I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

Be Inclusive
I urge you to include the families of gay, lesbian, bisexual and transgendered victims of September 11 among those deserving compensation. If any, now is the time to be inclusive, regardless of sexual orientation or marital status. Let those who lost their life partners be eligible for the September 11 Victim Compensation Fund.

International human rights standards including the Universal

Interim Final Rule
I have spent a few minutes gathering some information about the number of people usually at the WTC and Pentagon sites during normal working hours (workers, visitors, etc.) and the 'crude' death rates in the US, taking into account variations for "working age" vs. general public. If you do some math you come up with the following "worst case scenario": the odds of a particular deceased victim of working age being alive and one-or-more of the survivors-of-victim also being alive is effectively 0 after 3.133 years. I assumed 3.5 survivors-of-victim per victim (spouse plus 2.5 kids). So, providing 3.133 years extra income covers the "worst case scenario". But a lifetime of this income is certainly uncalled for. No one has any way of knowing how long any of these victims might have lived - or how long any of the survivors-of-victims might live. Giving the survivors-of-victims the benefit of the "best possible case scenario" is not justifiable. (Note: I did not include the numbers for the people on the planes or the response personnel, since these 2 populations are definitely not representative of norm.) Although the median household income in the US is $42187, the contribution of the highest earner (assuming 0-n earners per household) is $31948. So unless there are cases where multiple earners per household were victims, the median value of $31948 should apply. So, 3.133 years at $39148/year comes to $100093. Seems to me like this should be the economic compensation per deceased victim. This treats EVERYONE alike - the recipients of the compensation as well as the providers of the compensation (the average American)!
I would also like to see something figured in pertaining to the divorce rate! No matter what these surviving-spouses say (whether it be from grief or greed), none of their lives were the "story book/romance novel, blissful, utopian existences" that they are trying to convince everyone they lost. Get real! In the "normal" situation, alimony is a thing of the past. There is a significant probability that many of these marriages would have ended anyway. Again, the "best possible case scenario" (that they were going to live happily ever after) is not justifiable.
Also, a lot of comments have been made (here and in the media/press) about how these victims were 'only going to work'. However, it should not be forgotten that these people voluntarily worked at known target facilities. Every literate person in this country KNOWS the WTC was targeted before and that government facilities have been repeatedly targeted. Special considerations (compensation levels and extra benefits and added security) are part of the employment package at such locations. All of these victims knowingly weighed the benefits vs. the risks and decided this was the job for them. Every surviving spouse/child/relative had the chance to talk the deceased out of working there BEFORE THIS HAPPENED, but I bet they didn't! They sat back and 'enjoyed the benefits of the risk'. It is kind of like the people I hear about that signed contracts for heating oil at a fixed priced and now want to be let out of their contracts - they were perfectly happy when they were getting cheaper heating oil than everyone else, but now that the price is lower than what they have to pay IT ISN'T FAIR ANYMORE! Sorry Charlie!
Also, numerous comments have been made (here and in the media/press) of how much more horrific/traumatizing/exceptional/agonizing/unbelievable/blah...blah...blah this situation is compared TO ANY OTHER THAT HAS OR WILL EVER OCCUR. Baloney! The fact that 4 planes were simultaneously overtaken and crashed into buildings was unprecedented. Any particular death was not. Dead is dead - no matter what. If the "pain and suffering" is supposed to be for what the deceased experienced: well, frankly, a lot of them never new what hit them and none of them suffered very long. Nothing "exceptional" about it. If the "pain and suffering" is supposed to be for what the survivors-of-victims experienced: any unexpected death is experienced the same way by the survivors-of-deceased. Do they actually think they would feel "better" if the deceased had been shot by a stranger on the street? Nothing "exceptional" about this situation. The only justification for ANY compensation to the survivors-of-victims is LIABILITY - and that falls on the shoulders of the perpetrators, not the airlines/government/etc.
Since it seems inevitable that this program is going through one way or another, I want to make one suggestion: HOW ABOUT LETTING THE TAXPAYER WHO IS FOOTING THE BILL GET SOMETHING OUT OF THIS! WHAT A CONCEPT! (This is only for the survivors-of-victims situation. The case of those facing lifelong disability is too serious a matter to joke about). Here is my idea for the survivors-of-victims compensation: After you figure out the compensation amount for their situation, they have to win it on 'Who Wants to be a Millionaire'. Same set-up (Regis, TV, everything). They have to reuse previously used questions at each level (randomly drawn) so there won't be any 'bleeding heart easier than usual questions'. The only difference would be that the 'amount' at each level would be relative to their total compensation amount(which might be more or less than the regular $1M). Each player has to be from the set-of-survivors-per-victim - they choose who will play. They can stop at any point if they get nervous. Some of these people think they are such hot spit and 'above the average', LET THEM PROVE IT! I WANT TO WATCH! RATINGS WOULD BE ASTRONOMICAL! ADVERTISERS WILL COME RUNNING! THE SHOW IS FILMED IN NEW YORK CITY - HOW CONVENIENT! THIS IS CAPITALISM AT ITS BEST! ITS THE AMERICAN THING TO DO!

