I am writing this letter to ask the Justice Department
to include among relatives eligible for compensation from
the September 11 Victim Compensation Fund those who
lost their life partners as well as de facto parents or

status. I ask the U.S.Government to follow the
example already set by New York Governor Pataki in
granting compensation benefits "on a showing of mutual

movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

While overall, I think the interim final rules represent a good effort to treat victims fairly, I believe the following changes will solve some of the issues that remain and bring the rules more into line with the provisions of the Statute.
After a thorough review of the proposed interim rule, I have the following comments:
1. Calculation of Income. For purposes of determining economic losses, a victim & #8217;s base compensation appears to be his or her pre-tax earnings for the three-year period 1998-2000, including salary and bonus plus certain employer benefits. Why would the formula choose to use 1998 and ignore the victim& #8217;s most recent salary in 2001? Most of the victims were employed for nine out twelve months in 2001 and it would be easy to extrapolate the victim’s full 2001 salary. In many cases it would seem that the 2001 salary would be more indicative of a victim’s actual earning potential than his or her 1998 salary would. This is particularly true for younger victims who in most cases would have a much higher salary in 2001 than in 1998. Which year is more relevant? In the case of many of the victims, certainly the 2001 salary is more relevant. The regulations should be amended to allow the claimant to have the option to use either 1998 or 2001 in the three-year average. This can be done b
y amending the second and third sentences of Part 104.43 of the regulations pertaining to salary to read:
“The Decedent& #8217;s salary/income in 1998-2001 shall be evaluated in a manner that the Special Master deems appropriate. The Special Master may, if he deems it appropriate, take the higher of (i) an average of income figures for the three years 1998 through 2000, or (ii) an average of income figures for the three years 1999 through 2001.”
The regulations also need to be a little more clear on what & #8220;certain employer benefits” means. It would seem that all employer costs associated with compensating the victim should be considered a part of his or her compensation. This would include employer premiums paid for health insurance, dental insurance, life insurance, and workers’ compensation insurance. It should also include employer contributions to a victim’s pension plan or 401K plan. These types of payments are no less a part of compensation than a victim’s salary was.
2. Victims Engaged to be Married. The treatment of victims who were engaged to be married at the time they were killed on September 11 is not addressed in the interim final rule. FiancĂ©es appear to have no standing under the fund, even though they were often the person who was the closest person to the victim and the person whose life was affected the most dramatically. In addition, the compensation charts (particularly the calculation estimating how much of his compensation a victim would have personally consumed) assume that the victim would not have kept his or her promise to marry. If a victim was married without children the interim rules calculate his or her economic loss using a “consumption factor” that is based on the victim sharing his earnings with his spouse. Meanwhile, a person who is unmarried is deemed by the charts to have consumed almost all of his earnings himself. This is so even though the victim is engaged to be married and planned to have children, and would not have c
onsumed all of his income himself. While it is speculative to estimate the number of children, if any, that a victim would have had, it is not speculative to assume that the victim would have gone through with his or her promise to marry and thus have a lifetime of mutual support. If a victim was engaged to be married the chart showing “Married Decedent with No Dependent Children” should be used. The fact that September 11 cut short the lives of some of the victims at a time when they had not yet completed their plans to wed should create be an assumption that the victim’s future personal consumption would have been that of a single person.
3. Calculation of Non-Economic Loss. It appears that the interim final rules ignored the Statute in determining non-economic losses. While it is impossible to scientifically calculate the proper amount to award for non-economic losses, the amount of “presumed non-economic loss& #8221; of $250,000 plus $50,000 for each of the victim’s spouse and dependants is not in concert with the Statute. The Statute passed by Congress and signed by the President defined “non-economic losses” in twelve categories, including losses for:
- physical and emotional pain,
- suffering,
- inconvenience,
- physical impairment,
- mental anguish,
- disfigurement,
- loss of enjoyment of life,
- loss of society and companionship,
- loss of consortium (other than loss of domestic service),
- hedonic damages,
- injury to reputation,
- and all other non-pecuniary losses of any kind or nature.

