Dear Mr. Zwick,
 We are writing in response to the department's November 5 
Notice of Inquiry and Advanced Notice of Rulemaking Re: the September 
11th Victim Compensation Fund of 2001.

 The laudable purpose of the September 11th Fund is to provide 
compensation for the losses of relatives of those who died, and those 
who were injured.  It is crucial for the many grieving families that 
the regulations implementing this purpose permit recovery for all 
deserving relatives, including the committed partners or 
non-biological children of gay and lesbian victims of the terror 
attacks. For those whose family relationships do not meet certain 
strict formal legal definitions, the enormity of the loss of a 
beloved companion or parent could be compounded by the prospect of 
ineligibility for compensation intended for their protection. The 
Department of Justice should not permit this potential inequity.

 We urge the Department to include among relatives eligible 
for compensation those who lost their life partners or de facto 
parents or children, regardless of sexual orientation and marital 
status.

 Many who lost their life companions after lengthy committed 
relationships had not prepared wills with their partners, a 
circumstance which is not surprising considering the relative youth 
and good health they enjoyed. While many are fortunate to have the 
support of the biological relatives of the deceased, others (like 
many affected by this tragedy) face the added stresses of 
pre-existing family difficulties that have not abated in the wake of 
the attacks. Each and every one of them is reliant on the continuing 
good will and generosity of parents, siblings or children of the 
victim to treat them fairly.

 The federal September 11 Fund should ensure fair treatment of 
all surviving family members, including same-sex partners and de 
facto children of those who perished. Operated on a simple principle 
of equitable distribution of damages in proportion to losses 
sustained, it can serve the Congressional purposes of helping 
families to recover their economic security and allaying the 
financial uncertainty of survivors.

 Permitting all relatives who suffered losses to be eligible 
for compensation ensures equitable treatment of all the diverse 
families that suffered losses in this tragedy. As the United States 
Supreme Court recently noted, "[t]he demographic changes of the past 
century make it difficult to speak of an average American family. . . 
. [P]ersons outside the nuclear family are called upon with 
increasing frequency to assist in the everyday tasks of 
childrearing," Troxel v. Granville, 530 U.S. ___, 120 S.Ct. 2054, 
2059 (2000), and the same can be said of other daily supports for 
family members. The criteria proposed by the Lambda Legal Defense and 
Education Fund effectively accounts for the variety of family 
configurations and support obligations that Americans create today.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

Thank you for considering my comments. I look forward to hearing how you will act on these very
important issues.

A question on Support.

 

Dear Sirs,

   As an upstanding Citizen of the United State of America, I am urging you to NOT extend funds to the ILLEGAL ALIEN
families of the September Eleventh victims. This is an American tragedy. The funds are meant to go to Americans. The law is
still the law and an illegal aliens is someone who is breaking the laws of our country. Please do not support the people who take
jobs away from our citizens and are not even members of our country. If they wish to work here and be counted among the rest
of us, let them go through the proper channels. Your support of them through the September Eleventh Fund only goes to
encourage their illegal behavior. That, in my mind, is almost as bad as the attacks on America itself. No, actually it is worse. The
terrorists stabbed us in the back; your actions, in supporting illegal aliens, is simply twisting the knife.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Interim Final Rule

I have kept up with reading the submitted comments and I am very pleased to see that the closer the 'end date for submitting comments' got, the more comments I read AGAINST this program.  It should be cancelled.  I still have not read/heard anything about what the government position is on FUTURE SIMILAR EVENTS, or how they plan to prevent chaos at future 'mass disaster sites' caused by uninvolved parties flooding the area so they can get in line for the next handout.  The government DOES NOT have answers to these problems they are causing, and I consider it to be negligence to go ahead with this program without addressing those issues.  Anyway,....

First, I would like to request that a stipulation be put on compensation that if the recipient dies of other than natural causes, any remaining funds be returned to the government.  The way these 'survivors-of-victims' are already at each other (1st wife vs. 2nd wife, parents vs. spouse, biological vs. step-kids, etc.), I wouldn't doubt if some 'mysterious' deaths occur after funds have been received.  The tax payers should not have to support these 'survivors-of-victims', let alone some totally irrelevant person who couldn't otherwise get their hands on the money.

