As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Public Citizen is a national nonprofit organization based in Washington, D.C., with 21,200 members in New York, Connecticut and New Jersey. Part of our mission is the promotion of government accountability and the assurance that victims of wrongful acts can pursue justice and fair compensation. Our interest in the implementation of the Victim Compensation Fund is that procedural regularity and fairness are ensured for our members and others affected by these incidences. The following paragraphs represent our comments regarding the issues raised in the order presented. Topics # 1 & 2: Whether the Special Master should delay the "filing" of a claim under certain circumstances because of the limited statutory time frame? Yes. 120 days might not be sufficient time to properly prepare and document a claim. A claim should not be "filed" until the Special Masters deputy (or claims counselors) or other representative has determined that the claim is ready for decision. Delaying the filing until the application is complete will allow the claimant to obtain information necessary to allow the Special Master to make a reasonably informed decision. The Department should strive to avoid elevating form over substance in these proceedings. Whether there are actions the Special Master should be required to take before he or she can accept a claim, or deem a claim "filed?" Yes. All acts necessary to prepare the claim for decision should be completed before the Special Master accepts or deems the claim "filed." Only then should the 120 day time period for decision begin to run. Topic #3: What procedures should be used in taking and evaluating evidence? We suggest that all evidence be submitted primarily via documents, including photographs, videotape and other demonstrative materials. If necessary, limits could be placed on the amount of such materials that would be received. Witness statements, affidavits, depositions and other supporting documentary evidence should be submitted at the time of the "filing." Oral hearings in the presence of a hearing officer should be based on the filing, designed primarily to summarize the filing, answer questions, display scars, etc. The hearing officers should have experience in evaluating claims (former judges, personal injury attorneys experienced with mediation and facilitation hearings, etc.). These hearing officers should prepare proposed findings for consideration for the Special Master. Whether the statute permits the Special Master to temporarily halt or toll the running of the clock, at the initiative of the claimant or otherwise? Yes. Section 405(b)(4) entitled RIGHTS OF CLAIMANT, provides claimant shall have the right to an attorney, to present evidence, witnesses and documents, and any other due process rights determined appropriate by the Special Master. This language appears to authorize claimant to initiate a temporary halt in the running of the clock upon a showing of good cause. Again, we believe it is Congress intent to compensate the victims in a timely fashion rather than to establish arbitrary time lines that work to prevent compensation. Whether claimants should have the opportunity to appeal directly to the Special Master specific rulings or working decisions of a claims counselor or hearing officer on questions that arise in the course of the processing of the claim? Yes. We suggest that an appropriate appeal procedure within the process should be provided, as it is impossible to foresee the issues and problems that will arise. If necessary, the Special Master could create a council to hear and evaluate such appeals. Topic #4: What measures should be provided to assist claimants in preparing their "filing?" This is a remedial Act intended to compensate victims. As a result, its provisions should be liberally construed to accomplish that objective. Steps should be taken to provide personnel (claim counselors) to assist claimants with the preparation of their filing. Counseling and assistance with the completion of the application and collection of supporting documents should be provided. Likewise, the government should provide expert economists to evaluate the economic losses on the victims behalf, and present their recommendations as part of the filing. This should not be treated as an adversarial proceeding. Topic #5: How should claimant eligibility be determined? Again, we emphasize that this Act is remedial and should be construed liberally to provide compensation to victims of these terrorist attacks. In our opinion it is not wise or possible to attempt to define in advance the limits of such terms as present at, physical harm, or immediate aftermath. Attempts to establish rigid or artificial definitions should be avoided and the words should be given their common everyday meaning. The claimants individual circumstances need to be considered as provided in Section 405 before these decisions can be made. At this time there is insufficient factual information upon which to even attempt to draw these lines. The personal representative. In all death cases, only the person appointed by the appropriate probate court should be allowed to apply for benefits from this fund. If only the personal representative can file for benefits, then, that person must first go to probate court and obtain letters of authority to act as decedents personal representative. If, as we proposed above, (see Topics #1&2), the filing is delayed until the papers are in order, the time required to obtain probate court authority will