Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The President has spoken repeatedly of bringing the nation together and of taking care of each other, and this is the best possible way to demonstrate that at a time of incomprehensible grief, the federal government is not going to start making judgments about the way people live their lives. A lost breadwinner is a lost breadwinner, whether they are black or white, man or woman, straight or gay, married or co-habiting. Provided demonstrable evidence is available of co-dependence, be it a mortgage or lease or joint bank statements/credit cards, or less formal evidence, for not all of us merge our financial affairs with those we share our lives with, then the bereaved individual deserves support from this fund to the same degree as a "traditional wife and two kids" who lost a husband and Father. The appointment of a democrat has already gone a long way to ease the fears of those who suspected that AG Ashcroft would exclude all but married individuals from the fund - I hope very much that the new administrator of the fund will be as inclusive as possible in determining eligibility. Wednesday, November 07, 2001 2:46 PM re: charity and awards I strongly believe that the amount of charity a family has received should affect the amount of future awards they might be entitled to receiving from the government. It seems to me to be important to remember not only the victims and their needs, but to have respect for those that gave because they could, those that gave when they could have used it for their own families and those that pay taxes and have no choice in the matter. I hope that the award funds would be regulated in some manner so that abuses can be minimized. The Red Cross had funds available and I understand the need for immediate assistance, but I think that if a family received a large amount of money from this or any other charity, that amount should be taken into account when future award amounts are determined. Perhaps a figure could be reached as a guideline for that cap. According to the New York Times, some of the amounts distributed to the families were more than my yearly salary. I do appreciate the Red Cross and United Way and other large charities that are available to help in times like these, but the impression I have gotten since September 11th, is that they ask few questions, keep few records on how much or how many different charities these people have received funds from and I hope the Red Cross is taking into account that the funds they are using are not the Red Cross' but the money of hundreds of others who want to help that they are responsible for and would use the money with that responsibility in mind. I think most people would be disappointed to discover the possibility that a charity paid for a particular situation, such as a funeral, a car for transportation, several months of mortgage payments or rent, and then have the same family receive additional funds from the government for the same situation. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. I knew that I had just witnessed my husband's murder and I could do nothing about it. I lost my soul-mate, my best friend, partner and confidante. He was young, handsome and vibrant. We have received he dreaded knock on he door in the middle of the night, the police telling us that bone fragments have been recovered. I am a 31 year old full time mother of a one year old child who will have no memory of his father. I am not "well off," I am not destitute. We have worked hard, planned carefully and lived within our means to try to ensure that we would never become destitute. I consider myself to be "average." According to the interim rules, I will receive no benefit from the Victims Compensation Fund. We did not ask for this fund. But we must deal with it. The option to sue has been made not viable. The reason "The Fund" exists is that our right to litigate has been severely restricted. Congress' intent was to fairly compensate the families in return for their loss. We are not greedy. We wish to fairly and accurately be made whole for what we have lost. In order to be fair and more accurate, the following concepts need to be taken into consideration: - Use the decedent's most recent salary. The interim rule ignores 2001. Many young professionals have significantly increased their wages in the past year- do not minimize their hard work and accomplishments. - Averaging the three prior years salary will result in significantly reducing economic damage estimates-and penalize the victims for being young and successful- consider using the best of three years income to more accurately reflect the individual's earning potential - Use statistical data that is more relevant to the population effected- i.e.,- company and industry in which the decedent worked; local/city/state averages vs national. - Earnings potential should also factor in any eminent college degrees, professional designations, etc., on a case by case basis. Such accomplishments generally will dictate earnings beyond the formulas used. - Collateral sources-Should not be deducted- I know...we need to fight that with legislation but it is worth mentioning. Families should not be penalized for responsible financial planning or being successful. The DOJ and special master should seek to minimize any deductions that are mandated. Social Security alone would reduce my benefit by half. - Collateral sources- should be more clearly defined as to what is and is not a deductible offset. To be considered a deductible offset, the amount has to be identifiable. How can social security be accurately deducted? How soon will I get a job? die? remarry? How long will social security actually be paying these benefits? ; How can workers comp be deducted fairly? Will families have to return workers comp payments? -Collateral Sources- should it only include compensation that is government funded? I can understand the government wanting to avoid "double dipping" in the case of other government programs. Life insurance, company benefits, etc., are not government funded. They are a product of the individual's good financial planning and the contract they entered into when accepting a position at their workplace. Those benefits were earned. - As has been stated numerous times by TLC and many others, the non-economic damages are too low. This legislation was passed 11 days after the attacks to save the airline industry and our economy. In doing so it diminished my rights. The fund was established to make up for that loss. At the time it was established, it was estimated that there were 6,000 victims. Congress was prepared to set this fund up to compensate 6,000 families. Thankfully that figure has been cut in half...The government will have to pay out less than half of what they were originally preparing to pay. The media is reporting that the average award from this fund will be 1.65 million dollars. They forget to mention that there are huge deductions that will be taken from this amount. As a result the ill-informed public think that the "average" widow will be made a millionaire and is greedily looking for more. I attended a meeting with Mr. At the meeting, said that no one likes to admit it but our government puts a price on the value of a life every day. He said that the price was a couple of million dollars. If these perceptions were actually correct, I would not be writing this letter. Thank you for your consideration. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
