Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Is the governmment actually kidding that any family should have a spouse's life insurance policy or personal bank accounts deducted from the compensation amount. Also the nerve of the government deducting the spouses and childrens' social security from the final compensation. The goverment is so out of line. They protect the idoitic airline industry who did not do their job by having proper security in force. The government again is trying to the people. I am sickened by this. I am outraged by this. How can anyone discriminate against one portion of the population like that? It is a dire insult to the heroes who died who were gay. I am writing to urge you to change the approach concerning the designation of personal representatives to enforce and receive compensation as a result of the September 11 events. The creation of the fund to manage airline liabilities, give sure compensation to victims and avoid diversions of effort into investigations of possible fault and legal liability are all worthwhile, but do not adequately explain the best reason for this fund - to allow the entire country, in some measure, to shoulder the burdens of this attack, and make tangible measure that this was an assault on the entire country. This means that the hallmark of the administration of the fund needs to be practical justice and fairness, not tied to idiosyncratic issues of local law and certainly not subject to varying outcomes based on extraneous circumstances. Unfortunately, the proposed approach fails these elemental questions of fairness. You should adopt a federal standard, and use a broadly inclusive federal definition of the critical person - the personal representative. In particular, you should recognize the dignity and effect of long-standing domestic partnership relationships, including gay and lesbian relationships. The proposal intends to use state law to find persons entitled to compensation and use state law definitions, or equivalents, to define the person entitled to administer compensation - the personal representative. This would lead to varying results, even withi a state. In Maine, for instance, creditors, including contractors, may qualify as personal representatives of an estate. Domestic partners may register as long term contracting parties in Portland, Maine's largest city, but not elsewhere. Some county jurisdictions routinely approve adoption of children by gay couples, while others have never done so. Personal representatives may be nominated in a will. Claims for wrongful death are maintained under Maine law by the Personal Representative for the benefit of the heirs, not the devisees of a will. This means the Personal Representative who is a domestic partner may not be entitled to any portion of a claim, which must be distributed to sometimes distant relatives instead. The claims fund proceeds for an eligible individual are reduced by collateral sources - these claims, for disability or death insurance, survivor benefits, etc. are often contractual in nature with a named beneficiary. The interplay of this with all of the other factors means that individuals would have varying motivations to shop for forums where they are advantaged in some way. There are probably places in America which still define either domestic partner or gay/lesbian relationships as meretricious or even illegal. Millions of children are born each year in unmarried relationships. Allowing the varying details of state and local laws to dictate how the national purposes behind the victim compensation fund will function is not sound. The domestic partners and children of these murdered Americans deserve to come first. People who have responsibly managed their lives so that their families would be protected in the event of an accident are to be HONORED for their responsible behavior and NOT penalized! They should receive compensation regardless of monies received from insurance. If you do not change this rule what you are in effect communicating to the victims and our nation is that it doesn't pay to be a responsible citizen and protect your family with insurance because others who HAVE not been responsible will be compensated the same. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, March 15, 2002 12:22 AM Include Gay and Lesbian Survivors in Fund Benefits Dear Kenneth Feinberg and Whom It May Concern at the September 11 Fund, As a graduate student at the University of Washington in Public Policy and as an out and proud lesbian, I am appalled to hear of the audacity your organization and the Department of Justice are demonstrating in excluding Gay and Lesbian survivors from benefits of the September 11th Fund. I am familiar with the argument that discriminating policies of the State can not be overriden by the Federal government. The argument serves as justification for not having a national policy to protect Gay and Lesbian citizens in terms of Constitutional rights, hate crimes, and marriage. However, although I understand the arguments, I do not agree with, nor condone your statement to not extend benefits to Gay and Lesbian survivors of September 11th. Following a direct mandate from Congress and serving the arm of the U.S. Department of Justice, the September 11th Fund has a greater responsibility of representing the wishes of the American people than the narrower focus of individual states. Your agency is empowered to set a standard of fair compensation to the families of heroes, the survivors of loved ones. Saturday, March 16, 2002 5:44 PM 9/11 fund Dear Mr. President: It is with great honor that I feel that I am permitted to write to you -- and it is with great sadness that I approach you with what I see as a great injustice. The 9/11 fund set up by The United States Congress has developed into an all inclusive fund that will aid the many thousands of persons who died in the flames of hate. These persons were the innocent victims of the "evil ones" and each one of them were heroes in some way. Now we see that the 9/11 fund is going to be able to try in some way to financially remunerate their families and loved ones. It is impressive that the United States of America has seen fit to honor these persons, making payments to their families, making payments to illegal aliens, making payments to as yet unborn children. Each claimant comes to the table regardless of circumstances and is heard. It is our attempt as a caring and loving society to help these survivors to begin again. In all of this we have attempted to make sure that the hyphenated American disappears. We are not dealing with Italian-American or Irish-American or African-American -- we are dealing with Americans. And it is an honorable thing, a position that is long overdue. Yet Mr. President, all of this lacks one thing -- the gay and lesbian persons still are hyphenated. For in the 9/11 fund they do not count. Their lives do not mean anything to the Federally Mandated Fund. Mr. Feinberg has stated emphatically that the partners of gay and lesbian people who died on 9/11 will not be included. How terribly sad that a segment of the heroes of 9/11 are to be left out. Considered as non-victims, considered as if they didn't even exist, as if they were not a victim of the "evil ones" as if their lives did not count and that their families are not even worthy of consideration by the government of The United States of America. Mr. Feinberg's reasoning is that if state law does not recognize these relationships there will be no payments made to survivors of gay and lesbian persons. Yet how ironic that the Fund is set up by the Federal Government -- the Fund for 9/11 comes from federal funds. It makes me so very sad to realize that my government does not even care that gay and lesbians exist -- that the gay and lesbian's life isn't worth any kind of recognition, that all of the citizens of this vast country that are gay and lesbian don't have any status with those that died on 9/11. Please Mr. President, I beg you to make the first move. Open your heart as you have so many times since 9/11 and see that these persons are also included. Your doing so will make the statement that ALL persons within this vast and diverse county have a place -- that those who died in 9/11 are all looked at as Americans equally deserving of respect, care, concern and nondiscriminatory recognition and thanks through the 9/11 Fund.
