Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." My girls, and are 16 and 13 years of age respectively. and I worked hard to raise our children well but always with the idea that we hold a responsibility to provide for them should something happen to one of us. We worked for everything that we have. We lived within our means, contributing to our pensions, 401ks, catastrophic insurance, workers compensation insurance, social security and personal life insurance. We have suffered an incredible loss. My husband, my friend, my childrens father was taken from our lives. The Congress has established the Title IV of PL107-42, Victims Compensation, as part of the bailout of the airlines. Public opinion understands that we the victims, will be compensated with enormous sums of money from our government. Our neighbors are talking about us because we are now going to be wealthy individuals albeit without our husbands and fathers. As you well know, this is not the case. As you have established the rules, my family will receive nothing from this fund. I believe the following to be unfair. The twenty four hour rule The subtraction of collateral sources from the amount of compensation without at least a basic award regardless of these sources I also ask where within this rule was a family with a disabled child considered? Demanding that upon application the claimants right to seek further compensation from either the government or airlines with no knowledge of the amount of compensation is undemocratic. No money can replace my husband. I would have no need or desire for any compensation if my husband were here. But I would like to live out the remainder of my life knowing that I can provide completely for my children especially for my developmentally disabled daughter. I offer comments and recommendations in the following three areas. 1. It was not the intent of Congress or the President to preclude those who proceed with claims under the Act from also filing suits against the assets of Osama Bin Lidin, El Queda, the Taliban or any other terrorist individual, organization, or government involved with the events of September 11th. Such "frozen asset" suits should be specifically excluded from the waiver provisions under the rules implementing the Act. 2. The economic loss amount should not be reduced or offset by amounts received from life insurance proceeds or other benefits or assets owned by the September 11th victims. 3. Nor did my husband who is from New York whose father is a retired firefighter from the Yonkers fire department. However, I hear that your organization, in sending out compensation for victims who did lose someone are doing two things which I find rather disturbing. One, you aren't compensating the families of victims equally. You are in fact divying up finances by how much the person made. People who had a higher income and didn't plan for their families will get more than those who did or those who made less for that matter. As someone who donated money to the cause, I would hope my money would go to all in need equally. Second, I've read that while you are covering those families who may be illegal immigrants and the unborn, which I greatly admire, you are overlooking domestic partners in the compensation package. I would hope you would review this policy as well. If I had left someone behind and hadn't been married whether by choice or by law, I do hope that this would not preclude my partner being given the same benefits as those who were married. Eligibility To Make a Claim Don't parents count? According to the regulation, if my daughter-in-law, (whom I am very close to), decides to go with the Fund, I am totally excluded from receiving any monetary damages. It should be specified that other family members (parents) should also be part of the award. Their award should not be deducted from the spouses. As the law stands now, I also cannot sue or file a lawsuit against the terrorists, terrorist organization or countries that support terrorism, nor can I sue any company for negligence. I am totally excluded as if my heartache does not matter. The regulation should clearly state that surviving family members have their own, derivative claims. The regulations should also create uniform rules addressing which family members are entitled to share in an award and how they will share in the award. Again, don't I count? 2. Nature & Amount of Awards The victims should have the option of accepting the award or being able to sue on their own. They should not have to sign away their right to sue before they know what the award will be. The victims should also be allowed to sue the assets of the Terrorist funds whether they receive an award from the Fund or not. The Act could not have been intended to protect the financial interest of terrorists or terrorist organizations. Collateral benefits should not include payments from charities. The regulations should create a procedure by which there can be an administrative appeal of the award. I certainly you can help me to have a voice in this matter.
