Tuesday, March 12, 2002 1:23 PM Question re: Kenneth Feinberg and the September 11th Fund I could not beleave what I read in the "Meet the Press" transcripts as it applied to the 911 Fund. According to the excerpt below if state law discriminates against gay people, then so will Feinberg and the 911 Fund. The problem for gay Americans who lost loved ones on September 11 is that most states do not legally recognize gay relationships, and the very few that do tend to do so only for state employees, not for citizens at large. And while a handful of cities do in fact recognize such relationships, under Feinberg's formula, it's the state's law that counts, not the city's. What is the purpose of the Fund? If it is to help in its on small way to rectify such a national tragidy as it effected loved ones and families, then why are specific loved ones and families being leftout? The gay people that have been robbed by this tragidy are so small in number compared to all others that are not being discriminated against. Why cause such a hurt to these people when it would only take so little to help them. Please reconsided the statement made by Kenneth Feinberg on NBC's "Meet the Press," March 10, 2002 and make this thing right for all people -- not just the ones that are socially exceptable. On this six-month anniversary of the attacks on the World Trade Center and the Pentagon, don't let Kenneth Feinberg and the September 11th Fund tell the American people that regardless of whether a gay man was one of the four heroes on United Flight 93 who saved the US Congress and the White House from utter annihilation, the 911 Fund plans to discriminate against an American hero because most of the country sanctioned such discrimination prior to September 11. Wednesday, November 21, 2001 9:58 AM Comments: Victims Fund - September 11th Dear Mr. Zwick, It is with great concern, and hope of preventing what may be a grave injustice to all the families who lost loved ones during the tragic events of September 11th, 2001 that I am compelled to contact you. On September 11, the very fabric that symbolized the American family was torn with such finality as to eliminate any possibility of mending with "monetary thread." Despite that realization, I understand that the only compensation available to the families of those lost on that horrific day is monetary in nature. Subsequently, the establishment of the "Victims Compensation Fund" (the fund) is logical. However, while the establishment of the fund is logical, I fear that the guiding principals and mechanics of the fund are not. After all, it is commonly stated that "the distance between thought and deed is often far." Having said that, and having reviewed the parameters of the fund, I felt it was imperative to share with you the many reservations associated with the fund's ability to accomplish its single purpose - economic equity for those now painfully suffering from the lose of their loved ones. Below, you will find those reservations. First and foremost, it is imperative that each and every claimant be given the opportunity to share their unique circumstances with the individuals who will be instrumental in determining an award. In doing so, each claimant should be afforded both the opportunity to present evidence through their own personal testimony and enlist the assistance of experts, if desired, in order to provide a clear and concise depiction of their position. Allowing such an opportunity will ensure fairness and objectivity as each case will be heard separately and awards will be based on the circumstances associated with each case. On a personal note, the ability for an individual to share their pain and suffering is instrumental to the long journey associated with the healing process that every individual must now embark upon. Second, I am alarmed by the fact that the government, who will ultimately pay the awards, will be "appointing" one individual (The Special Master) to determine the "extent of harm to the claimant," the amount of compensation to be awarded based on "the harm to the claimant," "the facts of the claim" and "the individual circumstances of the claimant." While I understand that the "Special Master" will be designating individuals (hearing officers) to hear each case independently, that knowledge does not instill the confidence or peace of mind that I require to participate in the fund. Instead, I would prefer an independent panel, perhaps three (3) to five (5) individuals, who demonstrate expertise in areas such as "human life value," "wrongful death" and "taxation." I believe that these Individuals along with a "hearing officer" are more likely to determine an award that is commensurate based on the unique circumstances of each individual. Additionally, I believe by maintaining a panel of "hearing officers," the decision making process would demonstrate a greater degree of objectivity. Equally alarming is the fact that the determinations made by the "Special Master" and "hearing officers" are "final" and "not subject to judicial review." It is imperative that the option to appeal such a determination be made available to the claimants. Again, fairness and objectivity should be the guiding principals of the fund. In the event