Tuesday, November 06, 2001 4:42 PM Victim compensation fund payout. All compensation from all sources should count. I can't imagine anyone wanting citizens to be worse off after the attack. However, how do you quantify a victim's well being? Where do you draw the line? It is my opinion that no one should get rich. If you are a taxpayer and agree -- then all compensation should be taken into consideration (charitable or otherwise). The real question is does government want to make people "wealthy" or "financially whole". If a man could earn a million dollars in his lifetime his family would certainly be better off financially to have the money now versus spread out over the course of his life. No one would argue that most people would rather have their loved one living and have less money. The government can't bring the victims back nor should it try to make up for the loss by over paying. All compensation should be considered: charitable or otherwise. One of the main concerns with the 9/11 Compensation Fund is that no one actually knows what the compensation will be. Why can't the families be advised of this crutial information before signing away all their rights. Because they are required to sign away their rights blindly, the families do not have full faith that the government will be fair & equitable. I know that it is in debate as to how the domestic "life" partners of victims will be aided in their time of grief. I would like to offer a show of support by asking the Justice Department to include among relatives eligible for compensation, those who lost their life partners as well as de facto parents or children, without regard to sexual orientation or marital status. I would ask that the U.S. Government to follow the example already set by New York Governor Pataki in granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day-to-day activities and the emotional bonds of family deserves help in this time of need." Please keep in mind that everyone who lost a loved one will suffer from this tragedy. Every person, regardless of their sexual orientation, still grieves the loss of their devoted life partner, even if that person was not eligible to hold a "marriage certificate" due to their same sex partnership. Wednesday, January 23, 2002 12:02 AM (no subject) Dear Mr. Feinberg, My daughter was a victim of the attack on the World Trade Center.As we all continue to deal with our losses and grief,I have watched many families struggle with the realization of what their future financial circumstances will be as a result of the implementation of the Victims Compensation Fund.I continue to believe that the worst of these results were unintended, but they are nonetheless real. In authorizing the Fund, Congress significantly diminished the legal rights of victims and their families by limiting the liability of the airlines. While we can understand and support the economic considerations underlying that decision, the decision nontheless substantially altered the opportunities for redress. Regardless of one's views of the difficulties of litigation in this case, the fact that many victims believe that under normal procedures, they would have a reasonable opportunity to recover damages in line with other cases dealt with in our legal system. In removing these rights, it would have been fair to place the victims in a comparable position. I think that many people would also accept some reduction in exchange for the greater certainty and speed inherent in the fund mechanism when compared to litigation. However, the Fund in fact puts many claimants in a far worse position, and in a large number of cases there will be no recovery. The primary defects inthe current scheme are the collateral source offset, the artificial cap on recovery of economic damages and a cap on non-economic damages which bears no relation to awards routinely made in the court system. None of these circumstances would be present if the claimants were proceeding through normal litigation channels. I have been in contact with many families, and I know the extent to which they are suffering as a result of the current compensation structure. They are forced to deal with the worst of personal losses and find themselves denied recourse that would otherwise be theirs. The resulting anger and sense of hopelessness should not have been added to their grief. I have also found that these circumstances are adding to people's disaffection with their government. There has been increasing evidence of the government's failure over many years to recognize and respond evidence of terrorist threats. With the government-mandated compensation system failing to adequately address the needs of so many, people are quick to assign responsibility to the government for the tragedy itself, as well as its economic consequences. Again, whether this view is entirely supportable is not the issue; the fact is that these feelings are widespread and, while perhaps not foreseeable at the time the legislation was enacted, should be addressed in the only meaningful way available, which is to remedy the defects in the compensation plan. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. My main concern is when families review the chart to see the "award" then deduct "collateral" sources, it leaves nothing for many of the families. Families who had life insurance & pension plans should not be "punished" by the fund. A court of law would never deduct life insurance & pensions from any settlements, so the fund shouldn't either! I suggest that you go back to congress & have them amend the law to deduct collateral sources from the awards. I also suggest that you set up a guaranteed minimum for all families who will receive nothing after deducting collateral sources. I calculated my families award, then deducted life insurance & pensions and it left my family with ZERO. As a result, I am getting the paperwork ready to file a lawsuit against the airlines. This is a prime example of the aggravation that the fund has caused my family. Either we accept ZERO from the fund or file a very winnable lawsuit against the airlines. Unless the law to deduct collateral sources is amended, I feel that many families will also file lawsuits. Isn't this what you were trying to stop in the first place? Thursday, December 13, 2001 6:32 AM Fair Treatment for all Victim Families Sir, The attack on the World Trade Center and Pentagon on September 11th was an attack on the United States. The attackers didn't disciminate in choosing their victims. The victim compensation for those affected by the attacks should also be non-discriminatory. It is with great distress that I've learned that the families of gay and lesbian citizens are being threatened with exclusion from compensation by certain politicians and their constituencies. Speaking as a veteran and businessperson I find the exclusion of any victim or their families and loved ones, whether for sexual orientation or any other reason, to be nearly as reprehensible as the attacks themselves. The threat of exclusion finds its source in the same festering hatred that bred the fundamentalist extremism underlying the attack. When considering this issue I hope that the Justice Department will commend to itself the final four words of the Pledge of Allegiance taken by all Americans, "and justice for all". Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. The hypocrisy inherent in such a proposition--that only heterosexual relatives and partners of the dead are worthy of compensation--is an outrage. Regardless of states' laws, all families and partners of the victims of 9/11 should be compensated equally. To exclude gays and lesbians while including illegal immigrants is morally reprehensible. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these horrific attacks. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
