On September 11, 2001, my youngest son , along with thousands of others,was killed in the terrorist attack on the World Trade Center. The pain of his loss and subsequent grief has been incredibly difficult to bear as I am certain you can understand. I am continuously haunted by the thought that he suffered a harrowing death by fire , unable to escape from the 104th floor of WTC1. I do understand the need to resolve the issue of compensation to avoid prolonged litigation which could potentially have long term economic effects on our country . I also believe that the Victim Compensation Bill addresses these issues perfectly. For it to work effectively though, I believe it must be applied equally, simply and non-discriminately. My suggestions are, as follows: 1. The amount of the Settlement should be set ? the same for every applicant, no discretionary decisions . All of us are suffering the same grief regardless of our position in life. Arbitrary decisions made on a ?case by case? basis will only require us to hire attorneys to write our appeals to insure that our cases are pleaded properly. What will happen to those who do not have the funds to afford a top lawyer? A pre-determined offer of settlement based on relationship would also eliminate need for appeal. Take it or leave it. 2. Insurance and other payments should play no role in determining amount of settlement. To do otherwise would require the submission of reams of documentation . The loss of life and subsequent pain and suffering is the same for all of us. 3. Most important, please try to keep a simple, uncomplicated process. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. These people have already suffered the enormous loss of their loved ones. Now, they suffer doubly by having their relationships deemed unworthy by the very society in which they lived and in which their partners unwittingly died. Every single person who perished in this horrible attack--regardless of the texture, shape, or size of his or her part in the great American mosaic--deserves to be honored in the fullest possible way. This includes honor and respect for the ones they left behind, the ones with whom they chose to lead their lives, the ones who will remember and mourn for them long after their names have faded from your and my memories. I have studied your recent comments about the Fund and find your argumentation as to why you must discriminate morally and intellectually indefensible. You avoid responsibility for discriminating by citing the need to respect each individual state's laws on domestic partnerships and gay and lesbian partnerships. However, in the next breath you take great pains to stress that the laws governing illegal aliens will be waived in order to accomodate the moral duty to compensate the surviving victims of this tragedy. Why are federal laws regarding residency, naturalization, immigration, and taxation subject to flexible interpretation given the extraordinary circumstances of 9/11 but not laws regarding domestic partnerships? As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. If you have the audacity to do such a thing, then I truly hope you are a strong group of people, because I will pray endlessly that your conscious never ceases to rest for that kind of injustice. "In an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, the head of the September 11th Victim Compensation Fund (a fund created by Congress and run by the Department of Justice), said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost their loved ones. According to Feinberg, lots and lots of people will receive compensation under the plan, including children, babies, and even fetuses. And as an indication of how generous the fund will be, even illegal aliens, who aren't American citizens and who are in the US in violation of federal law, will receive benefits. Feinberg even says that the Attorney General has promised that if undocumented aliens come forward, they won't be kicked out of the country, and their employers won't be penalized. "The attorney general, in consultation with Immigration, etc., undocumented aliens who come forward, the families will not suffer any consequences. They are covered by this program. They will get a check. The employer, where we need the economic information about the undocumented alien, will not be penalized," Feinberg told "Meet the Press. [Gays and lesbians are] left out of my program to the extent that their own state doesn't include them. I cannot get into a position in this program, which has a one-and-a-half or two-year life start second-guessing what the state of New York or the Commonwealth of Massachusetts or the state of Virginia or New Jersey, how they treat same-sex partners, domestic live-ins, etc. I simply say this: What does your state law say about who is eligible? Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Saturday, March 16, 2002 2:35 PM Victims I am writing today to express my outrage over the clear and discriminatory policy that is currently in place that would provide Victim Compensation Funds to fetuses and the families of illegal aliens and yet deny the same funds to the surviving partners of same-sex couples. For a fleeting moment following the horrors of 9/11 I believed that the days of hyphenated-Americans (black-Americans, Latino Americans, gay-Americans....etc.) might actually be over. Like many others worked as a bond trader at on the floor. now has three small children ages 3, 5, and 7 to care for and support alone.I am writing to express my serious concerns and objections to the Department of Justice's (DOJ) "Interim Final Regulations Governing Payments Under the September 11th Victim Compensation Fund." I have read the letter that Congressman Marty Meehan sent to you on behalf of the victims.I couldn't voice my concerns and objections any better than he did in his letter.I urge you to strongly consider his objections and recommendations. Specifically I believe it is important to establish a substantial meaningful minimum that all victims will receive.The figure of $250,000 per person for non-economic damages is completely unacceptable and sends a statement to the victims that their losses are not valued in either a legal or humane way.I also want to voice my concern and bewilderment regarding why you have capped the incomes to be used in the calculations at $231,000.I have read and re-read the original bill and I can't find anything in it that required this type of cap on economic losses.I can only assume that this limit was set to appease those who object to the "government supporting these people."Those who have this view need to be reminded that this bill was put in place primarily to protect the airlines and secondarily to address the fact that the victims would have no recourse to sue for just compensation.Please do not give into this pressure of public opinion.All of these families are entitled to be compensated for the full extent of their economic and non-economic losses since they really have no other recourse at this point. I realize that you have a tremendously difficult job to do in balancing everyone's needs and concerns.However, I urge you to do the very best that you can on behalf of all the victims.I have seen first hand how painful their situations are and how much they want to move on with their lives. However, they have a lifetime in front of them in which they must support their families that will need tremendous care and attention for years to come.By fairly and fully compensating them for non-economic and economic losses, they can move on with the rest of their lives.