an award is not viewed as equitable, an individual should, as in any hearing, maintain their right to appeal a decision. The right to appeal a decision is often a cornerstone of legal defences. If appeal is available to a criminal, why then should an innocent person not be afforded that same courtesy? Next, the method used to compute "economic loss" is of paramount importance. A "cap" with regard to recovery associated with "economic losses" is simply not acceptable. In fact, we believe an approach such as the one commonly utilized in personal injury cases is most applicable. Pursuant to such a method, the deceased's retirement date should be set to coincide with the date that the deceased would have been eligible to receive full Social Security benefits. Also, the deceased's income should be averaged over the last three (3) years given the fact that "economic losses of many of these individuals are associated with future income streams that would have been highly contingent, variable, or unpredictable " With that in mind, an approach that utilizes an "average income" is obviously the most appropriate method for determining an individuals income. Also, be sure to keep in mind that it is imperative that "income" include wages, bonus', stock options, partnership earnings etc. Finally, in an effort to fully reflect the earning potential of those lost on September 11th, inflation, historical wage increases, merit and opportunity for advancement must be considered. The final result of such an exercise would represent the individual's "base income." The "base income" could then be multiplied by the number of years that the deceased individual would have worked had he/she been eligible to receive full Social Security benefits. Furthermore, with regard to reducing the amount of the compensation by the amount of the "collateral source compensation," Life insurance proceeds (private and/or group) associated with premiums paid by the deceased, should not be considered as a "collateral source." After all, the deceased, in an effort to ensure financial support for his/her family, made a prudent decision to dedicate a portion of his/her after tax income to that financial security. To consider life insurance proceeds associated with premiums paid by the deceased as a "collateral source" would be akin to punishing the deceased for loving & caring enough about his/her family to ensure their financial future in the event a tragedy were to occur. Also, Social Security benefits should not be considered as a "collateral source." After all, the deceased paid into the system in an effort to ensure "social security." Unfortunately his/her family now represent the members of society that are in need of the very "security" that the system was designed to provide. The deceased was not give a choice of "opting out" of the social security system. On the contrary, an individual has no choice but to contribute to the Social Security system. With that in mind, it is obvious that his/her family should not be punished for receiving such benefits. After all, the Social Security system was never intended to be a "needs based" benefit. All individuals, regardless of income and assets, assuming that they secured the appropriate number of "quarters," have always been entitled to benefits regardless of the other type of assets/income that they may or may not have. Interestingly, countless millionaires receive Social Security benefits despite the fact that the income is not needed to ensure their financial well being. With this in mind, why should a benefit that plays an instrumental role with regard to a family's financial security be deducted from an award? Next, retirement plans (IRA's, 401 k, etc.) funded by the actions and sacrifice of the deceased should not be considered as a "collateral source." Again, the deceased, in an effort to ensure financial support for his/her family, made a prudent decision to set aside funds designed to ensure a comfortable retirement. A great deal of legislation (past & present) has been adopted in order to motivate individual's to plan for their financial future. Today represents the first step of that financial future. To consider retirement plans a "collateral source" would again be akin to punishing the deceased for loving and caring enough about his/her family to forgo current enjoyment in order to ensure financial stability in the event of a tragedy. Additionally, A "cap" with regard to recovery associated with "non economic losses" is simply not acceptable. In fact, it is imperative that the assistance of experts in the field of "human life value," be enlisted to determine an appropriate award given the ambiguity associated with valuing the "non economic role" of an individual. After all, the lose of the family unit, enjoyment of life and emotional pain is not easily discernible. However, given that I am both questioning the "fairness" of the fund and taking the position that benefits (life insurance proceeds & social security benefits) associated with payments made by the deceased should not be considered "collateral source compensation," it is understandable that the benefits funded by an employer (i.e. Workers Comp.) may be deducted from an award. After all, the maintaining of "Workers Compensation" is mandatory for employers and the premium associated with such coverage is an expense of the employer. This in turn may make this benefit similar in nature to the employer provided, non-contributory life insurance coverage - the $100,000 received from CNA. With this in mind, it is easy to understand that the "benefit" is employer provided and may be considered a "collateral source compensation." This importantly should include the partners and children of same sex unions. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. This importantly should include the partners and children of same sex unions. Zwick, Director Office of Management Programs U.S. Department of Justice Dear Mr. Zwick, We are the only children of a firefighter who lost his life in the World Trade Center disaster. Our parents were divorced in 1990 and our father subsequently remarried, but had no additional children. We are concerned that the Interim Final Regulations (the "Regulations") are not sufficiently clear and make it likely that there will be delays in the administration of the Fund. The Regulations also do not adequately address the problems faced by fragmented families like ours. Since 40-45% of marriages in the U.S. end in divorce, many families must share the difficulties of our situation. We recommend that the Regulations be revised to reflect three concerns that, if addressed properly, will benefit the prompt and efficient administration of the Fund: 1. Amounts payable to individual beneficiaries should be reduced to reflect any collateral source income they received, but should not reduce the portion of the total award for beneficiaries who did not receive, and do not have a right to share in, the collateral income. 2. The provision in Section 104.52 of the Regulations regarding the Personal Representative's distribution of the award to beneficiaries should be clarified with regard to the body of laws that should guide such distributions. 3. The Fund should provide for the Special Master, where there is a broken marriage or in other appropriate cases, to appoint a neutral, third party to serve as the Personal Representative, and administer the claim on behalf of all eligible beneficiaries related to a particular decedent. We below elaborate on each of these proposals. First, if the total award is reduced because of a collateral source, any funds given to the recipient of that collateral source should be reduced accordingly, but the total award to other beneficiaries should not be affected. For example, if the total award, absent collateral income, would be $500,000, and a beneficiary who would otherwise be entitled to $250,000 (50%) of the award receives or is entitled to receive $400,000 in collateral income, the award should be reduced only by that beneficiary's entitlement, i.e., by $250,000, rather than by the full amount of the collateral income. The net award should be payable only to the other beneficiaries who did not receive the collateral income and have no right to benefit therefrom. In the case of dependents of a beneficiary receiving such collateral income, it could be presumed that the dependents have the right to benefit from the collateral income. For example, an adult beneficiary and her minor child can both be expected to benefit from collateral income that the adult receives. But where the other beneficiaries are not dependents, it would be entirely unjust to reduce their award because one beneficiary related to the same decedent has received (or has a right to receive) insurance proceeds or other collateral income. Currently, the rules do not clearly or adequately address this issue. We believe this approach is consistent with the intent of Congress in enacting the Air Transportation Safety and System Stabilization Act (the "Act"). Section 405(c)(3)(A) of the Act provides for only one claim to be submitted on behalf of a deceased individual, and Section 405(b)(6) provides for reduction of "the compensation determined under paragraph (1)(B)(ii) by the amount of the collateral source compensation the claimant has received." Although Section 402(3) defines the "claimant" as the "individual filing a claim for compensation under section 405(a)(1)," we do not believe Congress intended to deprive beneficiaries claiming through a Personal Representative of their just compensation as a result of collateral source compensation to which they have no right. In fact, the Act uses the term "claimant" inconsistently. For example, Section 405(a)(2)(B)(ii) provides that the claim form to be developed by the Special Master should request "information from the claimant concerning any possible economic and noneconomic losses that the claimant has suffered" (emphasis added) as a result of the plane crashes; yet the Special Master, in developing the Presumed Loss Calculation Tables Before any Collateral Offsets, has logically interpreted this to include losses suffered by other beneficiaries claiming through the Personal Representative. The Act's inconsistency in its use of the term "claimant" is understandable in light of the state of urgency in which the Act was drafted and adopted. Plainly, Congress did not have the time to consider what would be the most just