Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. We were concerned for our family back in the US, for our safety as we traveled, for the terrible pain and suffering of those who were directly affected. We had planned to travel to Morocco on September 13, and after spending hours watching the news (sometimes in Spanish), we wondered whether that was wise. But we decided that life goes on, and so we went. Interestingly enough, a couple on the tour we took on the 13th, was from New York City. They were very concerned about friends that they knew might have been in the Twin Towers. They were anxious for commuhications with home to be possible, and checking their email address regularly, and very emotionally distraught. They were also gay. It upsets me to think that they, if they had been in New York that day, and their friends might be treated differently from any other couples, especially in such a traumatic time. Enough pain has been suffered! Everyone who lost a partner or child or parent deserves to be treated the same, regardless of sexual orientation! Wednesday, February 06, 2002 3:45 PM (no subject) My father was a Security Officer in Building Two on the . he had been looking for a job desperately after being released from a job whre he worked 24 years as an executive designing Sprinkler Systems. He was in his late fifties and had the hardest time finding a job. The home they lived in all my life for 34 years was coming into financial problems, so my dad knew he had to act fast. He knew that his salary would drop considerable but he needed the job and due to his age he wasn't getting many other offers. My mother was a Secretary and did not make enough money to support all of them. They both adopted my niece since she had been 3 months old. She was now attending Catholic School in Brooklyn and her tuition needed to be paid. He received an opportunity to work as a Security Officer. The salary was low but it was a job and he desperately needed one in order to support his family and save his home. He had to attend training classes and these classes included video tapes and he had to have knowledge of the exits and stairways. Of course this information isn't as useful when you have a terrorist attack like this one. I don't believe any of us ever took into consideration that our father was puttinghis life in danger. I don't believe we thought about the attack that occured previously. We were all relieved that Daddy had gotten a job because we knew how important it was to him. My father took this jjob very seriously and the people that worked there loved him. At my fathers memorial I had the opportunity to talk to most of the people who worked on his floor they all told us of the events of that day and where and what my father was doing. He was calm they said and he evacuated them and showed them where the exit to take was/ One ot the young men said he oiffered to help my father but my father yelled at him to get his ass out of here he could handle things. He went to evacuate others, after that he was never seen again. My father was a Security Officer and I am surprised that no one is taking into consideration that fact that alot of Security Officers lost their lives as well as Firemen and Police Officers. My father was assisting people to evacuate. If his job was to work at a desk like everyone else he would have made it out of the building, because he would only be responsible for himself. But he was to evacuate personnel that worked there that was his job and responsibility. Now my mother who has been married and never seperated from my father in 34 years is being told that based on the fact that my father was 61 years old and only made a minimum salary, his life isn't worth as much as anyone else because he would have retired in four years. My father is a Vietnam Veteran, he was in the Airforce as a medic in Vietnam from 1963 to 1969. At the age of 61 he was trim and in good health. He ran 6 miles a day and ran the New York State Marathon for many years. He was responsible for taking care of his 96 year old mother. I miss him so much. I have never known my parents to be apart for so long. The house is filled with his memory. My mother has not been able to return to work since September 11th. She is depressed and cries alot. Things she never had to do alone before she now has to learn to do. My niece of which my mother and father adopted has lost another father to Violent Crime. Her father had been murdered three years before and now her grandfather which assumed the role of her father has been murdered . She has a blank stare. I want justice for my mother and my niece and my grandmother. I can't take away their pain or mine. My dad was special and unique and many people would have loved to have known him. I know he was doing his job when he died. He just didn't realize that the building would collapse in the interim. He has worked hard all his life and paid taxes all his life just like every other hard working American citizen and even served his country. I do not believe that the Security Officers/Guards are being given fair consideration. Please reconsider your decision. You cannot put the Security Officer in the same category as other Personnel that were not hired for Security purposes. While everyone was trying to escape and save themselves my dad was showing them the way. