I have many concerns and reservations as to how the Compensation Act is written to date. My overall main concern is - no amount of money could ever compensate for the loss of my son, but do not insult his memory and all his heroic deeds by offering such low token amounts for his lifetime's worth and then collaterally subtract out all the things that he worked for and paid into such as insurance and pensions. Why should he now be penalized for wanting to provide for his surviving loved ones? And second of all, do not fool the public into thinking we're all going to become millionaires over this, when in fact, after all of the required collateral items are subtracted out most people would be left with nothing. Lastly, If our government can send over billions of dollars to Afghanistan, a country that caused us all this pain and suffering to begin with, do not make us (United States citizens) quibble with our government over a few dollars one way or the other. Friday, December 21, 2001 12:11 AM New Jersey concern Hello, I lost my husband in the WTC attacks on 9/11 and I have a concern about how this compensation fund will be distributed. My husband and I did NOT have wills, nor did we have children yet. I am legally next of kin, as his wife. Because we do not have wills, some money is paid to the "estate" for which I am the administratrix, yet under NJ law, all monies paid to the estate would be divided, after the first $50,000, between myself and my husbands family...just because we didn't have wills. I want to make sure this compensation will be paid directly to me, not the estate, as his family was not financially dependent upon him. I would have no problem splitting "pain & suffering" with them, b/c that is what we are all experiencing, but the economic loss should not be split because I am next of kin, we depended financially upon one another, no one else did. Tuesday, January 01, 2002 9:29 PM Comment on Interim Final Rule with Request for Comments on the September 11th Victim Compensation Fund of 2001 I am writing with a concern over a potential unfair and unintended result of Sections 104.44 of the Interim Final Rule with regard to the determination of presumed non-economic losses for decedents. If not corrected, the current Rule will prejudice certain beneficiaries in favor of certain dependents which could result in an unfair and unjust distribution of the Victim Compensation Fund. Consider the following scenario: A WTC Victim died without a will. At the time of his death, he was survived by an adult daughter from his first marriage, his current spouse, and their three minor children. The adult daughter from the decedent's first marriage has an estranged relationship with the decedent's surviving spouse. Normally, in a wrongful death suit brought in New York on behalf of the estate of a deceased New York domiciliary, the distribution of the proceeds or settlement of a wrongful death would limit the distribution of the decedent's economic loss to those individuals who actually suffered a pecuniary loss as a result of the decedent's death, and the non-economic losses, including conscious pain and suffering prior to death, would be paid to the decedent's estate and distributed to the decedent's beneficiaries pursuant to the decedent's will or, in the case of a decedent who died intestate, be paid to his distributees. Under New York's rules of intestate succession (Section 4-1.1(a)(1) of the Estates, Powers and Trust Laws), the surviving spouse is entitled to the first $50,000.00 of the decedent's net estate, plus one-half of the remaining net estate; each of the decedent's surviving children (irrespective of whether they are minors or adults, and irrespective of whether the children are from a prior or current marriage) receive an equal share of the other one-half of the remaining net estate. All of the foregoing individuals are classified as "Distributees" under New York's laws of intestate succession and would also be defined as "Beneficiaries" under the Interim Final Rules. Section 104.44 of the Interim Final Rules states that "The determination of presumed non-economic losses for decedents shall be $250,000 plus an additional $50,000 for the spouse and each dependent of the deceased victim. Such presumed losses include a non-economic component of replacement services loss." However, this Rule does not explicitly state how the presumed total non-economic loss shall be distributed to Beneficiaries or Dependents. Would the additional sums of $50,000 for the surviving spouse and each dependent be distributed to the decedent's estate pursuant to local law? Or does the Rule contemplate that these additional presumed sums be distributed directly to the surviving spouse and dependents? Only if Section 104.44 were used solely to determine the total presumed non-economic loss would the Interim Final Rules be appropriate. By starting with the basic presumed non-economic loss of $250,000 and then adding an additional $50,000 for a surviving spouse and each dependent, the total amount of the presumed non-economic loss would be determined. However, the distribution of the said total non-economic loss must not be distributed directly to the surviving spouse and the decedent's surviving dependents. To do so would create conflict with local law as the direct distribution or payment to the spouse and dependents could provide an unintended windfall to the dependents to the detriment of other relatives who would otherwise be beneficiaries or distributees of a part of the decedent's estate. It is respectfully suggested that the Rules be modified to explicitly state that after the determination of the total presumed non-economic loss pursuant to Section 104.44, such amounts shall be distributed in accordance with the testamentary intent of the decedent, or in the case of a decedent who died intestate, in accordance with the local laws of intestate succession. Further, the Rules should specifically require that the Personal Representative's plan for distribution be approved by the Special Master pursuant to Section 405(c)(2)(C) only if the distribution is consistent with such criteria. The comments set forth herein address the failure of the regulations to meet their stated objective of treating victims of the