TomPaine Story TomPaine Story: Story "LESSONS LEARNED: THE IMPORTANCE OF THE FEDERAL COURTS","LESSONS LEARNED: THE IMPORTANCE OF THE FEDERAL COURTS A lesson we should be learning from the aftermath of September 11 is the importance of all federal courts, not just the Supreme Court, to the future of civil liberties. Ironically, President Bush has argued that the Senate should speedily confirm his right-wing judicial nominees lest empty seats on the federal trial and appellate courts compromise the war on terror. If anything, the novelty of the legal issues presented concerning the scope of government surveillance, military incarceration and trial, and secret detentions only intensifies the importance of scrutinizing lower court judges with painstaking care and due deliberation. The argument for speeding up lower court nominees is that, unlike the Supreme Court, lower courts only follow the law. They do not make it. That's hogwash. Lower court judges frequently face questions that cannot be decided on precedent alone. Trial judges are often required to exercise their ""sound discretion,"" which means that the Courts of Appeals typically defer to their factual findings and the Supreme Court does not interfere. Current challenges to the Adminstration's draconian policies prove the point. This is the most dangerous time since Vietnam to risk staffing the courts with judges more committed to ideology than civil liberties. Republicans helped create the extra vacancies they now hope to fill. Although President Clinton typically sent centrist judicial nominations to the Repubican Senate, Senate Republicans did not reciprocate the spirit of moderation. Instead, as documented in an American Judicature Society study, they subjected Clinton nominees to ""unprecedented delay in confirmation processes."" They hoped, in other words, to preserve an artificially high number of judicial vacancies that could later be filled with conservative Republicans. September 11 makes it especially important to rebuff such right-wing bullying. All courts help preserve our freedoms and must be staffed with utmost care. TomPaine Story TomPaine Story: Story Before 9/11 I was preparing to go to the demonstrations against the IMF/World Bank in Washington. Due to the militarization of police forces in the US and increasingly violent tactics used by the police for crowd control, I was freaked out. The meetings were cancelled, but I still attended a peace demonstration that drew about 6,000 people. Allthough Al Queda doesn't deserve to get off free, the US should be responsiblely inside the bounds of international law for justice to be made. When the first reports came back fron Jenin I felt empty inside. With a feeling of helplessness, I went back to D.C. to express disapproval again. People have their opinions on the conflict, but my tiff is with the fact that Israel has hifacked the ""War on Terror"" and is using U.S. tax dollars to extend state sponsored terrorism on the Palestinians. At this demonstration, 100,000 people, almost half of Arab descent, marched on Washington. The emotion of the Palestinian-Americans were so high and their courage was amazing to show their disapproval during the civil liberties destruction of post-9/11. At this time, I'm upset. The Bush administration's inability to pass the Kyoto Protocol and Bush's unsigning of the International Criminal Coart is unacceptable. Our elected leaders decided not to sign the international children's rights treaty, this is not acceptable. The U.S. delegates that walked out on the UN Conference on Racism just before 9/11 are not acceptable. The US tuned out any oppertunity to use the UN for justice of the 9/11 masterminds. This shows how much the US cares about international law. So while so many are proud to be American, I am ashamed. Whenever I spend money I cring at what my tax money is supporting. Is it fueling state sponsored terrorism in Columbia and Palestine? On the anniversory of 9/11, I will mourn. After that, once again I will prepare for another trip to DC to express diapproval of the IMF/WB, because it is patriotic to stand up for what you believe in. Terrorism can not interupt our agendas for democracy and with leaders like George W. Bush we are heading in the wrong direction. TomPaine Story TomPaine Story: Story TOWARD A MORE PERFECT UNION I worry. I worry that I'm just starting my life, and I have no idea where the world is headed. I worry that I could end up in the middle of a war. I worry that I could be just one casualty among thousands in some random terrorist event. I have no control over whether or not my country gets into a war. I have no control over anything. That was true before 9/11, but I wasn't fully aware of it. Now I am. I'm young enough that 9/11 will change my whole life, and I'm old enough to know it. I wish I didn't feel relief when I see a soldier from the National Guard in Penn Station. I wish Paul could be rambunctious and carefree, like he was before his father died. I wish I could believe again that America is untouchable. Nothing good has come out of 9/11; it's not possible to salvage something good out of such a nightmare. The two things that some suggest as good outcomes were the charitable giving and the rise in patriotic fervor. The reality is that 9/11 didn't instruct people to be generous; generosity was already in the hearts of those people. As for the second notion, patriotism boiled over into nationalism, and the result was a desire for violence. During the weeks following 9/11, even New York cab drivers were at risk