Innumerable 'gay' men and women have died for America; have died so that others may be free, gay or straigt- that we Americans would be free. The partners of gays and lesbians who died in the 911 terrorist attacks experience the pain and loss of a loved one the same if not more than, 'straight' Americans whose spouses or family members died. I cannot believe that I am 50 years old and that it is the year 2002 in the United States of America and that the Dept of Justice of our federal government, a government that taxes all Americans equally, would exclude recipients who have contributed money and more to this country; who have obeyed the civil and criminal laws of this country; who have been model citizens but for the sex of the person that they chose to love, cannot share in the largess of the 911 fund. I beg the DOJ to reconsider its discriminatory position, for we are, one and all, Americans and should treat each other as such. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"Severy death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape fromSThe Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did died. Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families. There should be no compromise about that ever." I was dismayed and outraged to hear that Kenneth Feinberg, the special master in charge of the federal victims' compensation fund, has decided to let bigotry and discrimination be his watchwords when it comes to recognizing the families and partners of gay and lesbian victims of 9-11. As its name indicates, the federal victims' compensation fund is federal money, not state money. ALL people should be treated fairly, equally, under the blanket of federal jurisdiction regardless of which state they happen to call home. The Bush administration has been getting a lot of mileage out of the rallying mantra of a United America, expecting support from all yet refusing to give fair treatment to all. There were gay and lesbian victims and heroes on 9-11--there was no discrimination based on sexual orientation in those terrorist acts. There continue to be gay and lesbian people working at ground zero and risking their lives in this war on terrorism. Their loved ones deserve the same honor and recognition as all other beloved survivors. Anything less is a shameful example of the hypocrisy of Feinberg's position--he will compensate illegal aliens but not gay American citizens. He will compensate fetuses but not the children of gay families torn apart by 9-11. It is outrageous! I sincerely hope that the administration will rethink this stand and recognize that, as the federal government, they must stand up for all of us, not pick and choose or leave it up to current state statutes. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Washington, D.C. 20530 Dear Director Zwick: On behalf of the Association of Flight Attendants (AFA), representing 50,000 flight attendants at 26 airlines, we are writing to comment on the Department of Justice's November 5 Notice of Inquiry and Advanced Notice of Rulemaking regarding the September 11th Victim Compensating Fund of 2001. AFA represents some of the flight attendants lost onboard aircraft during the attacks of September 11th. The purpose of the notice is to ask for public comment in the development of any rules established under the program "including, but not limited to, potential beneficiaries of the program, their employers, the legal community, and all those who have come forward to help those impacted." The September 11th Victim Compensation Fund is an important program in helping victims and their families recover from the attacks. However, we have concerns that the current proposed statute does not clearly identify that domestic partners in same-sex relationships or non-biological children are eligible to receive compensation from the Fund. We believe that when Congress approved the Fund it was for the purpose of helping all families to recover their economic security and ease the economic difficulties of all survivors. Compensation delivered through the fund must assist all individuals adversely affected by the September 11th attacks without regard to sexual orientation or biological relationship. At some carriers represented by AFA, domestic partners are included in benefit and survivor packages. Clearly, companies have recognized the reality of family structures and relationships in today's society. It is important that when implementing the Fund, the Department must also recognize these relationships and provide compensation to individuals that were economically and emotionally dependent on the victim. In conclusion, while we support the September 11th victim compensation Fund, we believe it is crucial that all surviving family, members, including same-sex partners and non-biological children of those who lost their lives, have access to compensation from the Fund. Please do not discriminate against the unmarried partners of September 11th victims. All unmarried partners, gay or straight, young and old and their dependents should be eligible for compensation based on a set of minimum guidelines. These guidelines should be based on the length of relationship, the fact that the couple was living together at the time of an individual partner's death, established joint finances, existing dependents such as a child/children, etc. If one or more of these factors--and others along the same lines--were in place, then unmarried partners should have the same compensation rights as married partners. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airlines industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked-the World Trade Center, the Financial Capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "...every death is tragic, A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come-is a horror these families will never escape form... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Giuliani stated in his farewell address: "we have an obligation to the people who did die... Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families...There should be no compromise account that ever..."We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for pain and suffering more accurately reflect that horror which was suffered. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am writing to you to plead her case and to encourage you to change the current victims compensation fund regulations that provide compensation for a few and are inadequate to all. Case in point, under the current tables will be receiving very limited compensation, if any. I would ask that you implement the following changes as soon as possible to rectify this injustice: 1. Use UP-TO-DATE NEW YORK STATISTICS which would reflect the victims potential lifetime earnings. 2. ELIMINATE THE CAP of $225, 000 in yearly earning potential. 3. INCREASE THE NON-ECONOMIC DAMAGES taking into consideration the immeasurable pain and suffering endured by our loved ones and our families. Non-economic damages should be guaranteed due to the offsets applied by Congress and the amount of individuals who will receive limited compensation from the fund. 4. Families should be fully informed of what their compensation will be in writing prior to officially waving their right to litigate. This would maintain their rights to pursue civil time in state or federal court for damages. Thank you for your consideration in this matter. Wednesday, December 19, 2001 9:13 AM Ensure Human Rights December 19, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
