Tuesday, December 04, 2001 3:10 PM coverage It has been brought to my attention that in deciding on the regulations for the September 11 Victim Compensation Fund, there have been recommendations that partners and non-biological children of gay or lesbian victims of the September 11 attacks be excluded from benefits. I find such a recommendation to be particularly contemptible. Survivors of the 911 attacks have no less need for compensation nor condolences than do other survivors solely on the basis of the sexual orientation of the victim or of the survivor. If America is truly to be brought together by the 911 attacks and by America's response to them, then the response needs to be even handed. To exclude survivors on the basis of sexual orientation would be to pursue the narrow social politics of those who would divide us. To be even handed is to help bring us together. I urge that ALL surviving committed partners and children of all victims of the 911 attacks be eligible for compensation under the Fund. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. My husband &nbsp&nbsp&nbsp&nbsp&nbsp, a man of 6'2 205 lbs a beautiful man that I have been with for 26 years, was one of the victims from the World Trade Center Attacks. He was working at &nbsp&nbsp&nbsp&nbsp&nbsp that day. On Sept. 11, 2001 my husband woke up at 5 a.m. in order to get to work on time. I was working at nights at &nbsp&nbsp&nbsp&nbsp&nbsp, but it was customary for me to drop &nbsp&nbsp&nbsp&nbsp&nbsp off at the Train station every morning. On the drive to the train station that morning, &nbsp&nbsp&nbsp&nbsp&nbsp kept telling me how much he loved me and our three daughters. He said that he would be home early that day. Then he got out of the car, I watched him go down the stairs. When I heard about the attacks my youngest daughter &nbsp&nbsp&nbsp&nbsp&nbsp and I walked to Manhattan from our Queens home. We searched every hospital we could get to and nothing. When I got home at 1:00 a. m my other two daughters &nbsp&nbsp&nbsp&nbsp&nbsp 20 (Who worked with her father in till March and lost many close friends.) and &nbsp&nbsp&nbsp&nbsp&nbsp 22 went to Manhattan on foot as well. We had no results till Sept 18 when the Detectives came and said that they had recovered a third of &nbsp&nbsp&nbsp&nbsp&nbsp torso and an arm. My family and I went to bury &nbsp&nbsp&nbsp&nbsp&nbsp at his birth land of &nbsp&nbsp&nbsp&nbsp&nbsp. On the 19 of November, I went and had a fibrotic tumor removal on my breast, which left me on bed rest for about two weeks and I still have two more tumor removals left. When I had thought that the worst was over, the funeral home had called me on the 27 of November to tell me that they have found more of my husbands remains, they found his legs. Since I was still in bed rest I had to postpone the burial of my husbands remains because I was not able to fly. On the 19 of DEC with my doctors OK I again went to &nbsp&nbsp&nbsp&nbsp&nbsp with my daughters and in-laws. When I had returned from &nbsp&nbsp&nbsp&nbsp&nbsp one of my Uncles had died. The reason I am telling you this is because nobody knows firsthand what the victims families have gone through. Suffering isn't the word, it's more than torture. I don't feel comfortable leaving my house just like many of the victims but I know that I will go mad if I do. I am not telling you this to feel any pity or sorrow but just to show what I as well as thousands of other people are going through in this time. Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I must begin by telling you that I found your conduct at the Boston meeting to be reprehensible. You seemed to have a lack of understanding regarding who it was that you were speaking to, and what we had been through as a group. I know that you say different, but your actions contradicted your words. Furthermore, at the meeting, you said several times, "Trust me." Well, I didn't, and I was right. Second, your performance on "Meet The Press," this weekend was the worst kind of dishonesty. Oh, I do not believe that you lied, but you also did not tell the whole truth. You have, from the inception of this process, insisted on using the pre-collateral deduction figure as the "Average award," as you call it. You know that the American people hear this, and conclude that this is what the average check will be. Again, this shows that despite your insistence, we were correct not to trust you. Now to where you went wrong. Right in the Final Regulations, you state that the "Victims' Compensation Fund," was created to compensate victims for their loss. Another half-truth. Congress knew that it would have been both unfair, and unconstitutional to pass the "Airline Bailout Bill," which as you know not only bailed out the airlines through loans, but also capped the liability on each flight at the extent of the insurance coverage carried for it, without providing some measure of recompense for the victims' families. So the "Victims' Compensation Fund," was truly created to compensate victims for the loss of their rights, and opportunity. This is the first thing that you missed or ignored. I will grant you, that winning such a lawsuit is not a given, and it takes time, however, this too what you missed or ignored. Any insurer, absent the existing cap on liability, would choose to attempt to settle any case that the believed that they had a substantial chance of losing. The cap removes any motive to settle that the insurance company might have had, because they already know what their maximum expenditure will be. In closing, when you were in Boston, I had the opportunity to ask you one of the final questions of the day. I wrote my questions before I asked it, a fact I am very glad of now. My question went as follows: "As a historian, and as a teacher of history, I have developed an inherent distrust for the people within government. You have said several times times today, "Trust me."" I continued, "Then tell me something that you are willing to do, or are planning to do which will make me have trust in you. What changes are you planning to make which will make me trust you?" In response you first quizzed me on history, and when you seemed dissatisfied that I didn't back off, you choose to answer an entirely different question. When I pointed out to you that you still hadn't answered my question, and asked if you planned to do so, you said, "No, I haven't made any plans yet." That's when I knew that I had just wasted my time, because the fix was in, and as we say in Boston, "The whole thing was a bag job." I would appreciate any comments have in response. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This horrible tragedy was unprecedented and affected people from all walks of American society. All the affected deserve our help. Your administration has recognized that a compassionate and effective response will entail making certain exceptions to general U.S. policy on eligibility for public benefits, such as making compensation available to undocumented aliens (and protecting their employers from prosecution should such individuals come forward).
