Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Zwick As a concerned citizen, I am anxious to find out what the millions of dollars that were donated for this specific tragedy are going and how are they being accounted for? The American Red Cross seems to have indicated that they would spend the money as they see fit. If this is the case, it is not what the people donated the money for. These donations were made by concerned people who felt they wanted to help those affected by the happenings of September 11, 2001, and the money was donated for that specific purpose. Every effort should be made to insure that the charitable actions of the people be used for the purpose for which the people intended. I CANNOT believe that the 9/11 Victims Fund would exclude gays and lesbians who were in a relationship from claiming benefits for the surviving partners. I am also at odds with not expelling illegal aliens and punishing their employers. But I am most angry at the policy of paying off people who were not in the service of their country at all. The families who deserve payment are those of our servicemen and women who will lose their health care and food stamps if their loved ones die or are maimed in the line of duty! Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. In order to ensure that the victims of the 9/11 tragedy and their families receive fair and just compensation,and to the fullest extent consisitent with the statute, I urge the adoption of regulations that will judge each case on an individual basis. I have read with dismay that there is a push to have the victims' damages judged according to a chart or matrix.Having specialized in this area for over 20 years, I know that no 2 cases are alike and that even when claimants suffer the same injury, so many other variables dictate a different result. This is especially so in the case of the victims who perished on 9/11. I am also a proud member of both the New York State Trial Lawyers Association and The Association of Trial Lawyers of America and signed up for their project in which I will be representing claimants pro bono. Tuesday, November 06, 2001 9:41 PM Suggestion 11/6/01 - One of the major complaints victims have expressed in trying to collect benefits from charities re 9/11 is the extensive paperwork they have to complete each time they go to a different charity.  DOJ could easily persuade or compel all charities to use a uniform information sheet with family's personal data.  Put that form on your web site and let victims' families download the form on their own floppy disk.  95% + of victims are computer literate enough to do this themselves, and the other 5% can get help from most libraries which now have computers.  Then when they visit each charity, the charity can download the information they need without having to write anything out.  Just sign the form to verify its accuracy.   Over time, perhaps a serialization could be entered on each disk so that every charity and agency could check and see what benefits every other agency had paid out, to avoid duplication and fraud.   In 5 to 10 minutes all of the 'paperwork' involved in processing a claim would be completed. Thursday, November 08, 2001 9:10 AM Please help!! Hello, I live across the street form the World Trade Center. I still have not been able to reoccupy my home. The problem that I am faced with is that my windows were opened during the incident on September 11th which left my apartment and all of its contents covered in a thick layer of ash, dust, etc. Now, I am faced with the expense of having to buy a new couch and a new bed. FEMA and the Red Cross said they won't help us with this. What do I do? I don't feel I should have to pay for new furniture when the stuff I had was perfectly fine. I also do not want to keep it due to the health risk it poses by having it in my apartment. There are millions of dollars that have been donated for the victims of September 11th yet no one can seem to help us. I don't have the money to just buy these new things and it aggravates me that I should have to pay for these new things when I was not the one who ruined them!!!! Does anyone have any suggestions as to where I can turn. I was told by FEMA that I can take out a small business loan. Why should I do that and put myself into more debt???? Please help! It is not the taxpayers duty to provide compensation when there's nobody left to sue. Now I respect the fact that the Airlines will go under if they had to provide the $$$ for these families and the market can't take them going out of business. But it is not right to take the taxpayers money and award it to the families of this horrible disaster. With the potential of 1.6 million dollars as an average, I feel it is just way over the top. I've been working for 16 years and I haven't even earned $80,000 yet. Now i'm married and am currently furthering my education with a scholarship i won in a competition. My wife is the only one with an income and believe me when i say that we watch every dime closley. We simply cannot afford this. Especially when they say that this is only the beginning. Will we continue to make victims millionaire's over night? And how about the victims at the Oklahoma bombing or the Embassies or even the father that get's shot down in Compton? What of them and their's? Will we always be liable? Me? I believe that there are other options available to compensate them with. The siezed assets of all of theterrorist organizations would be one way. Where's all of that money? How about all the charities? Where's all of that money? How about the airlines insurance companies because after all it is their fault for allowing the terrorists to get through their security gates? Where's that money? Let's face it. There is nothing in the constitution that guarantees that as american citizens and travelers to America, that they will be protected and secure against harm. And it most certainly does not read that in the case of such a disaster that the American citizens will make them millionaires. I can't believe the people we elect to come up with this crap and spoon feed it to us like we're a bunch of 2 year olds. We need to hold the countries and the financial orginazitions who harbored and supported the terrorist organisations responsible and make them compensate the families for this horrible situation.