terrorist attacks fairly, predictably and consistently. Since the Air Transportation Safety and System Stabilization Act provides that the mere submission of a claim under the Fund operates as a waiver of the right to file a civil action for damages, Sec, 405(c)(3)(B)(i), it is critically important that the unfair and inconsistent provisions discussed below be revised so that all individuals injured in the terrorist attacks will be able to seek compensation from the Fund. The regulations as presently promulgated exclude from Fund compensation those whose primary injuries are post-traumatic stress disorder and those who, for good reason, did not receive treatment for more than twenty- four hours. If such individuals submitted claims to the Fund and were found to be ineligible, they would be deemed to have waived their right to seek damages in a civil action. Thus, any individual whose eligibilty is uncertain will be forced to choose litigation and forego a claim for Fund compensation. 1. The 24-Hour Rule The Act provides that compensation under the Fund is limited to those who were at the site of crashes at the time or in the immediate aftermath of the crashes and "suffered physical harm or death as a result of such an air crash." Sec. 405(c)(2)(A). The regulations further restrict eligibility by defining physical harm as "physical injury to the body that was treated by a medical professional within 24 hours of the injury having been sustained or within 24 hours of rescue" 104.2(c)(1). This artificial restriction fails to account for the chaos and confusion in the aftermath of the attacks which prevented many injured individuals from seeking medical treatment for several days. Indeed, the Center for Disease Control and Prevention's Morbidity and Mortality Weekly Report of January 11, 2002 published a study which showed that fewer than 800 people were treated at hospitals nearest to the World Trade Center over the two days following September 11. There are many legitimate reasons why victims of the September 11 terrorist attacks may not have received medical treatment within 24 hours of injury or rescue. During the first 24 hours after the attack, many victims who were able to stumble away from the scene may have been suffering from shock rendering them incapable of seeking appropriate medical care or even identifying medical problems until they eventually received assistance from others to do so. There were probably many victims in New York City who tried to seek prompt medical care, but were unable to obtain it due to the overburdened emergency medical system and the disruption telephone communications during those initial hours of crisis. It would be unfair to deny eligibility for compensation through the Fund to victims who did not obtain immediate medical care for any of these types of reasons. Therefore, we propose that this provision of the regulation be amended to require that claimants sought treatment by a medical professional within a week of the injury having been sustained or identified or within a week of rescue. 2. Exclusion of Compensation for Damages Related to Post-Traumatic Stress Disorder. The regulation's definition of the statutory term "physical harm" excludes Fund compensation for those suffering from post-traumatic stress disorder(PTSD) who have no "physical injury to the body" meeting the requirements of 104.2(c), although PTSD sufferers may experience physiological symptoms^1 which would reasonably be deemed to constitute "physical harm." This exclusion drastically undermines the regulation's stated purpose of providing fair and consistent compensation to the victims of September 11. The eligibility regulations include individuals who sustained relatively minor physical injuries while excluding individuals suffering sever emotional and mental trauma whose actual damages may be much more significant. For example, a person who was on the street near the World Trade Center at ^1 See the American Psychiatric Association's Diagnostic and Statistical Manual of Mental Disorders, Fourth Edition("DSM IV")309.81. the time of the attacks, but before the collapse of the buildings, began running, tripped and sprained his ankle, and was taken to the hospital would be eligible for compensation, while a person who was on a high floor of the North Tower of the World Trade Center when it was hit, struggled for over an hour to descend the stairway, exited the building as the South Tower collapsed around him, witnessed the horrific scene of carnage at the site, and (while not sustaining any "physical injury to the body" as defined by 104.2(c)), developed a severe, protracted, and totally disabling case of post-traumatic stress disorder would not be eligible for any compensation. Moreover, it seems(although it is somewhat ambiguous) that, for those who have both a "physical injury to the body" and post-traumatic stress, only those economic losses(including medical expenses and lost earnings) and non-economic losses which were caused by the physical injury are compensable. 104.45(a) and (b) and 104.46. These provisions of the regulations thwart the statutory provision that "emotional pain" and "mental anguish" are compensable, losses. Sec. 402(7). Therefore we propose that post-traumatic stress disorder be included within the regulation's definition of "physical harm". Alternatively, the regulation should be amended to make it clear that, for those who meet the physical injury eligibility requirement of 104.2(c), all economic and non-economic losses caused to them by the airline crashes be compensable, including damages resulting from post-traumatic stress rather than from physical injury. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the surviving committed partners, and the non-biological children of gay and lesbian victims. It is a certainty that some reprehensible people will attempt to take advantage of the situation and try to get compensation that isn't rightfully theirs. It is an equal certainty that equally reprehensible people will try to prevent others from getting what is rightfully theirs, because those particular victims don't share the same "values" as they do. Neither of these things should be tolerated. The devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks.