of attack from hot-headed nationalists. I don't feel that I know enough to say whether or not the Bush administration has a firm grasp on the situation and understands what to do next. All I can do is hope. This is why I worry. The political battle is still between the working and moneyed classes, even if post-Reagan generations know little of it. Corporate airwaves banned Labor Day union stories along with the story of the creation of the EPA in response to a nations outrage at corporate polluters. Now people with such concerns are trivialized and vilified. Republicans accuse them of class warfare, as if the party of the moneyed class had not been waging its own. Like chameleons, market fundamentalists have become military fundamentalists. The market as panacea has changed to the war on terror as our reason for being. This fundamentalism subordinates all to a cause prosecuted behind closed doors, vulnerable to enormous corruption. Militarists know that the first rule of war is to control communications. Theres the rub: we have lost the right to set the public agenda. Exhibit A: the missing ozone layer. This story has been absolutely wiped clean from the national memory bank. Yet, according to scientists at NASA, ozone thinning will reach its peak by 2006. But that scenario works only if global warming is controlled because the two problems, ozone depletion and global warming, might interact. But hey, theyre only rocket scientists, so Im sure if corporate-controlled Blowhard Radio says theyre wrong, half of America will agree. Voila, nothing gets done. Television would rather warmonger nonstop than admit how close corporations have come to destroying us all. Nor will they tell the tale of how Doolittle and Delay, anti-regulation Republicans, delayed addressing the ozone problem. Likewise, Bush remains unchallenged as he stonewalls global warming. Are they patriotic or self-serving? Corporate Americas accountability dodge might ultimately be our greatest threat. Overcoming terrorism will require overcoming George W. Bush, Dick Cheney, and their dark hallucinatory vision of complete control. It will require substituting instead a vision and an international political economic order authentically based on the ""recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family"" enshrined in the Universal Declaration of Human Rights. How to make it happen, or alternatively the failure of the mass of People to see the cracks in the foundation of U.S. war for domination, will be the essential stuff of 21st century history. In Zbigniew Brzezinski's 1997 book titled ""The World Chess Board"", he makes an impassioned argument for the US to embark upon a course of economic and military ""Hegemony"" to save the world from itself. Brzezinski suggests this will require control of Eurasia (Europe and Asia) by the US, and it can be accomplished only by controlling the world's last great oil reserves in the Caspian Basin. Among the countries that border this gigantic oil pool are Afghanistan, Iran, Iraq, Tajikistan, Uzbekistan, Turkmenistan, et al. One of these pawns has now fallen. Team Bushs attitude towards governance was not so clear when the Twin Towers toppled and the presidentðs popularity soared. Only dimly do we remember that just before September 11, media outlets announced that results of consortium commissioned Bush v. Gore 2000 election recount were imminent. Tragedy struck, and predictably they were not. Not until mid-November did consortium participants release their version(s) of the results. Dutifully, media organizations reported Bush really is president, while burying the true story: had the recount proceeded without US Supreme Court intervention, Gore won. Civil unrest hasnt materialized despite the fact that Bush Administration actions in the aftermath of September 11 bear remarkable resemblance to a coup. Tactics involving repression, intimidation, disregard for the Constitution and its separation of powers now threaten our cherished democracy. The rule of law is thrown in the trash bin as treaty after treaty has been abrogated, or more ridiculously unsigned and the UN undermined. A right wing agenda is effected using War On Terror as the justification. Dissent evokes a harsh and coercive reaction from the White House that stifles inquiry. We must question the legitimacy of this presidency as we hurtle towards the brink of certain military conflict which may well morph into World War III. Before the world goes up in flames, thoughtful Americans must stand up to the powers that be and call their bluff, or risk losing democracy forever. These times are exceptionally dark and dangerous, not only because the administration is too cozy with corporate culture; but because the corporate media are it, and as such play along. For a time there was a heartening compassion for 9/11 victims. It didn't generalize. Mass interest in specific aspects of foreign affairs improved a little, but that interest centers largely on making war against countries that may not merit invasion. There is little interest in obtaining an international consensus on making war before doing it. Tolerance of diversity has diminished. American chauvinism has become louder and more offensive. Arab men have been detained for long periods without due process, beaten up by bigots, thrown off planes, and stigmatized in many other ways. Government agencies and public media have encouraged the population to report ""suspicious""--read Arab-looking--people and their actions. Mass media have compliantly toed the government line, providing