a showing of "extraordinary circumstances" for increases to presumed awards). First, the presumed non-economic damages awards provided under the interim final rules are substantially lower than those paid in comparable cases. Non-economic damage awards in considerable excess of $1 million are typical for other airline crashes and terrorism cases, but in this instance, presumed non-economic damages awards are limited to $250,000 per victim and $50,000 for a spouse and each dependent. This dramatic undervaluation of presumed non-economic damages runs contrary to Congress's general intent to provide full and fair compensation and, significantly, to the specific language of the law establishing the Fund, which lists an extremely broad array of non-economic damages for which victims and their loved ones are to be compensated (regardless of what may be allowable under state law). This problem bears considerable responsibility for the fact that many victims or their loved ones would reportedly be severely under- compensated by the Fund-potentially driving them to pursue litigation which, due to statutorily imposed liability limits, may shortchange them as well. The interim final rules can and should be fixed to increase presumed non-economic damages awards to amounts which properly reflect Congress's intent and are a more realistic assessment of the considerable pain and suffering endured by the victims of the September 11th terrorist attacks and their loved ones. Second, a number of economists or experts have pointed out flaws in the interim final rules methodology for calculating presumed economic damages. The use of outdated and improperly aggregated federal government data and the underestimation of household services performed by victims and of real increases in earnings by administrative support and clerical workers, among other things, has resulted in the unjustified and unnecessary undervaluation of presumed economic damages. The interim final rules cap on the level of income a victim may be considered to have earned per year for the purpose of calculating presumed economic damages awards serves to exacerbate this problem. I strongly urge you to provide interested parties with all information that is necessary and useful to further evaluate the propriety of the interim final rules presumed economic damages methodology and then correct all flaws that would tend to undervalue such damages. The fact that these are merely presumed economic and non-economic damages amounts-purportedly subject to upward adjustment based on specific evidence of loss presented at hearings or through supplemental evidentiary submissions by victims or their loved ones-does not excuse flaws in their calculation. Rather, presumed awards should be based on the best available data and methodologies regardless of the hearing or evidentiary submission option. Indeed, the goal of providing accurate compensation expeditiously through the Fund is furthered by having properly justified presumed Fund awards, as this may diminish the need for hearings or supplemental evidentiary submissions in each and every case. It also may be overly optimistic to assume that each Fund claimant will be able and willing to present evidence at a hearing to correct inaccuracies in the presumed Fund awards in light of their individual circumstances. Indeed, one can reasonably expect that some victims or their loved ones may, upon viewing inadequate presumed Fund awards, have little faith in the ultimate fairness of the hearing or supplemental evidentiary submission process and decide to forsake the Fund altogether. More importantly, the misplaced requirement contained in the interim final rules (though not contained in the statute establishing the Fund) that a Fund claimant demonstrate "extraordinary circumstances" through supplemental evidentiary submissions or at a hearing to justify increases to presumed Fund awards could serve essentially to "lock in" the unfair presumed economic and non-economic damage awards in any given case. Whether or not the presumed awards are fair, upward adjustments should be possible simply upon a showing by a claimant that a presumed award does not accurately reflect the economic and non-economic damages he or she has endured. But this degree of flexibility is particularly essential if the presumed economic and non-economic damage awards would in many cases provide less than fair and full compensation. The "extraordinary circumstances" threshold, however, may prevent the accurate and individualized Fund awards intended by Congress, because while all victims and their loved ones have endured extraordinary hardships, it may be difficult for a single Fund claimant to establish that his or her circumstances are "extraordinary" relative to all other victims and their loved ones. The hearing or supplemental evidentiary submission opportunities for victims and their loved ones must certainly be structured so as to afford them ample time and a convenient way to make their case. But even a properly structured hearing or evidentiary submission process would not remedy the difficulties arising from the inappropriately stringent "extraordinary circumstances" standard. Congress did not erect or envision any such obstacle to the award of accurate and individualized compensation to victims and their loved ones. Indeed, as Congress has considered bankruptcy reform legislation over the past few years, it has moved away from using an "extraordinary circumstances" threshold for permitting deviations from a grid of allowable expenses for debtors in favor of a standard that more readily accounts for debtors' particular economic circumstances. Accordingly, the "extraordinary circumstances" threshold should be modified. I do appreciate the fact that the interim final rules will not offset Fund awards by the amount of charitable contributions received by a victim or his or her loved ones. I believe the collateral source offset provision of the law is misguided. To the extent the final rules do offset Fund awards by virtue of certain collateral source payments. I strongly urge that you construe the collateral source offset provision of the law narrowly, consistent with the tenets of proper statutory interpretation. In particular, amounts paid by victims or their loved ones to secure certain types of collateral source compensation-for example, life insurance premium payments-should be deducted from any amount considered to offset a potential Fund award. Likewise, where collateral source payments trigger new income or estate tax liability, that new tax liability should be deducted from any amount considered to offset a potential Fund award. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Gay and lesbian families should be recognized, just as any other family. New York City is the melting pot of the world. With all of the cultural, racial, and ethnic diversity comes social diversities. This includes gay and lesbian couples. As a college student at Boston University with numerous homosexual friends, I would be appalled if something, God forbid, had happened to one of my friends and their future families were not compensated the same as everyone else. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a diswasher in one of the restaraunts destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayers money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian famillies are especially vulerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in a traumatic predicament of having to prove that their union is legitimate. Fortunaely, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Despite the published deadline, you and the DOJ website have indicated that add'l comments are being accepted and will be considered. Thank you. The primary issues are clear and are of no surprise to you. And so,from the Victims Families point of view, the question is: what can I possibly say to you that hasn't been said before and/or that might actually help you to reach a different conclusion? I wish I knew the answer to this question but I do not. Nontheless I offer you the following comments: 1)The $250k for pain and suffering ultimately reflects a value judgement --- your value judgement. To base the payment amount on the military and federal safety officers is not a fair or reasonable comparison to the Victims who primarily reflect a group of civilian workers. Mr. Feinberg, if you were not the Special Master but instead you were the family member of a civilian Victim, would the $250k value really seem fair or reasonable or adequate to you ??? Clearly there is room for an increase to the $250k payment without having to extend out to the "expected" multimillion $ payments which seem to eventually result from aircraft/terrorism settlements. 2) Overall, the collateral source deductions are a troublesome issue. I assume at this point the law will not change. I ask for your best judgement to be used in those difficult areas such as how to calculate the value of social security and workers comp collateral deductions when those long-term payment streams might end quickly i.e. upon remarriage. 3) I agree with the comments of the Families of September 11, Inc. --- see comment # N002585 --- as related to a) DOJ's Plan Significantly Undervalues Economic Damages and b) the Right to a Hearing Must be Meaningful. To the extent that those comments are accurate, I ask for your help to address all significant issues in a fair and reasonable manner. Mr. Feinberg - you have a terribly difficult job to do. For the past ten years I have been denied any benefits whatsoever because my current partner happens to be a woman. A partner is someone who loves you and wants to spend their life with you. I find that all of these victims who loss a loved one is suffering no different than anyone else, who has loss a loved one from violence prior to September 11th. I find that most of these victims have insurance with their jobs, private insurance, are intitled to social security, State Victims of Crime, but more so the monies from charities on their behalf are overwhelming. With the exception of the many immigrants, I find that these victims are pretty well off. I find that the fund raised to educated their children is overwhelming, also. My question to the Congress and President in regards to the Airline Stabilization Act, which includes provisions to provide financial compensation to victims and families, what more do they need besides what I have mentioned above? Why do the Government have to step in and create a new program for these victims? I have founded that from this drastic wake up call, that the people in the world can come together with Monies, without the immediate assistance from the State or Federal Government. This goes to show why there are so many people in this world who continue to be divided. I find that all victims of crime should be treated equally. Who am I to Judge? I am a single mother who have live through and have seen death throughout my life. Death is not new to me nor is it news. The only difference with the September 11 tragedy, is so many deaths at one time by terrorists (murderers). My ex-husband who was disabled, lived with me and took care of our son while, I work was robbed and shot to death on April 19, 1995. Yes, the same day many people was murdered at the Oklahoma Bombings. I had to take off from work due to greiving and dealing with our son who was ten at the time. Me, being a victim of crime did not spark any lights with the State Victims of Crime Program or Social Security. The V.O.C.P. reimbursed me for funeral cost, offered $10,000.00 for therapy for both me and my son, however, after two years they limited me to $5,000.00. I filed a claim for loss of wages and was denied. I was asked, to provide proof of many things for three years, before I gave up because everytime I provided the V.O.C. with what they asked for they continued to deny me. I had a small insurance policy, which help pay off some bills, but mainly to move my son out of Oakland, Ca. Social Security offered survior's benefit and widow's benefit. Did you know that the widow's benefit stops when your child turns sixteen when it us to be eighteen years old? Did you know that your childs' benefits stops when her or she turns eighteen, where, as it use to be so long as your child continued his or her education, they could receive benefits until they were twenty-three? Was this all due to cutting the social security program? Is this fair to the victims of crime? Don't my son deserve higher education? Don't you think that if his father was still alive, he would have more? So, who falls short here being a victim of crime? Do you know how many children here in the United States, who have loss a parent from murder? Do you know how many husband's and wive's that have loss their live's from been murdered? I ask, that you be fair to all, when implementing a new Federal program for the victim's of crime. Everybody is human and has feeling's when it come to equallisum. The Federal and State should offer more to post September 11th victims of crime.