not count against the 120-day limit. Many issues can and will arise in death cases as to the class of individuals who qualify as next of kin or survivors. The statutes of the state involved govern these issues and the probate court has the experience to resolve those issues. These state statutes generally provide for notice by the personal representative to all those who are within the statutory class of survivors. They also vest sole discretion in the personal representative to make decisions regarding whether a claim will be filed and in what forum. People unhappy with decisions made by the personal representative are required to take their complaints to the probate court. If time becomes an issue the probate court can issue an order appointing some appropriate person to act as personal representative for the purpose of pursuing a claim against the fund. Topic #6: Whether and how schedules or statistical methodologies should be developed and used in reaching a determination for the compensation of claimants? If the regulations are drafted, as we suggest in Topics #1 & 2 above, so that claims are not "filed" until they are complete and ready for decision, then a lot of the time pressures are relieved. The hearing officers and Special Master can use the full 120 days solely for considering and deciding the individual claims. Sec. 405 (b) requires that the amount of compensation shall be based on the harm to the claimant, the facts of the claim, and the individual circumstances of the claimant. While all claimants must be treated fairly, the statute does not require that all claimants receive the same amount of compensation. In fact, it requires just the opposite. The Act requires that each claim must be evaluated on its individual circumstances. Our civil justice system has never accepted the proposition that all injured persons or survivors of decedents are entitled to equal compensation. This Act clearly did not make that a requirement. Analysis of economic loss. We agree that experts in the analysis of economic loss should be provided by the Special Master to assist claimants in gathering and presenting the pertinent economic loss information. These experts are widely available and frequently used in catastrophic injury and death cases. It is possible that many economists may offer their services free or for nominal fees. Non-economic loss. Section 402 (7) sets forth a very broad definition of non-economic loss, and concludes with the phrase, "and all other nonpecuniary losses of any kind or nature." Based on this language, the Special Master is required to determine non-economic loss claims on a detailed claim-by-claim basis. The statute requires consideration of the individual circumstance of each case. The non-economic loss should be decided based on the materials presented (family and witness statements, photographs, videotapes, etc.) and, necessarily, the good judgment and discretion of the Special Master. Unfortunately, these decisions are not amenable to resolution by "standards." Collateral sources. Sec. 402(4) says collateral source means "all" collateral sources, including life insurance, pension funds, death benefit programs, and payments by Federal, State, or local governments related to the terrorist-related aircraft crashes of September 11, 2001. Sec. 405 (b)(6) provides that the Special Master shall reduce the amount of compensation determined under paragraph (1)(B)(ii) by the amount of the collateral source compensation the claimant has received or is entitled to receive as a result of the terrorist-related aircraft crashes of September 11, 2001. It is immediately apparent that the Act does not define the term collateral source, rather it provides a brief list that is only illustrative. The language contained in Section 402(5), which provides, in defining economic loss, that such losses may be recovered "to the extent recovery for such loss is allowed under applicable State law," requires that state law controls the subject of collateral sources. Whether the Act permits the Department to exclude charitable contributions from the definition of collateral source? Yes. Charitable contributions are not within the typical definition of collateral source followed in most states. (E.g. New York, McKinneys CPLR s4545) More importantly, we believe that everyone must recognize that none of the victims of this terrible tragedy can or will ever be made whole. Therefore, there should be little or no concern that these victims will be unjustly enriched. Moreover, one of Congress objectives in creating this unique fund was to encourage victims to apply to this fund rather than resort to traditional litigation. Reducing compensation through so-called collateral source payment offsets could provide an incentive to not use the fund for relief, but instead to use the courts. Whether in kind and/or material contributions could or should be considered collateral sources? No. Under the accepted meaning of collateral source, in kind contributions are not included. In the Acts definition of collateral source in kind contributions are not mentioned and the list of illustrative examples consists exclusively of programs and payments of specific items of economic loss. Whether potential future collateral source payments are ones that individuals are entitled to receive for purposes of Section 405(b)(6)? As indicated above, we believe state law controls this. New York, for example, requires that in order to find that any future cost or expense will, with reasonable certainty, be replaced or indemnified by the