a narrow spectrum of opinion centering around the rightwing government's views. The Bush administration has used 9/11 as a pretext to enact measures that increase the flow of money from the population and the public purse to very wealthy individuals and corporations. More ominously, the Bush administration has declared an unending "war on terrorism" which, without apparent awareness that they are following George Orwell's ""1984"" almost to the letter, they treat as a licence to militarize the country, propose internment camps, and dismantle both civil rights protections and many government programs basic to any decent social contract. The two big political parties are owned subsidiaries of large corporations and other wealthy contributors who are getting the government they purchased--not democratic, not fair, not wise, not just. The union has become frightening to live in, and nothing on its political horizon promises to improve it. TomPaine Story TomPaine Story: Story September 11, a day that opened Americans heart. T his day was a wake up call for everyone. It made Americans realize how evil people are out there. Just to imagine how many people died in that disaster, makes people understand how valuable life is. New York, the city of the Twin Towers; The city of a new history. I am from John Hands Class and Ill be writing about this topic. Children's crying, running , and screaming, while others were making published out of a disaster. Reporters began to realize this when they saw what the reality was and how bad this was. The September 11, made America a better union by bringing everybody together, but also insecure. If we had prevented something like this everything would be the same or better than before. Interrogations were done everywhere I could say that even in my school were real scare that they didnt let us take back packs. I was frustrated that I didnt know what to do. Just by passing through the gas station and seeing the prizes oversimplification made my heart feel sad, for the only reason that I though it was going to be the end of the Word. At this point, I started to think about how many things I didnt get to do and also the things I took for granted. In conclusion, Ill like to say that people don t do anything until something happens. TomPaine Story TomPaine Story: Story Many of the issues that seemed never ending in the news disappeared after Sept. 11. A few have returned while others are left in the dust. The biggest one or one of the most talked about was Bush's new presidency; whether or not he would be a reincarnation of his father and if he would be a good president. This question has returned as suspected. The nation is continuing to contemplate his actions as president thus far. September 11 lifted off his reputation as the ""people's president"". This was caused by his standing upon the wreckage together with the firefighters and speaking to the group of people who there about how he will retaliate against the Al-Queda. They felt at ease because he seemed to be in their level. Although this has occurred people of this nation still remain unsure toward his actions afterward. An enormous amount of people were anxious, thoroughly vexed, and wanted revenge as soon as possible. Personally, I was apprehensive Bush would consider a strike attack right after, then all out war. Especially now when the government is thinking about Iraq. Some residents of this nation want revenge while others would actually like to consider some thought into their final decision. For instance, an example where an equal amount of pressure and thought was put into was the Cuban Missile Crisis. President Kennedy and his advisors had to compete against the army's top men when they wanted to produce an immediate attack on Russia when they were posted in Cuba. Just like then we too are wondering whether Bush's decisions have been made correctly. Our commander-and-chief should be able to handle this situation. Question... Do you think he can or will? Would you agree? Personally, I think that it was an ""eye opener"", but I feel that is was so sad that it took the higacking of four commercial airlines to unite us, Americans, together. Many Americans felt insecure; for, here we are thinking that America was one of the sadest and invincible countries, and it waws attacked by terrorists. September 11, 2001 convinced many Americans to believe that possibly America wasn't one the safest countries after all. When I learned that it was Bin Laden that arranged the masterful plan of hijacking commercial airlines on Spetember 11, 2001 and striking the heart(s) of America (not only the World Trade Centers, but also the Pentagon), I was surprised that this evil driven man was from Afghanistan. I thought that our foreign policies were stern enough to prevent something like that attack from happening. I think because of September 11, 2001 our foreign policies need to involve stradegies to prevent other countries from invading our trust and freedom. Many people are very pessimistic, in general, and can't salvage anything good from anything what so ever, much less a tradegy like the event of September 11, 2001. Above all, I feel people should see the good in all this; we should salvage our freedom in this country, and see that this has not ""changed our lives forever"" because then we have been won by the people set out to control or hurt us. This should bee considered as ""evil-doers"" just putting Amercia's freedom and unity to the test. TomPaine Story TomPaine Story: Story Toward a More Perfect Union: Lessons