outcome in each possible circumstance, and Congress for that reason left it to the Special Master to adopt rules and forms to carry out its intent. We therefore believe that the Special Master is entitled to interpret the provisions of the Act liberally so as to best carry out Congress' intent of providing fair compensation to innocent direct and indirect victims of the September 11th terror attacks. In that light, we submit that the Special Master should interpret Section 405(b)(6) as requiring that only compensation which would otherwise be due to a particular beneficiary who receives (or is entitled to receive, or otherwise benefit from) collateral source compensation income should be subject to offset by the amount of such collateral source compensation, rather than reducing compensation under the Act to beneficiaries who will not receive or benefit from such collateral source income. To interpret the Act otherwise would be to assume that Congress wanted innocent indirect victims of the terrorists attacks to be unjustly deprived of compensation. Second, Section 104.52 of the Regulations is unclear as to how the award should be shared. The only direction given to the Personal Representative is that the award must be distributed "in a manner consistent with the law of the decedent's domicile or any applicable rulings made by a court of competent jurisdiction." We expect the generic reference to "the law of the decedent's domicile" to be a common source of confusion and urge that intestate laws, a body of laws that is well established and easily administered, provide the basis for distributions. Furthermore, we take the reference to "applicable rulings made by a court of competent jurisdiction" as a suggestion that disputes among beneficiaries may be resolved through litigation. However, given the relatively small sizes of the awards to be split potentially among multiple beneficiaries, and the cost and delay litigation would entail, we believe the Regulations should do as much as possible to enable distributions to be made without the need for resort to litigation. Third, the Regulations should provide for the Special Master (or his designee) to appoint a third party Personal Representative in appropriate situations, including in the case of fragmented families such as ours. Since our father did not leave a will, our understanding is that our father's wife would be his Personal Representative under Section 104.4 of the Regulations. As the Personal Representative, she would be in charge of distributing any award from the Fund, subject to the provisions of Section 104.52. Unfortunately, as is true of many fragmented families, relations between our family and our father's wife are strained. For example, we were not even notified of, much less invited to, our father's Fire Department memorial service. Furthermore, in the memorial card handed out to mourners, the adult daughter of his wife (from a previous marriage) was identified as his only child when, in fact, we are his only children. Although Section 104.52 authorizes the Special Master to intervene if children are not adequately compensated, we believe that this approach is only inviting difficulties because it does not address problems until after they have arisen. The process will be much more efficient and the interests of all beneficiaries will be better protected if beneficiaries in circumstances such as ours can request that a third party serve as the Personal Representative from the outset. The Fund will not be justly administered if the intention of the Regulations is solely to ensure that a suitably-sized award is provided to "beneficiaries." The individuals who are mourning loved ones will only receive fair treatment if the Special Master gives more attention to how the award is ultimately distributed. We respectfully submit that adoption of the proposals outlined above will help to avoid administrative delays and ensure that the Fund is administered smoothly and fairly, consistent with the Act and the intent of Congress. The govt should reduce the financial assistance which it provides to victims families by the amount of charity financial help they receive, given a minimum level of combine financial help. Basically , "fill the glass with whatever available funds from the charities, have the govt.(which is us, the taxpayers) , fill it up to the top." 2.Athough it appears that some in the Justice Dept. (per NYT article) believe charities should not be considered "collateral sources" and thus not subtracted, this is a new fund being created, with new guidelines, where laws on the books should not be picked according to a particular point of view. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. TheDepartment of Justice should do the same. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Friday, December 21, 2001 6:31 AM Help same sex partners of terrorist victims Dear Mr. Zwick: The very humane Fund for relatives of victims of the September 11 terrorist attacks must include all relatives of all the victims. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. They are interested in a political victory, not humane assistance. This Fund is intended for humane purposes; it is not a political statement, Mr. Zwick.