Dear Mr. Zwick, Attorney General Ashcroft,
and All Involved in the Administration of Justice:
I am writing to state my concern about the use of money in the September 11
Victims Compensation Fund. I am primarily concerned that these funds be used
to assuage the pain and loss felt by ALL families affected by this horrible
attack on our nation. This means including the families of gay, lesbian,
bisexual, and transgendered victims. I assure you, despite our government's
lack of recognition of relationships between people of the same gender, the
pain felt by those who lost partners, lovers, and co-parents is real and the
effects on their lives will be devastating.
I call your attention to the brave young gay man who lost his life on the
plane attempting to save the lives of innocent people in Pennsylvania, the
openly gay copilot on that same flight, the young gay couple and their
adopted three year old son who were killed on one of the flights, to the gay
priest who lost his life while ministering at Ground Zero, and to the many
lesbian and gay employees working in the World Trade Center. It is vitally
important now that our government treat all of our families with dignity and
respect and equality.
There was much doubt among those of us in the majority who did not vote for
President Bush as to whether or not his pick for Attorney General would be
capable of seeing past his own biases to dispense justice to ALL people.
This is the first major test of that question. We are waiting with hope in
our hearts and prayers on our lips that the Attorney General and the Justice
Department will indeed help to bring about justice based on what is right
and necessary, rather than personal point of view.
I urge you to follow the example already set by New York Governor Pataki in
granting compensation benefits: "on a showing of mutual interdependence with
the victim, in recognition that anyone who shared with the victim living
expenses, day-to-day activities and the emotional bonds of family deserves
help in this time of need."
This is a great test of our country, and we are proud of the effort and good
faith shown by our government and President so far. Please do not let down
the hundreds of gay and lesbian families affected by these horrible events
at this, their most vulnerable time.

9/11 Victim Compensation Fund
Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Fair distribution
I have made several contributions to assist families of the victims of 9/11,
however, I shall give no more.
I agree with the legislation that subtracts other aid and compensation such
as insurance death benefits from the total amount set aside for each family.
My husband died at the young age of 36. He did not want to die. He left a
wife and two boys, ages 15 and 10. However, his death was not so publicized
as those on 9/11. Those people did not choose to die either, and I
understand that. My children do not have a face to put to their terrorist
like Ben Laden. My childrend did not have anyone but their mother to make
sure they got through their grieving or to make sure they had money for a
college education. My family's terrorist was Cancer.
The only thing we can be sure of in this life is death. When it is our time
to go, it is our time to go. God does not make mistakes. I mourn for those
lost on 9/11 and I cry for their loved ones left behind. The money I
donated I hoped would go to those with little or no life insurance or death
benefits. I was lucky to have a husband who looked to the future and was
left with enough insurance to keep my house and educate my children if I
worked hard and watched my pennies.
I have recently met a young 33 year old woman who suddenly lost her husband
to a brain anuerism in October. They have an 8 year old boy and a 3 1/2
year old boy and two weeks after he died, she gave birth to their daughter.
She is panicking and doesn't know how she is going to keep her home and
provide for her children, let alone get through her grief. There is no fund
to help her.
It's not that I am unsympathetic. It's not that I am not horrified by the
terrorist attacks. It's not that I don't grieve for those who lost their
lives and feel the pain for the loved ones left behind. But I do feel they
should be grateful for any assistance they get. If they are already getting
some from other private entities, I feel it is only fair that their
distribution from the fund should be adjusted accordingly.

To Whom it May Concern:
I am disgusted and appalled that the fund is showing signs of discrimination.
In a time like this? How "Un-American" can you be? This is the kind of thing that makes me sad to be American. That we can still have people in this day and age who are unwilling and unsympathetic to someone because of their sexual orientation? How can you allow such hate? There were many victims of this tragedy, were some less affected because they are gay?

