Of course this has significant implications for same-sex partners, but it is not limited to them. As you contemplate the final regulations, I have both a question and a comment My question is, under the interim regulations, how do you interpret the position of the same-sex partner in a committed couple who applies for compensation for a victim who died intestate, having lost the person to whom he or she was emotionally committed, and with whom he or she shared a residence and whose finances were intermingled? In fact, the questions has two parts: A. What is the legal situation of such an individual if no blood relative of the deceased objects the claim made by the made by the surviving domestic partner? B. What is the status of the surviving claimant if a blood relative does object? I note that the interim regulations, you say this to be governed by state law. I repeat what I have said to you previously, namely that I do not find anything in the governing, legislation which mandates such a decision. That is, Congress clearly did not require you to follow state law, and we are dealing with a federal statute, under the usual workings of the supremacy clause of the U.S. Constitution. Beyond that, while I do not believe that state law should be binding in this regard, if you persist in this position, a question does then arise as to how you interpret state law. It does not seem to me that there would be state laws exactly in point. That is, we are dealing here not with the ordinary rules of inheritance, etc., but with a specific act providing compensation for the survivors of those murdered in this way. Thus, it does seem to me that if you are determined to look to state law as governing in this manner, it should be state law very broadly conceived. Indeed, perhaps a more appropriate phase would be "state public policy". As you know, Governor Pataki of New York has decided under his authority, pursuant to the New York State Constitution and state laws, that the New York State victims compensation fund will be administered in a way that recognizes the claims of domestic partners to compensate the victims of September 11. Is this not the best possible analog to the situation addressed by the federal law, and if it is, should not the federal law then be administered in a way that is fully compliant with Governor Pataki's Executive Order? Thus, to summarize my view, I continue to believe that there is no requirement that state law be followed, but if in fact you are determined to follow such a policy, state law ought to be broadly conceived, and certainly in those states where the legitimate claims of domestic partners are recognized in similar circumstances, the federal government should follow suit. Obviously this would apply even in those cases where other relatives might to seek to interpose objections, because the state policy clearly supports the claim of the surviving partner. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Please consider these observations. a.. The use of a 'grid' for calculating compensatory damages is useful to the process only if it's well understood and publicized. Victim's families will then have a minimun dollar amount they can weigh in their own considerations of options to file suit. In many cases families might be able to reach sound decisions using volunteer resources including family attorneys and accountants without consulting litigators who often have larger agendas. b.. At the same time, 'pain and suffereing' components of a compensation package will vary dramatically from family to family (or claimant to claimant) and should be treated individually. While I see inherent problems associated with the varying perceptions of individual judges/arbiters when faced with different qualities of presentations, close communication between judges and some sort of internal and automatic appeal step might help this part of the process succeed. c.. I have to agree with arguments against subtracting life insurance payments and other charitable support received from compensation packages. I understand the compensation program has two goals: (1) to provide an alternative to protracted litigation that would bankrupt a dozen companies, and (2) to make victims' families whole in terms of projected income. If insurance and relief payments are substracted the gulf between the two alternatives, litigation or application, widens. a.. Some people will turn down needed relief to the short-term detriment of their children. b.. It would suggest that the purchase of life insurance is essentially meaningless as an investment. c.. It puts the warm generosity of the American people on the same footing as cold-blooded taxation, since in essence, any relief accepted is simply subsidizing the financial responsibility already accepted by Congress. Of the other victim's families with whom I've been in contact, most want to clear the decks quickly and get on with our lives. However we have important, long-term obligations to our children. Let's find a way to make this work in an open and fair way that will bring closure to everyone. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. The U.S. has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you think about the rules you are making for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