There is no mention in the final interim rule of any of these specific losses that the Statute requires to be awarded. The Statute did not say that victims would only be awarded the same amount as “roughly equivalent to the amounts received under existing federal programs by public safety officers who are killed while on duty or members of our military who are killed in the line of duty.” The victims if September 11 were not public safety officers or members of the military killed in the line of duty. They were clerks, waiters, accountants, office workers and executives who were murdered when innocently going to work one Tuesday morning in September. They were murdered for what they symbolized, America’s freedom and economic success. They were murdered because of a failure by the airlines, security firms and the government to put adequate safeguards in place to properly protect the nation& #8217;s air transportation system.
Since Congress decided that it would be in the best interest of the nation to prevent the collapse of the airline industry by limiting lawsuits brought be victims, these victims are entitled to receive compensation in line with what Congress spelled out in the Statute. Although Congress could easily have written the Statute to state that non-economic awards should be comparable to awards given to public safety officers or the military, it chose not to do so. Rather Congress specifically spelled out the factors that should be considered in determining the amount of non-economic damages. Yet, the interim final rules chose to ignore these factors and substitute the judgment of Congress with this “comparable to the military” calculation. It should also be noted that awards to public safety officers and members of the military are not reduced by the amounts of any additional life insurance that such public safety officers or members of the military may have purchased on their own behalf. Thus, f
or many victims the amount they receive under the Fund would be substantially less than a public safety officer or member of the military under that federal statute.
There is no doubt that a jury would award a significantly higher amount for non-economic damages in a court action (Courts have awarded higher amounts than this to people who were burned by spilling cups of coffee on themselves). In many cases the September 11 victims suffered indescribable pain, agony and mental anguish for prolonged periods of time (up to several hours). All of this time the victims were aware that they were going to die a horrible and painful death. I understand that it would be difficult to address non-economic pain and suffering on a case-by-case basis as who is to say which victims suffered more than other victims. I think having a set amount for all victims is the fairest result. However, the amount needs to consider the factors set forth by Congress in the Statute. One way to come up with an amount for non-economic damages is to take an average of what was awarded by juries in any cases where victims suffered greatly for prolonged periods of time, knowing that their fate was to
die within hours.
Increasing the amount of non-economic damages would also help to solve two other criticisms of the interim rules. (1) it would help to close the gap in awards between highly compensated individuals and lower compensated individuals, and (2) it would increase the gross amount of the awards prior to deducting life insurance and other collateral sources of income making the fund a more viable alternative to many that would otherwise file law suits. A significant increase in the non-economic awards would go a long way toward bringing the interim final rules into concert with the Statute passed by Congress.
I would like to thank you and your staff for taking on this very difficult task and trying to “do the right thing” by all of the parties involved. As we all know, no amount of money could come close to adequately compensating the families of victims for what they are going through. The victim compensation fund (the “Fund”) is an attempt to provide for fair and just compensation outside of lawsuits. It is far from a “free lunch” though. The Airline Stabilization Act (the Statute”) put severe limitations on a victim& #8217;s ability to recover from the airlines and from other negligent parties. The Statute was conceived by Congress as a way of ensuring that the airlines are not brought to financial ruin by the immense litigation that would follow this attack. Such litigation and the financial collapse of the airlines would have had a devastating affect on the US economy. The resulting business slowdown would have deprived the US Treasury of significant tax receip
ts equal to many times more than the cost of this Fund. Because of this fact, the existence of the Fund will, without a doubt, save the taxpayers a significant amount of money.

Dear Mr. Zwick,
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the commited partners and non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Victim Compensation
I do NOT think a victim's compensation should be reduced by any pensions or
insurance for which the family planned and from which they may benefit.
I DO, however, think compensation should take into account other funds the
victims' families may have received from other charitable sources, such as
the Red Cross fund.

Comments on WTC Victims Compensation
I am the mother of a fallen Firefighter who remains
missing to this date at the WTC..
I would like to tell you how patently unfair the present Victims'
Compensation Regulations are in general, and in my case, it is specifically
unfair to members of the uniformed services such as my son.
It is an insult to limit to $250,000 non-economic loss. The loss
of my son, and my pain and suffering is incalculable, and a limit of this
amount is truly insulting.
Your method of calculating "worth" by averaging the last three
years income is also patently unfair for my son's case because he spent the
previous five years of his life IN SERVICE TO THIS COUNTRY IN THE US MARINE
CORPS, earning, as you may be aware, below poverty level wages for his
loyalty and service to this country.
In addition, he was earning an extremely low salary with the
FDNY, , and was definitely not getting a
salary that was commeasurate with Firefighters' salaries across the USA.
Another extremely unfair aspect of your "Regulations" is the
deductions of insurance, awards, pensions and other "collateral sources."
This is unfair for the following reasons:
The Federal Award for losing your life in the line of duty was
never meant to replace any other source of reimbursement. This is something
that our society gives to its public servants, and they should NOT be
penalized for being a public servant.
If you are responsible enough to buy and pay for life
insurance, you should not be discriminated against.
If a Police or Fire officer dies in the line of duty, society
gives them a hero's award of a pension for their family for life. You have
no right to once again penalize the person for being a hero. It is patently
unfair to deduct a hero's pension from the settlement.
Why is my son's life worth 50% less because he is single? Why
is my son's life worth less because he was a responsible person and did not
have any children? His worth is incalculable to me! His loss is
irreplaceable .
According to your guidelines you are penalized for being
responsible, for giving loyalty and service to your country, for being a
public servant, and for being a middle class American.
You are insulting and discriminating against The Firefighters,
Police and EMS workers. In addition, your settlement terms are equally
unfair to the civilians.
It is an American disgrace that the Airlines are protected,
Larry Silverstein Properties are protected, the Port Authority is protected,
but the only ones who are NOT PROTECTED ARE THE 3,000 victims of the World
Trade Center Disaster!

