I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. This decision is to deny the same compensation from the 911 fund to these partners and at the same time allowing funds to be paid to unborn fetuses and also illegal aliens. To Whom It may concern I was very very disappointed when I saw Kenneth Feinberg, the head of the September 11 Victim's Compensation Fund on meet the press this Sunday, when he announced that State Law would prevail when it comes to inclusion in the payout pool, of domestic partners of Gay's killed in the 9/11 attacks. In effect since most state's have not stepped up to the plate to change their laws YET, the only group not included in the pool will be gays. I understand the complexities of trying to discern a legitmate claim from a false one, but every effort should be made to include true domestic partners of Gays, and "Heterosexuals" in the fund. The sorrow felt by those who lost a loved one, can only be made a thousand times more painful, when their country denies them the ability to participate in the pool of compensation that this country has almost too generously set aside for these victims. I am in total disagreement with the fact that you are not going to give a settlement amount before signing the settlement agreement and giving up our rights to sue. My Mother was dependant on my brother constantly. She was not only dependant on him financially, but she also depended on him to pour a glass of water, open the window, make the bed, etc. She is handicapped and has severe arthritis. I do not believe either that the life insurance that my brother paid for yearly should be deducted from the settlement amount. As I was reading the article, I was appalled that after all that has happened, we as Americans are still excluding gays and lesbians. I guess it is going to take longer to accept gays and lesbians, just as it took so long for African Americans to be accepted. I thought this was the land of the free, but apparently it is not. I used to be a proud American, but now I am almost ashamed to be one. Why is it that an illeagal alien will be able to receive monies, but someone who is an American will not? As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. By all partners of Americans I mean -- without concern for race, sexual orientation, religion or any other variable in which people tend to be divided.
