Sunday, January 13, 2002 7:18 PM Victims Compensation Fund Dear Special Master, As every New Yorker, I was horrified by the events of Sept. 11. I work at &nbsp&nbsp&nbsp&nbsp and, like many others, heard and saw everything from my office windows. Again, like many others, I walked that long, eerily-quiet and sad walk north. And finally, like so many others, one of the first things I did was write a check to New York State's September 11 fund. I was happy to do it ... I felt that at least I could do something to help. While my heart goes out to all the victims of September 11, I am quite saddened to see what is going on with respect to the financial compensation to these families. Why all the squabbling? What dollar amount WOULD be enough for them? People who died on Sept. 10 (in fires, as by-standers to shootings, in the line of duty) did not get the outpouring of sympathy and money as these people did ... and still do. Nor did people who died on Sept. 12. Granted, this was an exceptional circumstance and I think the reaction of thousands of people around the world testifies to that fact. But the fact is that people die all the time with little or no recompense. These families are embarrassing themselves. Perhaps others are having my reaction ... which is some sense of regret that I gave money to them rather than the Police Athletic League or Doctors Without Borders. I don't believe anyone had the desire to make them wealthy. We just wanted to help our fellow Americans out. However, many other charities are hurting because of all the money that went to them ... as our hundreds of small businesses downtown. Are all our public figures afraid of seeming mean-spirited by not going along with the demands of these families? I have even read that some of them want to be exempt from income and property taxes. Again, many of us have lost people and just struggled along with no additional funds, public sympathy or free trips to Barbados. Please do not let either misguided sympathy or worry of how this might look to the media encourage you to give in to what is starting to look like extortion. I know that you are under pressure to change your methodology. I trust you will stick to your principles prevent you from doing what is right and fair, not just for the victims of Sept. 11 but for all victims and for all Americans. I am very and truly sorry for those who lost their lives. But I am also sorry for those who lost their lives the week before and the week after. And we don't do anything to help them. Let's not overdo for one vocal, visible group at the expense of others or of American citizens trying to manage during the economic aftermath. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, March 16, 2002 4:02 PM The value of an American Life To whom it may concern: I recently received information relating to gay-Americans and the the September 11th fund. Apparently, the United States government has now placed a value on a human life. Not that there should be any varying degrees of value on human life, but it seems that a fetus, as well as, an illegal alien are now both deemed more valuable and inherently worthy of September 11th relief than are homosexual Americans. It seems to me that this is blatantly unAmerican and outright discriminatory. It is shameful, non-cohesive and perpetuates discrimination, segregation and hate. How is this country supposed to pull together when the indirect message they are receiving from actions like these are: "there are some people who are more "American" and worthy of relief than others." I am deeply discusted with this newfound information and plan on speaking with the rest of the Feminist (and other liberal) groups on my college campus in order to spread awareness of what the government is now doing. People need to be educated on the widespread corruption and discrimination that the government perpetuates. I have seen a little coverage of this issue on the news, I believe it was the O'Reilly factor (not sure though), and it seems the only government reaction and justification for this action was, "if the states do not recognize same-sex partners than we have to follow state statute." ..........It occurs to me that this is simply a cop-out to do the wrong thing. Issues like September 11th and this recent Florida Gay-Adoption case (and Rosie O'Donnell) prove to the rest of America that it is time to take Federal Action on the issue of HUMAN rights. Discrimination is past its time, it is time to do something about it. If the states do not recognize this, the Federal government needs to start stepping in and making suggestions-----discrimination should not be tolerated in America. The wealthy have or should have planned their lives in such ways that their families should be provided for. I am a person of very limited means but my parents some 70 years ago insisted that we have insurance against death to provide for our loved ones. We didn't depend upon the generosity of others to support our dependents when we died. Death is one thing that everyone is assured of and anyone that doesn't plan for that and has the means to do so is either stupid or wants something for nothing. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. If we start to individualize the beliefs of people as a basis for giving, then is it a gift we're giving or payment for them to act and believe as we do. When Christ fed the multitude, He did not ask who believed in Him , nor did he ask what sins they had. He knew they were hungry and He fed them. Thank you for considering my concerns. In it, you posed to yourself the following question at paragraph 1.18: 1.18. What if I did not suffer a bodily injury but I inhaled smoke and dust, and was covered with cinders and ash? To be eligible, you must have received medical treatment within 24 hours and you must have been hospitalized or suffered disability or disfigurement. By stating in your question that the hypothetic victim "did not suffer a bodily injury", you did not really pose a question, at least not a useful question. By definition, if the victim did not suffer bodily harm, s/he is not entitled to compensation under this Law. This hypothetic that you posed is useless. However, it manages to confuse the public as well. You go on in this question to state that the hypothetic victim inhaled smoke and dust. By definition of the law, if the smoke and dust di not provoke bodily injury, the victim must receive no compensation. Yet, you must seriously guide and educate the victims. Members of our group, among other perhaps, had prior conditions including heart surgery and ailments, and respiratory diseases from asthma to asbestosis in different degrees. Properly cared, they lived useful normal lives. The inhalation of the dust (smoke is an euphemism under these circumstances as it was not produced solely by combustion) provoked medically diagnosed physical injury in some of these persons. Serious damage flowed. The dust produced by the air crashes and collapse of the buildings at the World Trade Center was composed of ground-up mortar, polyvynils, polychlorinates, PVCs, asbestos, incinerated bodies and human bones and other solid particles, toxic and poisonous inside the chest cavities of the victims. Scientists and doctors agree that -depending on the prior condition of the person- this dust produces the physical harm of which some members in our group suffer after 9-11. The statute under which you labor -Public Law 107-42- states, in relevant part, that a person is eligible for the compensation under the law if two conditions are met: that the person "(i) was present at the World Trade Center " and "(ii) suffered physical harm or death as a result of such an air crash." Physical harm produced by this black dust is not excluded in this text. You saluted this law as "an unprecedented expression of compassion on the part of the American people to the victims and their families " Your introduction to the interim final rule acknowledges receiving comments from many organizations. Notably, you do not mention any medical, scientific or psychiatric organization. The rules should be made on a medical and scientific basis. Medical, scientific and psychiatric associations are in agreement that "physical harm" can not be defined by what produced the physical injury. Each human being is different. The federal medical institutions -from Center for Diseases Control to NIOSH to the US Department of Health agree that respiratory and heart diseases are physical harm. Over 100 WTC victims and their families integrate the Hispanic Victims' Self-Help Group. Some of them suffered physical harm from ingesting dust (or as you seem to be calling it, inhaling smoke). Please make a question and answer that defines clearly your policy so that the victims are treated with dignity and compassion. Most, if not all, segments of the United States of America -- male, female; black, white, brown, red; gay, straight; white-collar, blue-collar; child, teenager, adult, senior; mentally and physically handicapped ... a true cross-section of our society -- were affected by this tragedy. Our strength as a country is in our unity: "United We Stand!". Please don't perpetuate this horror by allowing discrimination against any segment of this group that has already suffered so much. Im outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. This should not stand! Monday, March 18, 2002 7:02 AM 9/eleven fund The United States federal government has set precedent by superseding state law in many cases to do with civil rights in America and those decisions have always been backed up by the Supreme Court, I think that the man on ;Meet the Press was out of order in saying that the federal gov,t would not intervene on behalf of same sex couples unless state law backed them up. The generosity of the American People did not have strings attached for those familys and loved ones that were wiped out by Osama Bin Laden and his followers. United we stand, was the slogan of the President and the American People. This man does not represent that kind of thought at all.