Second, I would like to point out that most of the comments that complain about the 'paltry' amount being offered them in compensation make the assumption that they would WIN a lawsuit against the airport/airline/city/federal government agency/etc.  I don't think this is a 'slam dunk' case that justifies such an assumption.  There is a significant possibility they would be sent away empty handed, or at best get a 'secondary responsibility' award - the ultimate responsible party being the terrorists.  Also, there need be no legal fees in collecting the fund compensation.  They would also not have to go thru 5-10 years of uncertainty/hassles/etc. associated with the litigation.  I would consider the elimination of this 'pain and suffering' to be worth at least 20 cents-on-the-dollar (the 80%-20% rule). And the max. available is only $6billion (cap set at insurance limit) for 3000 victims.  An average would yield about $2Million per claimant.  So, if you figure a 50%-50% shot at win/lose (on litigation), a 30% expense for legal costs, and a 20% reduction for 'no hassle', you can figure the 'cents-on-the-dollar' the fund compensation could provided vs. expected award if litigate-and-win:  50% of (1 - (30 % + 20%)) = 50% of 50% = 25-cents-on-the-dollar vs. $2 million -&gt; flat $500,000 for fund compensation amount.  I suggest you go with that and forget all these tables/deductions/etc. It is more than they deserve, and they are free to not accept it.  Lets move on to something more important!

Help same sex partners of terrorist victims


Dear Mr. Zwick:

The very humane Fund for relatives of victims of the September 11 terrorist
attacks must include all relatives of all the victims.

This importantly should include the partners and children of same sex unions.
They suffer just as grievously for their deceased loved ones as do other
survivors, and their need for assistance is just as great.

Please do not give in to the importuning of callous homophobic groups and
individuals who would have the Department of Justice limit compensation to
survivors of heterosexual unions.  They are interested in a political victory,
not humane assistance.

This Fund is intended for humane purposes; it is not a political statement,
Mr. Zwick.

I think it is a big outrage that the families of the gay hero's on 9/11/01 are not being treated the same way as the heterosexual families are.
If it weren't for a few of us gay heroes on a few of those planes that day, there would have been more lives and more destruction done.  What an injustice.
We are good enough when the heterosexuals want something or the government wants something, then its fine, but now to honor the people who should be honored, Oh no!! forget it.
Ashcroft needs his head examined.  There shouldn't be any discrimination of sex in the government.  We are just as good as anyone else, sometimes better.  One of these days Aschroft will need help from a Gay Person and I hope we all turn our back on him.  He is a complete disgrace to the human race.
LARGE COMPANIES HAVE TO SHOW TAPES AND FILMS TO THEIR EMPLOYEES REGARDING DISCRIMINATION ETC.  IN THE WORKPLACE.  THE HUMAN RACE IS THE BIGGEST WORKPLACE.  WE ALL NEED TO BIND TOGETHER, AND PEOPLE LIKE ASCHROFT WILL DO NOTHING BUT BRING THE HUMAN RACE DOWN.

Is there a map of the qualifying area? More on injury criteria?

In my case I was injured, suffering broken bones, while trying to get
further away from the World Trade Center Tower 2 when it started to
collapse. Since the tower was very tall it seemed at the time that it would
fall my way.  On Sept 11 I was taken to New Jersey and a NYPD officer took a
statement from me after the hospital finished doing a closed reduction on my
fractured radius and a splint, I haven't heard anything since.  Because I
was able to get around a corner to get protection, I was not hit by debris,
but I was hurt trying to avoiding being hit. The injuries required surgery
later on. Is there something more to clarify this area. Most of the info I
see on the website seems geared to people who were killed....Thanks

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on
September 11th, including the children and families of low-wage workers and gay and lesbian
families.

Under traditional rules based on lost wages, the survivors of a bond trader earning millions of
dollars per year might receive thousands of times as much compensation as the survivors of a
dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last
paycheck to the inherent worth of all those killed, so that a high minimum compensation level is
set to lessen the disparities. It would be a double blow to the survivors to first lose their loved
one and then watch as most of the taxpayer money went to those who were already well off in the
first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships
and families. Gay and lesbian families are especially vulnerable when one partner is killed.
Because the option of marriage is unavailable, these families may find themselves in the
traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red
Cross and the State of New York have already announced that they will not discriminate against
gay and lesbian families. The Department of Justice should do the same.

very important issues.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick:

We lost our only son in the World Trade Center attack on September 11, 2001.  He was 38 years old.  We will live with this terrible nightmare the rest of our lives.

While we truly believe that most of the compensation should go to his wife and children,
however, as the law stands now, we have no rights as parents to receive compensation for our horrific pain and suffering.

Our lives have been destroyed and yet we have no rights as parents to receive compensation for our horrific pain and suffering.