After reading some of the comments, I must say I'm a little puzzled, the purpose of the fund as I understood it Was to have victims not sue the airlines, and receive a just compensation from the victims fund,if its in the millions, that is what one can expect from a lawsuit.

Family Crisis Relief Benefits

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

What a deal.
If their loved ones had died in a car wreck, they would have received the
life insurance policy on them and social security aid for their children.
As a retired officer my question is: what do the families of the soldiers
who have died over there going to get? They will get the life insurance and
social security for their children.
Just another case of the Federal Government forgetting the military. These
soldiers died in the defense of the country and also from direct or indirect
terrorist actions.
What is the difference?
I say the majority of the money should go to the airlines and the other
soldiers who gave their lives after the event. The soldiers I am talking
about are the firemen and policemen.

Victim's Compensation Fund: 9/11
Dear Mr. Zwick:
I am writing in about the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other. This is not the proper time or forum for Americans
to debate this issue.

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist      , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
     accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

To Whom it May Concern:
It is appalling to me that patriotic Americans whose family members were
killed on September 11th would not be allowed to receive funds from the 9/11
fund just because the victims were gays or lesbians. How can a country which
works so hard to fight discrimination be so complicit in perpetuating it? How
could you believe that gay partners grieve less, need less or feel less than
other Americans? That is what you are saying by denying some Americans aid
because of their sexual orientation. Hiding behind the veil of "we can't go
against state law" doesn't wash. This is a fund created by donations of
Americans who weren't asked what their orientation was before you cashed
their checks. If gay people are encouraged to support their country and its
fallen heroes, the country must support them as well.

Compensation for victims
To Whom it May Concern:
I read of the call for public comment on victims' compensation.
I heartily agree that it should be given. In my opinion, I think some
consideration should in fact be given to what resources the families have
regarding insurance, charity relief, and so on. A fireman's family does not
have the resources of a top corporate lawyer's family, and although both
fathers might have perished horribly, one bereaved family will be more
financially sound than the other.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per year might receive thousands of times as much compensation as the survivors of a dishwasher in
one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent
worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It
would be a double blow to the survivors to first lose their loved one and then watch as most of the
taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

HELP ENSURE COMPENSATION OF GAY AND LESBIAN VICTIMS' FAMILIES

Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. To suggest otherwise is simply
ridiculous. That anyone would even think to suggest otherwise
makes my head spin. And the Christian fundamentalists accuse
gay people of having an agenda? Then what do you call this attempt
to deny surviving members of families of gay and lesbian people
the same compensation received by familes of straight people?
I call it out-and-out bigotry.
Any legislation that is written to deny compensation to families of gays
and lesbians killed by these attacks is as evil, vindictive, and heartless
as the attacks themselves. I trust the Department of Justice will insure
justice for EVERYONE, not just straight Christian people.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Once again it seems that discrimination is being demonstrated full
heartedly. The Gay and Lesbian community has taken yet another blow when it
suffers prejudice because of the lack of compassion or insight that certain
individuals have in this country. It saddens me that people receive less
support, benefits, and are treated as being less patriotic because of who
they choose to have a relationship with.
I would hope that those who are making the decisions on victims benefits
seriously consider the message they send when they treat a selected group
of American citizens differently then even those who are not even
Americans. Surely we can show support and concern for all those who
suffered the loss of a loved one on September 11th.
Please do the right, ethical and fair thing and give all those who lost a
loved one equal rights and treatment. Support Gay, Lesbian and Transgender
partners the same as others.