collateral source, the court must find that the plaintiff is legally entitled to the continued receipt of such collateral source, pursuant to a contract or otherwise enforceable agreement, subject only to the continued payment of a premium and such other financial obligations as may be required by such agreement. Whether claimants are entitled to receive credits for premiums paid and the cost of securing fringe benefits that are offset as collateral sources? Yes. State law controls this question. Most states with collateral source statutes, including New York, provides plaintiffs with credit for premiums or other consideration paid to purchase the applicable collateral source. For example, if a claimants decedent had paid $20,000 in life insurance premiums to purchase a life insurance policy, it would not be fair to reduce his familys compensation from the fund by the full face value of the policy when he paid a significant sum to purchase the policy. Whether collateral sources entitled to a lien against plaintiffs recovery should be excluded from the definition of collateral source? Yes. State law controls this question. Most states with collateral source statutes, including New York, exclude as collateral sources those payers that are entitled to lien against the recovery and have a procedure for making those determinations. The same rules should apply here. Periodic payments to eligible individuals. The Act is silent regarding whether payments to eligible claimants will always be in single lump sum payments or may consist of the purchase of annuities that will thereafter make payments to the claimants over a period of time. Structured settlements are an accepted means of providing compensation to victims in similar circumstances and should be available to those claimants who accept the wisdom of that alternative. CONCLUSION Thank you for the opportunity to make these comments and suggestions. This Act provides our government a unique opportunity to provide real and deserved compensation to all of those unfortunate victims of the September 11th attack. I have received information from the Trial Lawyers Care on the September 11th victim compensation fund 2001, and I have some disagreements regarding the compensation fund distribution of funds, they are as follows: 1) Why do you want to limit what the compensation will be based on what has already been collected by the victims families (such as any benefits; life Insurance; State crimes victims etc.)? At that time he said "Mom, I have to go there is fire everywhere". I like others were under the impression that help was on its way. As you well know, help never arrived. You see my son worked on the floor of WTC 1 for . My son caught the earlier train into New York from Wayne N.J. He went in earlier that day because he had a scheduled vacation day on Friday Sept 14th. On that day he and my daughter-in-law and their two young daughters were to close on their first home. On Sept 11th, his dream of owning a home never came true. He was one of many who lost their lives on that horrific day for no reason. My son's dream as a child was to live and work in the city. When he was given that chance a few years ago to work on top of the world, (that is what he called it) he jumped at the chance. He always said that opportunities don't come around that often. My son was just starting to make a name for himself. His title was , one of his responsibilities was to design a network in which trillions of transactions from all around the country were maintained by this network. My son was one of those people who was self taught. We as parents of the fifties could not afford college for him. He never thought bad of us for not being able to send him to college. Throughout the years he took some college courses. When he was twenty years old he went to work for a large corporation. Through this corporation he was able to take night courses. But as life went on for him, he was unable to keep up is classes due to his work load. I would like to mention that when he first started in this company, he started in the mail room and then worked himself up to work in a Information Technology group. When he first tried for the job the interviewer was a little hesitate to hire him, but after my son starting to talk about technology the interviewer was taken back by my sons knowledge that he hired him immediately. He was thrilled because the other candidates who interviewed for this job held a college degree. My husband and I could not afford to put him through college. We both had to work, so when got married he vowed that his wife would not have to work because he was on his way up in the technology field. It was only the past five years that companies had seen the potential in . We as parents were so proud that he was able to grow within an organization and also get paid for a job well done. By the time he left the company that he had worked for twelve years he was making $36k, at the time of his untimely death he was making $85k plus bonus. He loved his work, he enjoyed in learning new technology each and everyday. He was a walking library. He was admired by all for his knowledge and common sense. My daughter-in-law is now a widow at thirty-three and my granddaughters will not have the opportunity to have their Dad see them graduate from kindergarten, high school, college or even walk them down the aisle when they get married. We as parents will never see him get old. We will never have the opportunity to our family name carried on for future generations. He was a loving son who