In 1981 President Regan ,for who knows what reason, took away the survivor benefits for children of parents who died after they reach the age of 19 or the day they graduate from High School. Great Graduation Present?! Needless to say for most children with one or no parent college is out! Especially if depression due to the parents death sets in...... My 2 son's reached age 19 and lost the $500 per mo survivor benefit they rec. after their father was killed he was crushed between 2 RR cars. It was sudden,without warning, no chance to say goodbye, horrific death of their male role model at the most crucial age of 14 and 15 years old. However, when they reached age 19 and lost the benefits life became hard to handle. One son was Senior class treasurer, student council rep and was in Junior college classes for college credit. We did not have the $129 . to pay the High school for his classes to count. He wanted to be a Doctor. No senior pictures, a few announcements and that was all. My gifted (his grades in HS dropped to 1.2 the quarter his dad died ) son's friends are Seniors in College he is now a Sophomore as he has had to drop out 2 times to earn money and then try to go back. He lives in an apartment with his brother and they gets a part tuition scholarship for football. He has no books and had 3 B's and 1 A at mid term He played football last Saturday and had not eaten 2 meals on Friday he said he and his brother jump over the rope in the school cafeteria sometimes to eat free .(they are in a " christian" college.) I told them this was lying but.......... Sunday I bought him and his brother $243. in groceries and did not pay my rent. $730. I am a teacher and I clear $925 every 2 weeks. I have been ill but currently can't afford the medicine co pay so I can't get my meds. But last week I received a letter from the Dept of Ed that they will now take my income tax return for past school loans from 1971 when I got my College degree. I feel like I am paying enough but now the money will be less. The Ed dept already takes over $100 every month for past school loans . My older son has a heart condition and medical bills prevented me from getting ahead to pay the loans when the boys were growing up. Needless to say the 2 boys are now struggling in college money wise. The older son is a Senior now in college and works full time and that is ok but at times the depression hits and it is so hard for the boys to keep trying. Like Sept. 11 when the stories of people going through what they went through and the thought that even though you try to make people proud of you and are a model High school student you won't have money to go to college. We have taken the max out in loans and there are not that many grants. There is still not enough for school. Loss of that survivor benefit really hurt our family. I never remarried after the children's father's death. This means there was just one income. We really needed the survivor benefits to continue . Cobra ins. was out of the question we could not afford it. Especially with my older son's pre existing heart condition. Meds for seizures have left him with a learning disability that requires him to study 3 times as hard as others just to get a "C". The railroad however bought out the Santa Fe RR and many other big businesses made money in 1981 when this was passed by congress. The Social Security laws are the same and the children of America were "sold for 30 pieces of gold" by congress. I know the children who lost parent's in the WTC bombing will reach age 19 or graduate from HS in the coming year. Someone needs to change this terrible law. The survivor benefit needs to be "grandfathered in" to cover all children who lost parent or parents and continue until the child reaches age 25 or graduates from college. The taxpayers & workers of America do not know about this problem unless a family member dies . Also they don't have enough money to continue to pay with the job lay offs. Not a day goes by when my son's do not think of their Dad and his pain and thoughts at his death. Yesterday their Dad's Mom died and the whole thing will be relived Friday at her funeral. Please help the victim's by paying a lobby in Congress to change this unfair law. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. In each case the person who was killed was the family's primary wage earner. In each case there are young children who have been deprived of a father, and wives who have lost their husbands. These families have suffered emotional devastation, and each of them now faces an uncertain financial future. The legislation which gave rise to the Compensation Fund, simultaneously eliminated the prospect of victims receiving adequate compensation through private litigation by limiting liability to the amount of the insurance coverage maintained by the air carriers. It is therefore essential that the fund be administrated in such a fashion as to guarantee that claimants will receive adequate compensation, since no reasonable alternative to the fund now exists. Unfortunately, the fund fails miserably in this regard. In formulating the compensation rates available under the fund, there has apparently been little consideration given to the economic realities faced by many of the families who were impacted by the September 11 tragedy. Many of those who worked in the WTC, especially those in the offices on the upper floors, were the top people at some of the most successful financial enterprises in the world. Their talent, ambition and hard work provided them with levels of compensation far beyond the upper limits recognized by the Compensation Fund. They had lifestyles and obligations commensurate with their extraordinary salaries. Their survivors have now been deprived of those salaries, but the obligations remain. Under the formulas provided by the Interim Final Rules the ultimate compensation available to surviving families can amount to a small percentage of the victim's annual salary. The September 11 widows will be forced to meet the needs of their families through a system which refuses to recognize the true value of their loss. The alternative: face the daunting prospects of a civil law suit the outcome of which has been pre-ordained by Congress to be meager, even if all burdens of proof have been satisfied. In Connecticut the measure of civil damages is "fair, just and reasonable." For many of the survivors of September 11 the system which has been established to provide them with compensation makes this fundamental concept an impossibility. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Tuesday, December 18, 2001 9:22 AM Protect Traditional Marriage Mr. Kenneth Zwick Office of Management Programs Department of Justice Washington, DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp, writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." Thursday, February 07, 2002 1:13 PM Government's Role We all grieve for the people directly affected by the September 11 attack and the families and friends of all those lost; their lives will never be the same. The American people opened their hearts and wallets to these victims in an outpouring of great sympathy and sadness. But then Congress got involved, bringing to the fore our "great" American tort system. Assuming that Congress instituted this compensation program in order to head off any suits against the airlines or the government, and not just a knee jerk reaction to a horrible tragedy, shows again one of the great defects in our American culture. How can anybody in good conscience hold the airlines or the government responsible for what happened? People scream out one side of their mouths for more and more freedoms and "keep the government out of my life", and then say out the other side "why didn't you stop those terrorists?". This compensation program sets a very significant precedent for any future terrorist actions. What if, God forbid, a New York City, a Los Angeles, or a bigger area is wiped out? The money that the government takes in is not a bottomless pit as Congress seems to think it is. Many people die tragically in disasters, murders, etc. and the government does not get involved nor do people pour millions into charities to help the families. No, these families somehow pick up the pieces of their lives, try to adjust, and push on. As horrific as September 11 was, it was another disaster in a long list of disasters throughout history and unfortunately will not be the last, natural or man-made. Monday, January 21, 2002 11:52 PM Comments Federal Victims Compensation Program I attended the rally on 1/18 at the Park Avenue Armory in NYC. Below are my comments regarding the aforementioned subject: As the spouse of FDNY/Paramedic , who gave his life to save others on September 11, I am disappointed on the ruling of the Federal Victims Compensation Program, specifically on how the amount was determined for each family affected by this tragedy, especially the Uniform personnel. Why should Uniform personnel be penalized for having a good pension and/or life insurance when their type of job puts them at risk every day? In order for them to protect and make sure their families are taken care of, they would need to have this pension and/or life insurance. Why then should pension/life insurance or any government funds be deducted from the amount being compensated to prevent the families from sueing the airlines. With this ruling, many families are not being given a choice. It gears families who are being penalized to go towards a lawsuit, but at the same time they don't want to go thru the emotional anguish of a lawsuit. Eventhough, money would not replace the 3,000 lives lost on 9/11, reality is that all the families need to be compensated fairly and equally. Personally, I have had a great loss and I would never be able to fulfill all my dreams with my love one the way we had planned but knowing that my husband die as a hero doing the job that he loved for 17 years and the country that he love; I feel that the right decision will be made to justify for the country's great loss! Monday, March 18, 2002 1:27 PM 911 Fund I have recently been made aware of the fact that money donated to help the victims of the September 11th attacks is being given to families of victims on one condition... they must be heterosexual. According to an article (http://uspolitics.about.com/library/weekly/aa031102a.htm), the head of the September 11 fund stated on Meet the Pressthat although money would be available to illegal immigrants, gay partners of the victims would not be eligible to receive the same funds. There is no other explanation for this other than outright discrimination of homosexual people. Since the terrorist attacks, I have seen more patriotism and compassion in America. However, I have also seen more finger-pointing, more racism, and more discrimination in general. One would think that in times of crisis, people would come together. However, actions like those taken by the September 11 Victim Compensation Fund proves that this country as a whole is still too intolerant of those who are labeled as "different." Discrimination is not the answer to defeating terrorism or to making this world a better place. It is, however, the cause of events such as those that occurred on September 11. Discrimination has plagued this nation since its birth. It has lead to nothing but hatred, which, unfortunately, doesn't discriminate.
