What about all the trauma people are faced with now? Who need counseling? Who lost homes, jobs? I think if Americans were told that some of their donations would go to these people, they would be just as happy. Everyone who was directly affected in some way (after all, we were all traumatized, but I'm sure that to be there, to have seen it, to have run for your life from it, to have looked for your child at a daycare near ground zero, etc., etc....this is a greater degree of trauma than for those of us who were traumatized by watching the scenes on TV or even for those of us who couldn't reach relatives for hours in NY) should be eligible to make claims. The elderly who can't home, who lost pets, the children who need counseling from continuing nightmares, the WTC unemployed, survivor guilt, all these issues are very important and people need financial resources to deal with them. Friday, November 23, 2001 5:57 PM Comments regarding September 11th victim compensation fund In reviewing the proposed legislation and comments I would like to express my concerns. The way the legislation reads presently, women who lived with men who would be their future husbands can not benefit. There are many women who lost the man they were going to marry but unfortunately they were killed before the wedding dates. These women, including myself, deserve to be compensated separate from the "next of kin". I have seen numerous comments addressing the same concern and know I am among many young women in the same situation. I would ask that the legislation consider me and the other women as potential claimants and give us the ability to receive the financial support that their future husbands would have provided. The majority of us effected in this way are young and would have had a life time of earnings, love and support. Friday, January 04, 2002 5:40 AM Comments It is highly disturbing to know that as Survivors of the 09/11/01 World Trade Center Attack, financial assistance is given to survivors of the victims, and to survivors who have sustained physical injuries and is not given to us. I write on behalf of all these individuals who have survived the WTC attack without any physical injuries, but whose lives have not been the same since that tragic day. Do survivors have to sustain physical injuries to be compensated? Is our Federal Government not taking into account the emotional and psychological injuries that survivors have sustained and will have to live with for the rest of their lives. As a nation, we have all suffered, but the ones who continue to suffer are the ones who survived the attacks on the United States of America, those who were in both One and Two WTC, and those in the Pentagon; these are the ones who live each day in fear of the unknown. I am not attempting to lessen the pain and grief experienced by families, due to the loss of loved ones, and also thousands of lives that day; the point I am making is that thousands more who survived the attacks relive this event in some way each day. Are these individuals not entitled to restitution for our Federal Government? Do we have to be scarred, wounded, or pronounced dead to be restituted? The airline industry has been promised, and have received billions of dollars which will bail them out of Chapter 11, instead of this occurring, why did they not take the initial steps to put safety first. They are the ones whose product and service was used against us; but, it is o'kay to pour billions of dollars into that industry to "keep it afloat". It seems our priorities are not in order. It seems that the loss of lives, the massive amounts of physical injuries, and the countless survivors who continue to experience emotional and psychological trauma is less important. All victims and survivors should be compensated by our Federal Government. There should not be any discrimination in who should be restituted and who should not. Monetary compensation is the lest form of restitution for such a horrific act. Think about the thousands of survivors who find it difficult to exist from day to day due to the ghastly and horrible images implanted in their minds. Think about the thousands who barely escaped with their lives before both buildings crumbled. Think about the thousands who walked down 100, 90, 80, 70, 60, and 50 flights of stairs to get to safety. Does this not call for some form of restitution. There are stories of many of my workers, and countless others, including myself, who barely escaped with out lives. Think about the people walking along the stairways or in the elevators, in both one and two WTC who when both planes hit the building at different intervals, witnessed their fellow co-workers or a stranger instantly killed by such brutal force, but they were spared, however, they must live with this image in their minds. Think of the ones who barely escaped with their lives out of one and two WTC, and in their attempt to look back, saw people jumping from top floors. These are images implanted in our minds, which will be there until death. Our politicians can sit back and make decisions as to who should be compensated and who should not, it is much easier for them to depersonalize themselves from the events that occurred on 9/11/01; it is not easy for us to do so. Thus, the Federal Government should reevaluate the September 11th Victims Compensation Fund of 2001 and restitute all survivors who were present in both one and two WTC buildings and at the Pentagon on 09/11/2001. I sent a message to your fund last fall urging that compensation money be made available to gay and lesbian partners of 9-11 casualties. I also contributed to the fund. I am unhappy to learn that the top management of your fund is making public statements indicating the fund will be guided by various state-level laws regarding eligibility and determinations of "next of kin." I do not understand why a federal agency would choose to follow the archaic and inequitable anti-gay provisions found in most state laws. If you are confused or unsure, then ask Congress for specific guidance. I am urging my congressional representatives to enact whatever law is needed to make sure that domestic partners of 9-11 victims receive fair treatment, regardless of their sexual orientation, marital status, etc. There are many methods the Fund could use to determine that Partner X was a committed life partner of Victim Z - for example, if X is named as the main beneficiary in Z's will, life insurance or bank account, that should be construed as evidence of being "next of kin." If X has shared a postal address or telephone number with Z for at least a year, that also, should be considered evidence of cohabitation and "next of kin" status. Far too often, gay, lesbian, bisexual and transsexual people are shunned by their biological relatives for many years --- until death occurs. Then the "bereaved" rush forward to collect the assets left behind by the person they more or less disowned in life. The 9-11 events should reinforce our commitment to freedom and justice. Please don't perpetuate and expand the prejudice found in our Social Security system and many other aspects of U.S. government. I sent money to the Red Cross, so I understand that the families need help in coping with this horrible situation. But for the government to step in and indemnify life like this seems very dangerous. Who do I call if my husband is killed in an automobile accident? What is the difference between his sudden demise and the death of 2889 people at the WTC? I mean, is the government admitting some kind of wrongdoing by providing funding for these people? January 9, 2001 To Out Elected Officials: In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims" Compensation Fund of 2001 P.L.107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King, "Severy death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape fromSThe Special Master cannot take it upon himself to restrict the rights of the families." Tuesday, January 22, 2002 12:30 PM Victims Compensation Fund I believe the entire country feels an overwhelming sympathy for the families of this tragedy and with good intentions rallied behind the fund raising events to compensate them in some fashion. No one could have predicted the money contributed would be such a huge sum or that it would turn into such a nightmare for any organization to handle. So some amount of chaos and confusion is understandable. However, as an observer from Oklahoma where until 9-11 we were the site of the largest act of terror ( at a Federal building no less) and not one family received a penny of monetary assistance from any charity funds to ease the financial burden of losing an income earner in a split second, I am wondering if some kind of monster has been created. I have no argument about helping the families with funeral expenses and other non-routine expenses that have occurred due to this tragedy; or even paying routine living expenses until social security benefits or life insurance compensation arrives. However, I resent any attitude of "entitlement" to hundreds of thousands of dollars per family because they have suffered a loss in a violent and very public fashion. That a mother of three young children, who will very likely receive a large life insurance reward and will receive social security death benefits on all the children until they turn 18 should think that she should not have to go to work at some point is expecting nothing short of "welfare" disguised as a charity fund. People who are the victims of vicious acts of violence by mentally ill people are not entitled to become instant millionaires simply because they are also victims of world-wide sympathy. Every day there is a child who has become motherless or fatherless due to a cruel twist of fate; that child and surviving parent feels no less grief nor suffers any less financial burden yet they have to find a way, often totally on their own, to go on with life. Also, when the next terrorist act occurs, and if there are hundreds of victims, will America think those families should receive a monetary sympathy reward in equal value to the WTC fund? I don't mean to sound callous to any of the families but there has to be an equitable, fair way to help them without turning it into an arena of fighting over millions of dollars not because they actually "need" it but simply because it is there.
