Monday, March 18, 2002 11:53 AM 9/11 Fund Discrimination I have recently heard that the fund relies on state laws in determining who benefits from the fund. As a result, most same-sex partners of those who died in the attacks will not be eligible for such benefits. According to a statement supposedly made by Feinberg on March 10, 2002, he is not responsible for determining who gets these funds. He leaves that decision to the states once they receive those funds and that if the states choose to discriminate against same-sex partners of victims, it is out of his control. I believe this argument to be false. Feinberg has every right to encourage states to extend benefits from the fund to same-sex partners of victims. If it is true that illegal aliens and unborn children will benefit, there is no reason why same-sex partners could not as well. This form of discrimination undermines the very attempt at bringing all Americans together. As far as not having the power to tell the states how to distribute the money granted by the fund, why not simply deny the funds to states who choose to discriminate against any of the victims' families and loves ones, gay or straight, black or white, etc.. Federal funds for transportation departments can be denied to states that do not make laws for lowering speed limits or that make not wearing seat belts illegal. True, it could be that implementing these laws will decrease state costs and improve transportation; but, by allowing all victims' loved ones to benefit from the fund, the fund would improve society's morale overall, not limited to certain victims. I encourage Feinberg and the rest of those in charge of the 9/11 fund to reconsider their positions on fund distribution, to include all victims' families and loved ones. All those directly affected by the attacks are hurting/were hurt, and the pain is the same regardless of race, religion, age or sexual orientation. Thank you for taking time to read my opinion. If it is true, it is another infamy. I hope that it is just a rumor that the radical right is not petitioning that survivors of gay relationships will be excluded. (My qualifications for writing this note include 29 years as a practicing forensic economist, author of Determining Economic Damages (now in its 14th edition), current Vice President-at-Large of the National Association of Forensic Economics, former member of the Board of Directors of the American Rehabilitation Economics Association, and approximately 5,000 cases in which I have been retained nearly equally by plaintiff and defendant attorneys.) 1. The explanatory material notes you are relying on the Worklife Expectancy Tables published by the Bureau of Labor Statistics. These tables were published in 1986 using data from 1979 and 1980. As such, they are very much out of date, particularly with regard to female worklife. In a cost saving era, BLS ceased publishing these tables some years ago and began providing the underlying material to economists so that updates could be made by them. Such updates have, in fact, been made using much more recent data and the same methodology as used by BLS. The three studies already released were done by (senior authors only listed here) Dr. Tamara Hunt, Dr. Jim Ciecka, and Mr. Hugh Richards. In all three, the worklife for men has not changed greatly from the BLS study, but the worklife for women has steadily increased. You have explained that the earnings figures used for calculating the loss are after the deduction of income tax. This is a legitimate method, however there is substantial case law instructing that when earnings are calculated after tax, then the discount rate must be a "below market" rate to compensate for the tax that must be paid on the interest generated by the investment of an award. Below market means, for practical purposes, a discount rate that represents a tax free yield. In other words, high grade municipal bond yields. These yields are usually 75 to 125 basis points lower than the rate on Treasury bonds. Failure to use a below market rate to convert after tax income to present value double taxes the award. I am sure your are familiar with the published opinions on the use of these below market rates, but if you wish I can send you the citations. THIS IS WRONG! The victims and heros didn't descriminate and attempt to save only the gay victims and their memory shouldn't have the stigma of being excluded from the benefit bestowal! On September 11, my fiance, , kissed me goodbye, went to work (at , where he was a partner) and never returned. and I were together for five years and lived together for 41/2. We were to be married September 28, 2001. We were looking forward to starting our married lives together and starting a family of our own. At 's request, I had given up my job 4 years ago. During which time I was completely financially dependent upon him. Not only have I been robbed of my life partner, but of any future financial security as well. As I understand there is only one application per victim which presents a problem for fiancees/domestic partners. I am requesting that you take into consideration my situation as I was financially dependent on him and left with $6,000 bills per month. It is bad enough that I lost my life time partner much less to worry my financial security and where my life goes from here. In all fairness if the fiancees/domestic partner are going to be denied the opportunity to apply for the Victims Compensation Fund on our own, it should be determined how the settlement should be divided when there is a fiancee/domestic partner involved. It is very difficult to discuss these financial matters with the family and it might be helpful if there are distribution regulations set to protect people in these situations. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
