I am writing to you to voice my concerns and objections to the Department of Justice's September 11th Victims Compensation Fund. It was my understanding that Congress set up the fund to ensure that the airlines bail out would not come at the expense of the victim's families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. The DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by us. The DOJ's formula for non-economic damages is $250,000. for the person killed and $50,000. for the spouse and each dependent. Normally non-economic damage awards run well into the seven-figure range. This dramatic undervaluation of presumed non-economic damages runs contrary to Congress's general intent to provide full and fair compensation. Also, the method used to calculate economic damages are based on federal workers' incomes and not the higher-paying private sector. The cap placed on a victim's income at $231,000. per annum, combined with the offset for collateral damage further erodes the compensation we would receive from this fund. The DOJ should fulfill the act's intent by revising the rules to compensate victims and their families for the types of damages specified by Congress at levels comparable to those provided in the tort system the fund was designed to replace. The Special Master/U.S. Department of Justice (DOJ) should seek to establish an electronic form and populate key fields from current data and databases of victims of the September 11, 2001 terrorist attacks based on eligibility, as defined in Public Law 107-42 Section 404(c). Basic claimant information might be available from aircraft manifests of flight crew and passengers, employees and beneficiary records of the World Trade Center and Pentagon, and others data of possible victims. Claimants could provide other information to complete the form. An electronic filing format could include prompts and instructions to aid in the completion of mandatory fields. Claimants filing for victims that have not been identified from existing data would be required to provide proof of injury and entitlement to compensation and could also submit information electronically, via Facsimile, or by other means determined by the Special Master and DOJ. Working from a predetermined list of potential claimants could serve as a deterrent to fraud. Issuing a password to potential claimants could also be a means to further prevent and detect fraud. The feasibility of using an electronic form to administer the victim compensation fund is supported by the development of benefit eligibility prescreening software by public agencies and non-profit organizations that have been involved in advancing the innovative use of technology to support service delivery. Of note, the Department of Commerce Technology Opportunities Program (TOP) grant, formerly the Telecommunications Information Infrastructure Assistance Program (TIIAP), has provided matching funds for several eligibility prescreening projects in recent grant cycles. The Special Master can look to these as examples of the applicability of developing an electronic form that can serve claimants across a range of proficiency levels with the use of Internet technology. Topic #4: Procedures to Assist an Individual in Filing and Pursuing Claims Under this Title The Special Master could designate a support network to assist victims and claimants that do not have access or limited proficiency in using the Internet to complete an electronic claim form. The Department of Justice Office for Victims of Crime (OVC) currently administers a program of assistance to victims of violent crimes administered by state agencies. Additionally, a number of faith-based and community-based non-for-profit organizations rallied to offer financial assistance, support services, and comfort to victims of the September 11th terrorist attacks. The September 11th Fund established by the United Way of New York awarded grants to 69 organizations to provide assistance to victims and their families. The Internal Revenue Services (IRS) granted tax-exempt status under special expedited procedures to 90 organizations to help victims of the September 11th attacks. The existing network of state agencies and faith-based and community-based service providers could be engaged to assist claimants complete the form and pursue allowable claims. These agencies and organizations could be chosen based on their existing service delivery focus and their ability to provide longer-term support to potential claimants. Given the need to limit administrative fees, to insure that the greater percentage of the fund directly benefits the victims, the involvement of state agencies and faith-based and community-based non-profit organizations, that have an established funding source, could be a consideration for selection. In addition to providing assistance to individuals and families with the filing of a claim, the network of non-profit organizations can also support outreach to potential claimants. The recent Washington Post article of Sunday, November 18, 2001, reports stories of paperwork and grief as a deterrent to families seeking benefits that they are entitled to receive. The Special Master will want to ensure that claims are filed timely and within the two-year time frame specified under Section 405 ( a )(3). Families of victims of the Pentagon were greatly aided by the Family Assistance Center in completing the required paperwork during an initial period of grief and expressed an interest in having the support continued to assist in accessing other eligible benefits and services. The Department of Justice could expand the services to victims beyond the role of the Special Master consistent with the range of assistance administered by the Office of Victims of Crime (OVC). In establishing an electronic format for administering the September 11th Victim Compensation Fund, DOJ should also establish a central website to inform victims of other benefits and services. The website should integrate information from all the funds established for victims and serve as a central portal to inform claimants of the full range of benefits that they may be eligible to receive. At a time of grief, individuals and families should have an efficient means for accessing the funds that were raised on their behalf and to obtain the services that are available. OVC, for example, considers financial counseling, to assist victims to restructure their financial affairs as an allowable service and compensable expense (Victims of Crime Act Victim Compensation Grant Program, Federal Register, May 16, 2001, Vol. 66, No. 99, page 27158). Individuals and families who are eligible claimants under the September 11th Victim Compensation Fund should have easy access to information about all the benefits and services that are available and a method for determining eligibility for receiving benefits. Coordinating information about all the September 11th Funds and charitable services would also comply with Congressional calls for greater federal oversight of the disbursement of charitable funds raised by numerous non-profit tax exempt organizations in the aftermath of the September 11th terrorist attacks. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This importantly should include the partners and children of same sex unions. That money could have been spent by the victim but instead was put into pension funds like a savings account to be used in the future. These people did without to save for a rainy day and now are being punished for it. The should have spent their money, Not bought life insurance and they would have made out better. People are being discriminated against because they made good salaries and did the right thing all their lives. Dear Sir/Madam (whomever is reading this for AG Ashcroft) : The answer to the question of whether awards from the Victims Fund should be reduced by charitable donations is clearly NO. First of all the legislation that created the fund was after all a bailout of the airlines that, inter alia, capped airline liability for the four hijackings at their insurance policy limits. By compensating the victims of the WTC, the Pentagon and the PA crash the fund not only insures prompt payment to the families affected but also, and primarily, saves the corporate assets of the airline industries. Now without even discussing the economic effects of not saving the airlines, the fact remains by reducing awards by the amount of charity a victim's family received the USDOJ would effectively be using the donations of millions of Americans, and others, to underwrite its bail-out of the Airlines. Certainly this is not what the Charities or the people who donated to them intended. Secondly, by reducing the award amounts by the amounts of other collateral sources such as life insurance, Worker's compensation and pension survivor benefits, the fund is in step with collateral source rules in the various jurisdictions that would be applicable in any litigation stemming from events of September 11th. However, I cannot recall ever reading about, nor do I believe I could find if I looked, any case were an award for personal injury and/or wrongful death was ever reduced by any charitable donations the plaintiff/victim had received. A fair reading if the statute, and I have read it, would be that the fund was intended to take the place of litigation. Variation from litigation norms were expressly provided, such as waiving the claimants burden of proving liability, however, the claimant must still prove their measure of damages. The language regarding reductions of awards for monies received by collateral sources would appear to be just the application of a collateral source rule. Since, as I stated above, I believe that, no jurisdiction that applies a collateral source rule to PI and wrongful death litigation, reduced the amount of damages by any charitable amounts received, an argument could be made that reduction of the award by such amount is not authorized by the statute. Although a legitimate argument it is admittedly not the strongest of legal arguments, but in the court of public opinion (combined with the above) it is some what more compelling of an argument. Lastly, and this is the more rhetorical and political of arguments, if the Government is going to reduce the awards by the amount of charity a victim receives, will they also be looking to reduce the awards by 1/3 since the victims who opt into the fund will be eligible for free legal service from ATLA, NYSLTA and ATLA-NJ through Trial Lawyers Care. Will the reduction for charitable awards include donation of services from others looking to help. It sounds ridicules to me as well, but think of the potential sound bytes.