Learned- Or Not- Since 9/11 After the terrible tragedy on September 11 the world has changed drastically. we went from fighting against one another over political issues to being united against the criminals who committed this heinous crime. People opened their eyes and realized that instead of us fighting amongst each other that we are all together in this country and to stand up together as one. This tragedy caused many people to think negative about our countrys government because of their decisions concerning the incident. The public at first felt that the government reacted way to slowly and allowed the criminals to escape. The government took heavy criticism and now they react without much debate. They are quick to make drastic decisions because they dont want any public backlash. Regardless of what kind of approach the government takes the public will find something to complain about. The government now also worries about our standing as a world power. We were and still are the number one power in the world but we are also seen as being weaker than we were before. Other countries now realize that we are not as invincible as we think we are. Even if they wanted to hurt us, its even more difficult for foreigners to enter our country. The foreign policy of our country since September 11 has become much more strict and many people are not allowed to enter or country. Since the eye opener on September 11 I think we have realized that there is much more important issues than political issues and tax cuts. We have to learn to appreciate the people around us because at any given time those people can be taken away from us. Like children afraid to sleep when there is lightning and thunder outside our windows, we have wished for the government to stay with us. There's only one problem: we aren't children, and the lightning and thunder of the past year have come not from terrorists, but from our own government. We've been subjected to repeated assaults upon our Constitutional rights, plans to pit neighbor against neighbor as spies, plans of war to which none of our forebearers would have consented, all of which have been promulgated by an administration attaining office without mandate for such. In our distraction, we have let decades of enviromental law and international treaty work be flushed away by corporate interests with ties to our current administration. We have yet to understand that our votes in the 2000 election prompted what has happened to us since September 11th and before. We have yet to understand that our future votes are all that can undo this damage, domestically and internationally. Why have we come to this? Perhaps because our only news sources seek to focus us on the administration's message--war is necessary, war is inevitable, war is... whatever the administration wants it to be. To be truly free, to be truly self-governed, we must instruct our representatives in Congress in what we wish for our future. We cannot leave that task to those compromised by the wealth of corporations. If we do, those representatives will act in the interest of corporations, rather than in the interests of the majority of individual citizens. Unless we, as citizens, stop the insanity by our votes, we will live with institutionalized insanity--a drift towards fascism, and a constant fear of everything and everyone from without and within. TomPaine Story TomPaine Story: Story TOWARD A MORE PERFECT UNION: LESSONS LEARNED -OR NOT- SINCE 9/11: Humans are unique in that we can, and often do, engage in bouts of self-examination, personal critique and navel contemplation It is how we assess the effects of our behavior, gauge the state of our relationships, measure our personal and professional failures and successes, and heal ourselves in times of pain. Such introspection, at its best, nurtures humility, patience and ideally, self-improvement. At its worst, of course, it breeds neurosis, inaction and crippling self- doubt. Self-critique has never come easy to America, a nation that values fierce pride over humility, unbridled toughness over acts of kindness, and unconditional obedience over public protest. In the aftermath of 9/11, the nation's inability to critique itself is crippling our recovery. Could our anger and grief over the terrible events of 9/11 be the result, in some small measure, of a vague sense of guilt, a whiff of responsibility for the maelstrom of violence inflicted upon us? ""WHY DO THEY HATE US?"" Newsweek blared last Fall while smoke drifted up from Ground Zero enveloping lower Manhattan in that smell. Writers Barbara Kingsolver and Susan Sontag enraged the Right by suggesting American culture was to blame, while Jerry Falwell and Pat Robertson enraged the Left by suggesting homosexuals should take the fall. Thankfully, neither sentiment resonated with the general public A year has passed, and we have not yet begun to heal. Let us hope among the several stages of our grief, Americans find the maturity and the wisdom to reflect upon this great tragedy, learn from its profound lessons, and chart our future course with little recrimination or blame. And our government seems to be doing everything it can to make this country as widely and fiercely hated as possible. The debate over global politics, the environment, and the bombing of other countries is not just about others' misery, owl species, or the world of our great-grandchildren anymore. It's about the safety of this country today or next week, and about whether magnanimity or machismo is the best course to ensure that safety. For