We write to comment on the Interim Rules adopted effective December 21, 2001. There are several aspects of the Interim Rules which we believe do not carry out the letter and intent of the Act (Title IV of Public Law 107-42), but we wish to focus on one particular aspect of the Interim Rules which we believe to be clearly contrary to the Act and unfair to our client and others similarly situated. Our client's husband who was killed at the World trade Center by the highjacked airplane was a relatively young man, age 42 and earning $1.1 million a year as a stockbroker. In addition to his wife, he left four minor children ranging in age from 11 months to 14 years. The Interim Rules and the Special Master's comments indicate that, absent undefined "extraordinary circumstances" the economic loss award will be limited by capping annual incomes up to but not beyond the 98th percentile of individual income in the United States for the year 2000 ( 104.43). The Table of Presumed Economic and Noneconomic Loss ("Table") indicates that the 98th percentile is $231,000 for the year 2000 and computes the highest economic loss based on an income of $225,000. There is no basis in the Act for limiting the economic loss awards by capping the annual compensation level at $225,000. The Act contains no limitation on the amount of annual income to be taken into account in determining the "pecuniary loss." In defining "economic loss," §402(5) of the Act refers to "pecuniary loss...including the loss of earning or other benefits related to employment...to the extent recovery for such loss is allowed under applicable State law." The law of the State of New York, for instance, contains no limitation on earnings in determining the "pecuniary injuries" to the distributees of a wrongful death victim (EPTL §5- 4.3). Particularly in light of the offset for collateral source payments, such as life insurance (which is not an offset in a New York wrongful death action), it is unjust and contrary to the Act to limit the economic loss award by capping annual earnings at the $225,000 level. Surely, Congress did not intend to penalize and discriminate against a deceased victim's dependents because their husband and father was successful in his gainful employment. We request that §104.43 of the Interim Rules and related references be modified to remove the limitation on annual incomes being considered up to but not beyond the 98th percentile and that the Table be modified accordingly. Collateral sources which are deducted from the Fund compensation should only be life insurance, pension funds, death benefit payments and payments by Federal, State or local governments, as stated in the law. Funds received from charitable organizations should not be deducted. 2. A claimant should be required to waive their right to file a civil action only after a determination is made as to the amount of compensation that they will receive from the Fund, and the claimant accepts this determination. Sunday, January 20, 2002 1:34 PM Comments On September 11, I watched in complete horror from my mid-town Manhattan office as the Twin Towers collapsed. At that moment, I knew in my heart that a dear friend that was at work was dying. His wife and two children are now left without a husband and father. The horror that was that moment lives on every day for this family. All Americans were hurt in some way by 9/11; but the pain, loss and continued suffering of the families that lost loved ones go light years beyond anything anyone else feels or can even comprehend. Unfortunately, our government is not helping to alleviate this situation. Under the present proposal for the victims compensation fund, my friend's family (and hundreds of others) will be receiving little, if any, compensation for their loss. There are several problems with the present proposal: (i) non-economic damages (or pain & suffering) are equal to $250,000 for the decedent and $50,000 for each surviving person; (ii) economic calculations are based upon National statistics and not NY earnings statistics for potential loss of earnings (even the Federal Government pays employees more that work in the NY area); and (iii) the application of collateral offsets. These issues should not be considered in a vacuum, as many appear to be doing. The intent of this proposal is clear -- avoidance of protracted litigation and limitation of economic harm to the airline industry. These are noble goals. However, if this were any other airline disaster, recoveries could be much higher that the current proposal. Indeed, recoveries could be as much as $2 million or more. And, such recoveries would be based upon actual earnings and not subject to an arbitrary cap. Moreover, recoveries would not be reduced merely because the victim had the good sense to pay for life insurance and save for retirement. Money will not bring back lives; it is not meant to. What it can do is fairly compensate families for the loss of their loved one. There are many people and organizations that bear some responsibility for the events of 9/11 -- for instance, the airlines and airports who were unprepared to protect their passengers and the Port Authority of NY and NJ that told people not to evacuate and remain at their desks. These entities are benefiting from the compensation proposal far more than the victims. The removal of the spectre of protracted litigation saves them millions in fees and eventual judgments. The victims of 9/11 deserve to be fairly compensated if they are to cooperate with the government's goals of limiting litigation and liability. The present proposal for the victims compensation fund must be altered to permit compensation to be calculated in a proper manner. Actual earnings and potential earnings should be based upon reality -- the actual wages and NY statistics; not an arbitrary standard. Also, there should be no caps on these calculations. Finally, families that planned for their future by buying insurance and saving for retirement should be penalized. The only message this would send to Americans is that you are better off if you are immature and irresponsible. Clearly, not the right message. I urge each of you to sign onto Congressman Peter King's letter concerning the victims compensation fund. Thank you for your time in this extremely important matter. Thursday, November 08, 2001 11:54 AM Federal vs. Private Aid My husband and I donated $1000.00 to the United Way September 11th fund. This is the largest donation we have ever made to any charity or non-profit organization. We made the donation with the idea that the money would go directly to the victim's families and especially to their children. However, we are concerned with all of the reports in the papers about potential abuse, reluctance of families to deal with the bureaucracies and paperwork, and migrant workers who have lost everything and cannot receive compensation because of their illegal status. We hope the Federal government will step in and assist in the distribution of charity and government funds to assure that all victims are adequately compensated and possible abuse of funds or double-dipping is curtailed. Fair limits should be imposed. We must remember we are fighting a war. Our economy will be seriously stretched for the foreseeable future. Friday, December 21, 2001 2:21 PM Equal Access To Benefits Under the September 11 Victims Relief Fund December 21, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape from... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise about that ever..."We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. This importantly should include the partners and children of same sex unions.
