They all vote. They all pay taxes. They are all American citizens, and they all consider themselves to be proud Americans--even though America cannot decide to be proud of them--even when some of them are heroes. I realize that gay rights is too big a subject for an e-mail conversation, so I will simply say that I am profoundly disappointed in your decision to back away from sharing the compensation for victims of the 9/11 attack on America with the survivors of gay and lesbian partners. You fear lawsuits from those states that refuse to recognize their partnering as meriting government protection and recognition. There was a time, Mr. Feinberg, when black Americans would also not have been recognized as meriting the protection of the government of the United States, much less recognizing them as citizens entitled to the full protection of the Constitution. We have all lived with a burden of shame because of the fearfulness of men in government early in our history--men who knew slavery was wrong, yet did not have the courage to stand up against it. In issues of education and health care, California has done its worst to deny illegal aliens benefits or protection. Now you have the opportunity to be a courageous man in history, one who can stand up and say that the government of the United States belongs to all it's citizens, regardless of the attitude their state of residence adopts. You have promised benefits to those who are in the country illegally, who pay no taxes, who are not Americans, but who suffered as a result of the attack on America. You simply cannot let political agendas sway you away from the truth that the gay and lesbian persons who suffered ARE Americans, those on the planes and on the ground at Ground Zero, and those left behind to mourn. You simply cannot deny any of the survivors of those people who were willing to die resisting the attackers, the ones who died attempting to save others, or the ones who, like the foreign nationals and illegal aliens and straight Americans of all varieties, lost their lives in an attack against America. Tuesday, January 22, 2002 6:00 PM Don't give them any money Hello, I know this will sound "heartless", but I don't think ANY of our tax money should go to the families of the WTC tragedy. The WHOLE country was attacked, and suffered, although, not in the extreme way in which those few thousand were forced to suffer. However, to compensate their suffering, the American people have given to all the charities that were established for just this reason - to help them with what would be sure financial troubles ahead. For the families now to think somehow that we OWE them more than the billion + that was given freely from our hearts, through our TAX dollars, is ludicrous. Their complaining makes me very resentful toward the families because what was given freely is now not good enough. It certainly at least APPEARS that they are looking to get rich (and I'm being polite here). Please do not release ONE RED CENT of MY TAX dollars to these families. However: I'm disappointed that you repeatedly said there is no cap, In my opinion, you blemished a terrific product by lying about it, Why? If the law passed by congress dictates there shouldn't be a cap, you disregarded it. If that is the case why don't you cap (or whatever you want to call it) the offsets? Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, March 16, 2002 4:43 PM 9/11 benefits policy Dear Sir or Madam, I find it completely outrageous that partners of gays and lesbians who died in the September 11 bombings will not receive the same benefits as heterosexual spouses of victims. This discriminatory policy undermines all the flag waving patriotism and unity evoked by September 11 and truly shows the American stance on 'freedom' and 'opportunity' (which really should be read as 'freedom and opportunity for some at the cost of others'--a notion present since the founding of this country). I will not embrace symbols of American pride and support patriotic slogans, songs, or paraphernalia until the American claim to freedom encompasses all people living in America. Tuesday, January 22, 2002 5:56 PM Comments on Victim Compensation 9/11 Hello, I understand that there must be rules and guidelines, and that with those, someone will always fall into those cracks however, i firmly believe 2 things... 1)Families should NOT be forced to calculate the "worth" of their lost family member. Finances should be the absolute least of their worries. I dont care if we are talking about the CEO of a major company, or the janitor who scrubbed his toilet. Give them funds, and give it freely, without calculating in other funds they will also get. When people contributed to these various funds, no one thought.. well gee, they will get such and such from a pension, and ok, they get insurance, oh and social security will pay this much.. if i give them 5.00 , subtract a dollar here for this, a dollar here for that. . This policy is just wrong! Even if someone killed in the attacks was still living at home, with no dependants, why should they be valued as less then someone with a wife and 6 kids? That person would probably have eventually had a wife and kids also. Their parents mourn them just as greatly as the other families do. 2)Do not make these families promise not to file a lawsuit. The first rule of mourning is "do not make any life changing decisions for one year". Give them that year to decide, btu dont without funds for them in the meantime. It sickens me to see these families having to beg and caluclate their lost loved ones worth, and seeing all the deductions ad rules that apply to that figure. The money was given to organizations freely. it should be distributed the same way it was given. Wednesday, November 21, 2001 6:08 PM Please take into account that the families will most likely be suffering from Post Traumatic Stress Disorder for some time to come. Psychological/victimization counseling is immensely important. We are seeing a large increase in our calls to our 24 hour Hotline regarding depression, since 9/11, plus many people talking about death and especially suicide. Our community has also suffered from a more than "normal" number of suicide deaths since 9/11. We are extremely concerned about the effect this trauma is having on our countries citizens as a whole. Unfortunately, I don't believe we can compensate every person who witnessed the event, as that would be all of us. We also can't compensate all those who witnessed in person, as the numbers would be overwhelming and limited control on proof. But the ramifications to all of us.....they are immense, and the aftereffects are happening. We are concerned. One said that the companies should continue just as if my husband/wife/son were alive. As someone stated, just how much would be enough for these people. They are getting something that no other people have ever gotten, so why do they consider themselves so much better and more deserving than the rest of the country. People die every day. If you are killed in the military you generally get $250,000.00. If you are on the job elsewhere, you get whatever the company pays. Kobar Towers, Oklahoma City, any town any time, a policeman, firefighter, cab driver, store clerk, etc. is killed. Their families don't expect to be taken care for life. I had a daughter that was a few blocks away and could have been killed. Would I have wanted to become rich because of this? Hell no. We would have gotten a smaller amount like $300,000.00. That would have been far more than enough. That is more than most people save in a lifetime. Stick to your guns and rules. Tuesday, March 19, 2002 1:33 PM Discrimination is un-American I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. In recent interviews, the head of the September 11 Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11) has made clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. Even fetuses and illegal aliens will be receiving benefits under this problem - heck, they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. But when it comes to gay and lesbian heroes of the day - &nbsp who helped bring down the flight in Pennsylvania, &nbsp who died in the line of duty when the first tower fell, and &nbsp who was &nbsp of the plane that crashed into the &nbsp (there are many more) - we are told the law is the law and no exceptions can be made. Wednesday, January 16, 2002 11:42 AM Comments The following are my objections to the Victims Compensation Fund: My husband's life insurance policy, which he paid for, which would pay off my mortgage, should not be deducted from any benefits I may receive. This was purchased privately and has nothing to do with any government, state or city benefits that I would/could receive because of this tragedy. (Collateral source deductions are not required in court cases.) The proposed awards for non-economic damages ($250,000) per victim are only one-tenth the level paid in comparable cases. For example, a spouse was awarded $5 million in non-economic damages in a lawsuit arising out of Lockerbie. Congress explicitly enumerated a broad range of non-economic damages for which victims and their families shall be compensated and DOJ ignored this.