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, November 14, 2001 10:29 PM Comments on 9/11 Victim Compensation Fund Before I get into specific comments, I do not think the federal government should be doing this at all! I would really like to see what the Supreme Court Justices think of this! But it looks like it is going to happen. So ... DEATHS Boy - what a can of worms you are opening up! After a first-reading of this material and based on my recent experience as a personal representative (my spouse died - also in an unexpected situation involving search-and-rescue/recovery operations) in which there was no will, an ex-wife (and so potentially a probate effecting divorce settlement), minor children from a previous marriage, multiple states involved, not to mention parents-and-siblings-of-the-deceased who just could NOT accept the fact that they are not 'legal heirs' in probate matters, AND ON AND ON AND ON! You have a chicken-and-egg question here - you cannot determine needs until the estate is settled and the estate cannot be settled without taking potential compensation into account! What about claims by creditors of the deceased? What if the will explicitly excludes the spouse/children and leaves the estate to someone else? Divorce settlements, child support agreements/orders, prenuptial agreements, same-sex partners, divorces filed but not yet settled, short-duration vs. long-duration marriages, same-sex partners - all of these are problems are to be expected and better be taken in to account ahead of time. If you go the 'personal representative' route, then it is the desires of the deceased as reflected in a will that will count. If no will, then intestate laws. But either way, the compensation is tied to the estate of the deceased. If you want to sever any tie to the estate, then you also have to sever the tie to 'legal heir'. In which case you will start getting claims from 'significant others'. My recommendation: In the case of death, I would limit the compensation to payment of any benefit from a life insurance policy held by the deceased (independent or thru employer) but which was not payable due to the circumstances of the death ('act of war' or something). The beneficiary on the life insurance policy would be the recipient. All taxes/etc. issues would apply just as if the benefit came directly from the insurance policy issuer. No waivers required, no probate complications, case closed. If the deceased DID NOT have any life insurance, I would limit the compensation to whatever is provided for enlisted personnel killed (like the guys in the helicopter that went down). The military policy probably already has all the definitions/specifics needed in this situation. Under this 'plan', if the deceased had life insurance and it was paid, no further compensation would be made under any circumstances! PHYSICALLY INJURED I would limit 'qualification' to those who have verifiable proof that they were injured enough to have required medical treatment within the first 24 hours after having left or been freed from the site in question (they might have been trapped for more than the first 24 hours!). The source of their injuries would most likely be stated on the record of the medical treatment ('was at WTC site') or, if not, would have to be verified by other means (the physician, etc.) - this would satisfy the 'present at' issue. If the injury was not enough to even require treatment, no compensation is justifiable - thus settling the "physical harm" question. The 24-hour limit settles the "immediate aftermath" question. People who were officially on site after the first 24-hour period all have injury coverage/compensation accounted for by other means. Anyone else claiming an injury AFTER the first 24-hours was well aware of what they were getting into and probably were not authorized to be there anyway! The amount of compensation would be equal to the cost of all medical expenses directly attributable to their 9/11 injury which their insurance (if any) did not cover - whether due to deductible, co-pay, not-covered, etc. It should be like 'secondary insurance' - just pick up the rest of the medical bill, but nothing else. ADDITIONAL CONSIDERATION FOR INSURANCE PITFALLS! I would also provide compensation for any home owners, auto, personal property insurance that was carried but for which payment was not received due to the circumstances ('act of war'). I see this clause all over, and I'll bet some people get hit with it. Since I think it is pretty well accepted that this circumstance is considered as-close-to-an-act-of-war-as-anything, the compensation fund should cover this exclusion - according to the policy held (amount, replacement cost, etc.). That is it. Nothing else. They should not get anything else FROM THE FEDERAL GOVERNMENT concerning lost jobs, trouble meeting bills, future earnings, mental conditions, special unemployment benefits, special health insurance benefits, college funds, lump sums, special income/estate tax treatment, etc. All of their other needs are going to be more-than-met by the private sector. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