would do anything for anyone from zero to 100 years old. He never saw color in people, he only saw people as people. Just imagine having dreams for your loved ones and all of a sudden all of those dreams are taken away. Why did we as a country let our guard down. We as a country are too trusting and now we who lost loved ones as well the entire world have to live with seeing the towers collapsing. As a parent I feel the pain everyday, knowing that at 9:03 Am that morning and hoping an praying that he was going to make it. Once his tower collapsed we never gave up on hope. After days went by we knew we would never talk or see him again. It is hard as a parent to explain to anyone about losing your child and seeing the whole horrific attack on television with your own eyes. We who lost loved ones will never be able to escape Sept 11th, our loved ones spouses and children will never be the same. My son had a future. He was only thirty five years old and was on his way up in the corporate structure. The monies that are being offered make a monarchy out of his life. You can't put a price on his head. He had great potential. He still had thirty years ahead to contribute to society. You see his first dream while in high school was to be a history teacher. He knew the reality of teaching, but he knew that he would not financially be able to survive and support a family. The reason being that our educators are underpaid. When he had days off from work he would go to 's nursery school and read the young children stories. was so proud of her Dad when he read stories to her classmates. My concern is for my daughter-in-law and two grandchildren. My son would have wanted me to pursue this. He knows that I will make sure that my family and others will and should be compensated. Why is it when someone sues for an injury they get thousands and they don't have to give up anything. To me and as well others, this whole compensation that the government is offering to us is not just. We the victims families don't have any rights. My son thought about his future, he had a life insurance policy on him because he was the breadwinner in the family. Why should he have been penalized for preparing for his future. Now if my daughter-in-law decides to take what the government is offering she has to forfeit her monies. Where is the justice in all of this. If my son were alive and with the potential he had he would have made double of what the government is offering. What is just compensation for giving your live for your country and leaving behind a wife, children and other family. I don't feel that we are being treated justly. Why should my family take a back seat while the government bails out big business like the airlines and other large companies who can not manage their money. But these same big businesses live high off of the hog while the little people have to struggle just to make ends meet. I believe as others, that everyone human being who lost their live on Sept 11th, should be treated equally. You can't put a price on life. People from all walks of life, some highly educated, others with little or no education to the people who swept the floors and cooked the food in the cafeteria should be treated the same. They were all human beings. I don't want to have to beg, it is not necessary. Sometimes I think that if my daughter-in-law and granddaughters were to take advantage of what is being offered that it would be like compromising with the devil. They should not have to do that. My son got up everyday to go to work because he wanted to make a difference in this world. He was a proud American, when he first took the job with we were not happy with his choice. It was nothing against but we all were afraid because of the job was in New York but on top of that on the floor of the trade center. He convinced us that we as a country should not live in fear. Thursday, March 21, 2002 3:42 PM State laws compound tragedy of gays and lesbian victims of 9/11 I am not someone who will be impacted by how the Department of Justice defines "family" when dispensing funds for the victims of the attacks on the Pentagon and the World Trade Center. But every single person who died on September 11 is part of my family. They should be part of your family, too, and treated with equal respect. It is beyond an outrage if everyone who suffered loss is not treated equally. People died in those attacks who had families, who had children, but who did not have "wives" or "husbands". When the government defines legal marriage as the only love that counts, hundreds of people who had equal love for their partners are excluded from benefits they rightfully and morally deserve. Particularly at the Pentagon, everyone who works there is a patriot. Everyone who died was a patriot. New York law allows domestic partnership benefits through an executive order from the New York governor. If a gay or lesbian victim worked at the Pentagon and lived in Virginia and then died as a result of the terrorist attacks, his or her partner is denied benefits because of Virginia's archaic and hurtful laws born out of religious dogma. Virginia is wrong, and the US government shouldn't compound this outrage. There is no equity when the laws vary from state to state about who can be defined as "family." It's beyond absurd, and it bears no image of justice. Or mercy. If you have any sense of decency or patriotism, then ALL survivors' life partners--straight, gay and lesbian--should get equal benefits. Gays and lesbians aren't ALLOWED to get married, and now the government is considering that they be punished for not being married. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Wednesday, November 07, 2001 2:21 PM from BPC Resident We are all thankful to be alive. We mourn for those who have lost their lives. We cry for all of those who are heroes, and workers, and lovers of our beautiful city and who are no longer here. We especially cry for their family and friends who are left behind. We also mourn the loss of our neighborhood. We have lived there almost ten years. Every day we knew how lucky we were to claim Battery Park City as our community. It was peaceful and vibrant, a small town in a busy city, and the World Trade Center was the hub of the wheel. It was a measure of the clouds and weather, it reflected the light of the sun and sky, and as you explored the depths of the financial district or Tribeca or China Town, it was the beacon that brought you home again. My children (boys ages 6 and 8) attend PS 89. We were proud to be part of the very first kindergarten class there and watched with pride and amazement as the school grew. We knew we helped build it, and put books on the library shelves, and make it into this incredible happy center of our children's outside world. It was just after I dropped my children at school that the first plane hit the North tower. I was just outside the Winter Garden by the Financial Center, so I ran closer to the marina to escape any falling debris. I was outside of the Gateway Plaza complex when the second plane hit. You knew then that it was then end of the world as you knew it. We were being attacked in our very backyard. The people jumping from the towers confirmed how helpless we all were. The dove and tumbled out of the inferno they were trapped in. I wondered about the wonderful firemen in the ladder company right across the street, (they used to let my kids come in and look at the trucks and gear, they were our heroes already), and if they were OK. Little did we know what was in store for New York's Bravest. I was with my neighbors helping them comfort their toddlers, and we were all trying to figure out how to get to our kids at school. My husband appeared (he works at the and was running across West St. when the second plane hit). We went to our apartment, closed our windows, grabbed some money, and decided to try and get to the kids at school. We were on our way when I looked up at the burning tower, and saw it start to collapse. We ran behind a building kept our heads down and pulled our shirts over our faces. As the darkness lifted and the smoke cleared, we were told to evacuate to the South. We washed the soot out of our mouth and nose and eyes, and walked south. We were able to more easily outrun the collapse of the second tower, and stood at the South marina as our friends and neighbors boarded tugs and barges. Our children were of course our first priority and we would not get on any boat until their whereabouts and safety could be confirmed. Since radios and phones were out, no one knew. My husband and I turned and walked against the throngs of people heading south to the evacuation point, and walked along our beautiful esplanade, now thick with soot and papers. As we got closer to ground zero and the financial center, the papers were more concentrated, the soot deeper, and the pieces of debris larger and more disturbing. The evidence of human loss was illustrated by the many shoes that littered the area. They were everywhere. We walked by the smoldering, blackened Winter Garden. Just an hour or so earlier, it was a glowing, brilliant centerpiece to the World Financial Center. Just across the street was the hold in the sky where the World Trade Center once stood. We located our children at a public school in the West Village. They were being evacuated as the first tower fell. My younger son cried as he saw this and said he was worried about us. My older son was witness to the burning of the first tower out his classroom window before the shades were finally drawn. We will return to our neighborhood when the fires are out. I cannot bring my children home to a place where the fires burn across the street and the air they breathe is of questionable quality. They have also both had respiratory issues that have required hospitalization in the past, and I certainly will not take any additional risks with their health, physical or emotional. I think we are all lucky. We have weathered this together as a family intact. Our home still stands. Our children are old enough to understand what happened, but perhaps just young enough to be spared the huge ramifications of the loss of life and economic repercussions. They know their favorite store is gone (Borders Books), and many of their friends have moved away and will not be returning. There have been few nightmares and we all support each other. That is a lot to be grateful for. We have received financial assistance and we have explored various funds that are available. There is no one not affected by this. There are many who suffered an unfathonable loss. We only lost our community, our sense of safety and well being. We were witness to an attack of terrorism across the street from where we live. We ran from a crumbling tower and were enveloped in it's ash and darkness. What is compensation for that? Is there compensation for that? More than anything, this exercise has been cathartic. There are hundreds, thousands of stories for those who have been touched by this. I hope whoever reads this gains some small insight into what out world was, and what it is now. Thank you.