RE: Benefits under the September 11 Victims Relief Fund

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

SUPPORTING THE FAMILIES 100% (Article Re Backlash by        )
I was appalled to read about victims' families facing fund backlash for taking an activist role in seeking compensation from the DOJ. What better cause could there be? Inspite of prior insurance/pension settlements of a million or more dollars to some of the families. That only replaces maybe 10 years, or 15 years of lost income of these INNOCENT victims. Is that all a life is worth? The DOJ settlements should have been with no strings attached.......no deductions....period. With our beloved country's reputation of lavish waste on questionable donations/awards etc., the DOJ awards are fully deserved by each and every Victim's family. I am a totally unrelated-to-any-victim-and -their family person who supports a full award to all the families for their pain and suffering as victims in an Act of War!

I wanted to express our (family's) support of all the 911 families in the quest for fair treatment in distribution of funds, especially the Dept. of Justice Victim Compensation Funds>
What people forget to factor in, and which the above article appearing in my hometown paper, the Mobile Register, on 1/26/02 also failed to mention, is that even though $1.6 million average settlement sounds like alot to an average citizen, this amount must replace anticipated loss of income due to the untimely death in an act of war/terrorism. The article gave the example of the husband of        , who earned $96,000 annually. His family is entitled to abt $1.1 but must deduct other insurance/pension awards of approx. $l.4 milliion leaving it questionable that the         survivors would receive anything from the DOJ award.
Well, the pension/insurance settlements would only replace abt 10 years of lost income for the        , whose husband lost his life in an Act of War. Small compensation, I say! The DOJ award would add another 10 yrs approx. of lost income. These families absolutely deserve all the awards. Small compensation for innocent loss of life, especially, looking upon how millions and millions of dollars are wasted in this, our beloved country, for so-called "causes" not nearly as just as this one!
By the way, I am not related to any victim or their families, except by total empathy, in their losses and in their quest for fair treatment.

Discrimination is Un-American
For you to not honor the families of gays and lesbians equally with the other
"vicitms" is to continue the ugly abusive discrimination that has kept up
from truly being a great nation that includes all marginalized persons. You

Subject: Ensure compensation for ALL victims
Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.

Mr Kenneth Feinberg - Shame On You!
To Whom It May Concern:
In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press,"
Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (a
fund created by Congress and run by the Department of Justice), said that gay
partners of the heroes of September 11th will not necessarily be eligible for
the same compensation as heterosexual family members who lost their loved
ones.
I am appalled by this statement and feel that no matter what the individual
state's position on the subject is, everyone, and that means gay people,
should be eligible to recieve compensation for their loss. If laws can be
disregared for illegal aliens, isn't it hypocritcal to then use laws as a
reason to deny compensation to others?
Is their loss any less? Besides it's just the right thing to do!!

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th, including the children and families of low-wage workers and gay and lesbian families. Under
traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of
all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money
went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of marriage is unavailable, these families may find themselves in the traumatic predicament of
having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New
York have already announced that they will not discriminate against gay and lesbian families. The
Department of Justice should do the same.

important issues.

Equal compensation
I was so angered when I saw informaton on Good Morning America that this
Victim Compensation was in part based on the person's wages. I, luckily,
have no one that I knew personally in all this tragedy. But my anger for
those persons is real.
On September 11th, there was no separation of pain or destruction depending
on your salary. No one said "ok you have to suffer more because you made

anyone be given more just because they made more during their day? That is
the role of their employer-to furnish benefits related to their salary.
It is the role of the government to assist those in need WITHOUT PREJUDICE
TO THEIR PAYSTUB !!!
Those who made $200,000 would have many protections in place, such as life
insurance(both personal and employer) and other employer benefits that are
in correlation to the income. The person who made only $20,000 probably had
minimal insurance and minimal other benefits(if any). If anything, those
lower waged people will be harder hit with just trying to get by day to
day--eating, paying for education, medical support, the basics.........
The foundation of America is equality--in the face of the most horrible of
horrible events, our government now says to it's people "We can help, show
us a checkstub!" Whoever made this decision should hang their head in shame
!!

September 11 Victim Compensation Fund
Dear Mr. Zwick:
I am writing in response to the Department's request for public
comments regarding the forthcoming regulations for implementing
and administering the "September 11 Victim Compensation Fund."
I strongly urge the Department to draft regulations that ensure
compensation is available to all victims of the attack,
including the committed partners and the non-biological children
of gay and lesbian victims.
It is unquestionable that the devastating grief and economic
losses suffered by the families of gay and lesbian victims are
no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw
no lines in compensating those who suffered the most personal of
losses from these horrific attacks.
Many Americans lost their lives on September 11, each of whom
left behind loved ones. I urge the Department to honor these
bonds by treating the families of gay and lesbian victims as you
would any other.