Our lives have been ruined by his loss and yet we have no rights as parents to receive
compensation for our horrific pain and suffering.

Our lives have been turned up-side-down and yet we have no rights as parents to receive compensation for our horrific pain and suffering.

Our pain is devastating and will last a lifetime and yet we have no rights as parents to receive compensation for our horrific pain and suffering.  

Our son can never be replaced -OUR RIGHT AS PARENTS IS TO HAVE A LIFETIME OF  PAIN AND SUFFERING.

A Parents' Pain and Suffering should be part of the non-economic fund's regulation.  Our Pain &amp; Suffering should be completely separate and apart from the compensation that the wife and children are going to receive.  It should not be included as one package  in the award to the wife and children, even if it is written clearly as such.  This will cause MUCH FRICTION  in surviving families -  DO NOT DO THIS!!  A way should be found to include parents as "beneficiaries" under the Fund  without at the same time reducing the amounts otherwise payable to the surviving spouse and children.

To Mr. Feinberg:

I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families.  Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.

The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and 
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Dear Mr. Zwick:

With heavy hearts we write this letter to you representing not only ourselves, but the
hundreds of other families whose loved ones were either hurt or killed in the tragic events
of September 11, 2001.  On that day, our lives spiraled out of control.  Writing this letter to
you in response to your request for comments about the Victims Compensation Fund is
one step in our efforts at regaining control over our new lives, and learning to have hope
for tomorrow.

The Victims Compensation Fund's intent is to make whole the families of the victims
While the fund is set up as a convenient, expedient process, we are concerned and do share
some reservations about its ability to make us whole.

OPPORTUNITY TO BE HEARD

Most importantly, we are concerned that we will not be given a complete and full
opportunity to be heard, should we choose to do so.  Each of us rightfully deserves the
opportunity to be fairly heard before a hearing officer.  We would like to have the occasion
to present evidence through our own testimony and the testimony of expert witnesses.  We
would like for each of our cases to be considered on a case-by-case basis.  For many of us,
being given the right to be heard is a crucial and extremely valuable part of our healing
process.  Lack of economic means should not foreclose such an opportunity.  We hope that
you can understand this.

Currently, most, if not all of us, are in financial distress.  We do not have the economic
means to hire the necessary experts for our particular cases.  We do not want to be
precluded from retaining the services of these expert witnesses simply because of our own
financial inability to do so.  Therefore, we believe that all expert fees should be paid
directly out of the compensation fund by the Special Master, and that there should be no
limit on garnering such fees.

RIGHT TO APPEAL AND FORM OF PAYMENT

One of our greatest concerns is that the current statutory schemes are removing our
options.  With the passage of the most recent legislation removing all public entities from
fault, we are left with one viable means of recovery - the Victims Compensation Fund.

Please understand, by electing the Fund we are forfeiting our right to bring a third-party
lawsuit.  We are forfeiting our right to find actual fault against an entity (the federal
government, the Port Authority, the airlines, etc.) - that would psychologically provide us
with some kind of answers as to why this horrible event was even able to occur.

If we are forfeiting our right to bring a third-party lawsuit, we should be guaranteed a right
to appeal in exchange.  If we are going to put our fate in the hands of a hearing officer, we
should at the very least have the right to appeal his or her decision.

We would also like the option to receive any payments made either in one lump sum, or 
through a structured pay out to the decedent's beneficiary, consistent with what our
personal investment advisors recommend for each of our individual family circumstances.
For example, any payment made to minor children should be in trust.  In addition, the
parent of said minor children should determine the date of vesting.  The trust should not
automatically vest at the age of 18, unless the parent determines that it is in the children's
own best interests to do so.

ECONOMIC LOSSES

Of critical importance to us, is the fair computation of economic losses.  We strongly
oppose any cap being placed upon this portion of recovery.  Simply put, no one should be
penalized because their loved one worked long, hard hours and earned a "good salary".

Every case is unique and deserves individual treatment, but we would like to know
beforehand how economic damages will be calculated for loss of earnings and work related
benefits.  This will, at least, provide us with a base from which we can begin to make a
decision as to whether the fund will provide us with adequate compensation to survive.

We request an approach similar to that used in personal injury actions.  However, neither
age nor marital status should be a discriminatory factor.  Retirement should be set at age
68.  The decedent's income should be averaged over the past 3 working years.  The
decedent's age should be subtracted from 68.  Those two numbers should be multiplied
together, thereby gleaning a starting point for computation.  From this base point, other
factors such as inflation, wage-increases, merit, likely bonuses and advancement, and any
other benefits should be considered.  We should be given the right to present expert
testimony to prove these losses.

