Since then female labor force participation has grown substantially. Studies using more recent data (and replicating the methods used by the BLS) give female worklife expectancies that are 10-16% higher than the outdated BLS study. I am puzzled by the table showing losses for a single decedent without children. Who would qualify for this award? The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Monday, March 18, 2002 7:21 PM Be Fair to All Families I have recently learned that the Victims Compensation Fund will recognize families of all types, as long as those families are recognized under state law. I happen to be fortunate enough to live in California, where legislation now recognizes gay and lesbian "domestic partnerships." Although this law does not create the same legal status that is enjoyed by all married heterosexual couples, it does create rights with respect to actions for wrongful death suits and presumably would allow the families of gay and lesbian victims who were residing in California to collect money from the funds. Those victims who happen to live in states with less tolerant lawmakers deserve the same respect. Like their married heterosexual counterparts, they were living in committed, loving relationships and suffered a great loss in the tragic events of 9/11. Don't punish families from those states with less tolerant lawmakers by not recognizing their legitimate family relationships. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, March 20, 2002 2:56 PM Victims compensation for dependents of 9/11 tragedy I should inform you that I am not the type of person with either the time or inclination to engage in letter writing campaigns, even with regard to those issues in which I might have a personal interest, but I feel compelled to voice my opinion about an issue brought to my attention by a family member. The tragedy of September 11th forced a certain amount of much needed closing of the ranks of race, gender, political allegiance, and yes even religion in this nation. Yet it seems someone failed to notify those in charge of disbursing compensation to the families of the casualties of that horrible day. Appropriately, we as a nation have at least in this particular instance decided to set aside issues of illegal immigration, among others, that might normally be an impediment to the legal status of the people in need our financial support, but the same consideration has not been given to same sex partners. While not homosexual myself, I find it ridiculous that we should single out one "different" sort of dependent relationship to deny our consideration in this time of what should still be a period of national reconciliation. Please find the strength to rise above the political fray and do the right thing; treat all the victims of this tragedy with the same humanity and respect and provide domestic partners with the help they need and deserve. I did not have insurance thus that was my problem. I think it is a disgrace to give Federal Money for someone's death regardless of how it happened.
