The pain and suffering of the past few months is immeasurable in a dollar amount. If it was however it would far exeed $100-500,000. Let's be realistic. We,the families, went through weeks of not knowing if our loved ones were alive, we are left to imagine the way in which they died, and we have been forced to make many exhausting trips into the city. On top of that we have bee bombarded with the recognition of NYPD and FDNY. Everyone died doing their job. It is wrong to acknowledge people by occupation. A BADGE DOES NOT MAKE A HERO. And the statue that will be erected with the firemen putting the American flag on the antenna of the towers should not represent the firemen who died. Who is to say that one of the waiters, for example, working in Windows of the World was not saving money to go to college to be a doctor. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I urge that the regulations you promulagate and your administration of the fund ensure that all victims receive full compensation for their losses without regard to their sexual orientation. Just as those who died in the World Trade Center spanned all races, creeds, and colors, the tragedy touched lesbian and gay families as well as heterosexual families. One of the heroes of September 11 on board United Flight 93, &nbsp&nbsp&nbsp&nbsp , was a gay man. Many of the lesbian and gay victims are survived by longtime partners. &nbsp&nbsp&nbsp&nbsp lost his partner of 17 years. &nbsp&nbsp&nbsp&nbsp , a project analyst at &nbsp&nbsp&nbsp&nbsp with whom he shared a Yonkers home. &nbsp&nbsp&nbsp&nbsp lost her partner &nbsp&nbsp&nbsp&nbsp , &nbsp&nbsp&nbsp&nbsp at &nbsp&nbsp&nbsp&nbsp on the &nbsp&nbsp&nbsp&nbsp floor of One World Trade. Their stories, and the stories of the other gay and lesbian victims of this tragedy, are as compelling as any others'. The need for support and recompense is no less real for these survivors than it is for the countless other relatives who lost loved ones. America has reached out with enormous generosity to all of the victims because our common humanity recognizes that grief and loss are not reserved to any single culture or group--they are borne by each and every one of us, whatever our race, religion, or sexual orientation. The laudable purpose of the September 11th Fund is set forth clearly in the Act: to provide compensation for the losses of those who died and those who were injured. It is crucial for the many deserving families that the regulations implementing this Section permit recovery for all deserving relatives, including the committed partners of gay and lesbian victims of the terror attacks. For those whose family relationships do not meet certain strict formal legal definitions, such as same-sex partners and non-biological children of victims the enormity of the loss of a beloved companion and parent could be compounded by the prospect of ineligibility for compensation intended for their protection. The Department of Justice should not permit this potential inequity. I urge you to include among relatives eligible for compensation those who lost their life partners or non-biological parents, regardless of sexual orientation and marital status. Just a few days ago, Governor Pataki issued an Executrive Order granting surviving same sex partners of the World Trade Center attacks comparable benefits to those received by surviving spouses from the state's Crime Victim Board. (The Board, I note, receives a large proportion of its compensation funds from the Department of Justice's Office for Victims of Crime.) In many other areas, New York state and local laws recognize that an array of people come together to form families that are emotionally and financially interdependent, and the law has been taking affirmative steps to protect those who face peril when a family member perishes. These court rulings, laws, and executive orders deserve special consideration and carry special weight because the vast majority of the victims of the September 11 attacks were killed in New York, and New York law would normally apply in compensation litigation. Our nation has come together in this time of tragedy to lend its unqualified support to all the innocent victims of the attacks. We must stand united to fulfill our moral obligation to all those harmed by this tragedy. I therefore believe that all same-sex partners and non-biological children be eligible to serve as proper representatives for claims related to individuals who died as a result of the September 11th attacks. I further encourage you to treat non-economic damages, such as loss of companionship and loss of consortium, identically for those victims who were in heterosexual and homosexual relationships. Ensuring that same-sex partners and the non-biological children of victims receive compensation permits the federal fund to be distributed with basic equality and fairness to all those in need. And it upholds the fundamental values of liberty and equality cherished by all Americans, values that we are all fighting to defend as we wage war on those who are bened on undermining our freedom. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. No one can put a price tag on the life of a loved one. You are charged with the difficult task of doing just that in your honorable work of trying to compensate the victims and families of the vicitms of the September 11, 2001 tragedy. I urge you to create a system that allows all victims to have compensation that is unrelated to their salary. The man or woman who was the sole support for a family and worked as custodian or dishwasher should be compensated equally with those who worked as stockbrokers. I know that this will be a difficult task, but I do suggest that you take at least 75% of the money and distribute it equally. The remaining 25% could be distributed based on prior income. I do realize that some people affected have higher bills to pay and a more expensive lifestyle to keep up. By doing the distribution in this way, you try to walk a fine line between equal distribution and distribution based on prior income. Monday, January 14, 2002 1:51 AM Comment on Interim Final Rule January 13, 2002 Dear Director Zwick, As a brother of a victim who was murdered in the World Trade Center, lets talk about what the special nature of this ?fund? should be. The fund should be set up because people like my brother were going about their business in the WTC and were murdered largely because the US government were unconcerned, uncommitted and about three months too late in protecting them. Furthermore, the fund is being set up because the US government didn?t act when the same terrorists attacked the same WTC tower in 1993 (didn?t the severity of this attack give you any hints, massive bomb, luckily few deaths). What about when American embassies were attacked in Africa, and American military interests were attacked (i.e. the Cole) in Yemen? If my brother, had died under different circumstances, he would have received his life insurance and other regular benefits, and that would be the end of it. But he didn?t die that way. He died a ?wrongful death? and government organizations (i.e. like the FAA) and companies the government wants to protect (i.e. the airlines) are culpable. So to summarize, the reason that the federal fund has been set up, is to compensate our family for this ?wrongful death?. The fund is there so that families like my own do not sue the various agencies, governments, companies and individuals responsible for their deaths. So why is the government offsetting benefits like life insurance (i.e. the collateral compensation) from the victims compensation payout? After all my family would have received this life insurance had my brother died a ?normal death?. Don?t let people like my brother - who paid life insurance premiums and who died because of significant negligence - bail you out. Instead determine an amount that we deserve for the ?wrongful death? of a 34-year old of significant worth, and don?t offset this by anything. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