For many, the lost income streams may be contingent, variable, or unpredictable.  We do
not believe that our families should be penalized because of this.  The hearing officers
should be permitted to consider the testimony of experts concerning such things as the
likelihood of advancement, the bonus scheme unique to each company and each
department in each company, economic cycles, performance reviews, as well as, how the
compensation of other co-workers progressed during the course of their working lives.  In
those cases where the compensation is extremely variable and dependant upon
commissions, as a base, we believe that the hearing officer should consider the average of
the best three out of five years of employment.

NON-ECONOMIC LOSSES

There should also be absolutely no cap on the non-economic losses awarded by the Fund.
Each person's circumstances must be evaluated individually.  Each case should take into
account the decedent's age, the marital status, and the number and ages of the decedent's
children.  Moreover, the severity of pain and suffering (both mental and physical) of not
only the decedent, but also the spouse, children, parents, and next of kin of the decedent
should also be evaluated.

Non-economic losses should be calculated similar to that in personal injury actions.  But,
again, neither age, marital status, nor dependency status should be a detriment.  Special
consideration must be given to the fact that eyewitness testimony concerning the horrific
pain and suffering endured by our loved ones may be impossible to elicit.  Thus, the
hearing officer should consider the reports and/or testimony of expert witnesses who may
describe based upon their training and experiences what the decedent went through both
mentally and physically prior to his or her own death.  Hearsay testimony should be
permitted.

Moreover, we do not believe that there should be a limitation on the types of injuries to be
compensated.  We are concerned that we may suffer from real and devastating emotional
harm not immediately apparent after the attack; harm for which we should be
compensated.  In addition to personal injury, we may suffer the loss of the ability to earn
an income, we may incur large medical bills, etc.  All of these things should be
compensated for by the Fund.

We strongly oppose any attempt to place into a formula or matrix a predetermined 
methodology for calculating our other losses.  Each family situation is different.  We have
the right to be treated as individuals.

Compensation for non-economic losses is crucial to the survival of some families, such as
the firemen and policemen's.  Any family who has a considerable amount of coverage in
life insurance will need some incentive to enter the Fund, since life insurance proceeds are
currently scheduled to be deducted from any recovery.  We strongly disagree with the
proposal as outlined below.  Certainly, we would expect any non-economic recovery from
this Fund to be generous in light of the terrible circumstances of September 11th.

COLLATERAL SOURCES

Finally, we are very concerned about the possible use of collateral sources to offset any
amount recovered from the Fund.  Life insurance should not be deducted from Fund
payments.  Simply put, life insurance is not taxed by the IRS for one reason-it encourages
people to plan for their heirs.  To deduct any life insurance from Fund payments would
penalize those who were merely responsible estate planners.  The decedents sacrificed and
saved hard-earned money to pay for such plans.  They are already victims once, do not
make them victim's twice.  At the very least the premiums paid should be offset
against the life insurance deductions.

Moreover, pension funds, IRAs, and 401k plans should not be deducted from the fund's
recovery amount.  Again, our loved ones sacrificed to save for these plans as part of a
responsible estate planning program.  Essentially, they are savings accounts, and they
should not be deducted from any award received from the Fund.

There should be no deductions from any Fund recovery for any "in kind" contributions
made to our families.  In addition, all potential future collateral source payments should 
similarly be excluded from consideration as deductions from any compensation recovery.

With regard to charity, Americans across this country donated their hard-earned money as
a symbol of their patriotism, and our brotherhood as a nation.  To deduct this charity
money from any final payment would, in our opinion, be wrong.  Donations made to
families like us were generously and selflessly given to us as a form of healing for both
donor and recipient.  Every single dollar donated and received gives each one of us a hope
for tomorrow and a belief in our country as a united whole.  Please do not denigrate this
beautiful symbol of our nation standing together as one by turning it into a dollars and
cents computation.

In closing, we sincerely thank you for considering our comments.  We are all struggling
through extremely difficult times.  Your asking for our input about the Victims
Compensation Fund--something that will have an enormous and tremendous bearing on the
rest of our lives-truly and honestly gives us a small bit of peace in our restless minds.  We
can only ask you to please keep our children and ourselves in your hearts during the weeks
ahead.

September 11th Victim Compensation Fund

Equal Relief Access

Dear Mr. Kenneth Zwick,

I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
  
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status.  The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."

Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies.  An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds.  In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality. 

Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.