certain war- and cold-war-promoters every country we've attacked for decades has been attacked to protect this country, but I never believed that justification or felt that threat. Now the Pentagon has been attacked, and the people left inside it seem intent on amplifying the policies that seem most likely to lead to more attacks. Now I feel the threat, but believe that the justification for attacking other countries is more misguided than ever. The President believes that the route to safety and honor is to search out any slight, take great offense at it, and react with overwhelming fury and power. In the case of Iraq, the desired slight may have to be manufactured, in the form of an allegation of aid to Bin Laden. If that doesn't work, the offense may be the possession of weapons that the United States also possesses. If that doesn't stick, we'll just bomb Iraqis for their own good, out of humanitarian concern. Our own safety finally really is at stake, but acting out the same fear-driven panic and chest-pounding as usual will make us part of the problem.. Bombing Iraq and putting weapons in space won't stop box-cutters. Bombs won't scare off suicide killers. Now that we're all scared, let's talk a little about what course of action might actually make us safer. It seems everyday the "mcmilitarial industrial complex Corporation" tightens its grip around the necks of the American Consumer (citizen?). Since September 11th, the "liberal" mass media has reported about six stories that could be considered investigative journalism that entailed more legwork than walking to the AP machine. "The W" and American CEO Dick Cheney have remained bullet proof despite enormous amounts of evidence that testify to their shadiness and unfitness to serve people they know nothing about nor care to. "There will be no more easy money, just hard time," says George. That s just funny. When politicians get to this level of hypocrisy it enters the realm of "super irony." Language implodes under its own weight at this stage, releasing intermittent laughter and sobbing as by-product. The average consumers societal plight is virtually the same. It s still easier for a corporation to claim bankruptcy and get shelter from debt than the average citizen. US foreign policy is still putting us all at risk. The gap between rich and the poor is widening. The economy sucks. Our civil liberties are in dire condition. The democrats are mostly a bunch of pushovers and get their money from the same place as republicans anyway. Politics and big business is, as usual, an incestuous orgy of influence and power that we are not invited to. So, whats gotten better? September 11th has done nothing to reform the corrupt power structure from what I can see. My life is the pretty much the same besides being laid off and the ridiculous amount of reading Ive been doing. Reading. Thats whats gotten better since 9/11. September 11th has made me more informed and probably others. Knowledge is often increased by tragedy. Knowledge is good. Perhaps things are looking up. The United States of America is the largest terrorist organization in the world. THAT is what the guys who blew up the WTC and Pentagon wanted us to acknowledge. And have we? I think not. Terrorism is defined as: attacking civilian populations to create political leverage. Were the guys who attacked the WTC and Pentagon terrorists? Sure they were. They were doing what we've been doing for decades: attacking strategic centers and ignoring collateral damage to civilians. Anyone remember Vietnam? Agent Orange? Napalm. Remember a little girl running down a road naked, burning from napalm? But that was then and this was...Well...How about blockading Iraq, causing hundreds of thousands of civilian deaths over a period of almost ten years now. Asked about the horrendous human consequences of the sanctions, Madeleine Albright (U.S. ambassador to the UN and later Secretary of State) declared that, the price is worth it. In case you need a translation here she is saying that terrorism is worth it. I think Osama would agree. Or how about sending cruise missiles into the Sudan to blow up a pharmaceutical plant causing eventual suffering and death to tens of thousands more? And, SIMULTANEOUSLY ruining a negotiation whereby the Taliban had agreed to hand over bin Laden to the Saudis. Is that shooting yourself in the head or what? How about the U.S. arming the Turks to push the Kurds -- men, women, and children -- back over the border into Iraq to irritate Saddam? How about condoning genocide in Cambodia because they are friendlies, they oppose Vietnam? How about staying silent when Indonesia invades East Timor because our mineral and petroleum corporations want to stay on good terms with the Indonesian government? Or when Indonesian soldiers shoot workers to crush labor unions at U.S. mines? But this is not the same, you say. That was war, these were innocent civilians! No one who works in the Pentagon effecting these massacres is an innocent civilian. And what about the WTC? Civilians? Do you know what they did there? And what they are now doing somewhere else? Men and women sit at computers clicking on mice. Click -- a billion dollars leaves Taiwan and 100,000 people lose their jobs. Click -- a billion dollars is invested in Bolivia where 100,000 peasants are removed from their land to make way for another strip mine. Click -- close down that factory in South Carolina and move it to Mexico. Click -- what next? America is 4% of the global population consuming 24% of the global resources.
