Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking beyond the financial aspect to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. I am told you have mediated past disputes related to Agent Orange and asbestos injuries, and that you have a reputation for being fair and thorough. Mr. Feinberg, we need these very qualities now more than ever. Please make sure that the billions of dollars of our money are wisely spent, and not simply a reaction to possible lawsuits and political maneuvers. Thank you for considering my comments. On Tuesday September 11, 2001, my brother, of , and 342 of New York's Bravest gave their lives to save over 25,000 innocent civilians. Now the government is telling my family that they will not revive any federal money because of other benefits my family may receive. I don't believe the government can put a price on anybodies life in some formula that was created to bail out the airlines. No amount of money will bring any of these innocent people back, but to say, sorry, you already received enough money due to insurance, pension, or some other reason is absurd. If we were to sue in court, I believe we would be awarded a very large some of money for pain and suffering alone. Perhaps it would take years to collect, but a jury would not take into account any other compensation already received. If the airlines were under insured, that is their problem. If I was involved in a major car accident and I was underinsured, I'm sure my salary would be garnished until the settlement was fulfilled. Please reconsider the rules and distribute the money in a more just manner. My brother was only a firefighter, but was scheduled to take a promotional exam in October of 2001. He had been studying for over 3 years, and would have done well. Your formula does not take into account any future promotions. Monday, March 18, 2002 12:42 PM Discrimination in Compensation Funding The passing of the buck to individual states in the matter of denying compensation to same-sex longtime companions and survivors of gays/lesbians who died in the attacks on 9/11 is nearly as unAmerican as the attacks themselves. That states may individually uphold discriminatory policies {or legislate new ones to get around policies determined on a national level that just don't "agree with community standards", to wit: the editing of hate-crimes legislation in over ten states to remove the categories of sexual orientation} is something we have to live with. But to take the position that the decedent's 'state of origin' shall decide if survivors and significant others are not entitled when on a national level violations of immigration laws are being winked at is offensive. Gays and lesbians died in the attacks, too. Or lost loved ones. In the days following 9/11, gay dollars doubtless swelled donations for this fund and others. The redemptive aspect of the horror of 9/11 is that for a time, people came together in unity and put aside barriers -- people reached out to one another openly and with great generosity of spirit. To potentially deny the same compensation to gays and lesbians [who certainly number amongst the dead of 9/11 -- and among its list of heroes] is certainly an affront. Certainly to the loved ones of &nbsp -- &nbsp of US AIR flight 77, &nbsp -- &nbsp who died while administering the sacraments to NYFD firefighters at Ground Zero, and &nbsp -- one of the heroes of Flight 93. Our gay and lesbian tax dollars are certainly acceptable enough to the country as a source of income, but we consistently are ineligible for the very things taxes are levied to achieve. I realize that the 9/11 fund is not a tax issue, but the principle obtains. To publicly acknowledge the grief of survivors is a tremendous and admirable thing. To publicly acknowledge the grief of some -- and to bend the law in the case of illegal aliens so they too will be compensated -- with monies from the Fund becomes a little suspect. To publicly declare invalid the grief and loss of gays and lesbians -- unworthy of participation in the 9/11 Fund compensations because most states in the country don't consider their relationships real or valid -- this is shameful. DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Friday, January 18, 2002 1:29 PM Interim Final Regulations Attachment 1: January 17, 2001 Dear President Bush, My Husband, &nbsp was murdered along with his &nbsp co-workers on the September 11, 2001 terrorist attacks on the World Trade Center. The interim final regulations written by the Dept. of Justice have not followed the intent of the Congress when they passed and the President signed the "September 11 Victim Compensation Fund of 2001" into law as Title IV of Public Law 107-42 ("Air Transportation Safety and System Stabilization Act"). Congress set up the fund to ensure that the airline bailout would not come at the expense of the victims families. The act mandates full and fair compensation to victims and their families for their actual economic and non-economic damages. DOJ has ignored this mandate and instead has written arbitrary regulations that will result in compensation levels far below the losses actually suffered by the victims and their families. In fact, many families total compensation from the fund and all collateral sources combined will not even fully replace lost income. In effect, these families will not receive any of the non-economic compensation required by the statute. After collateral sources are deducted, as required by the regulation, some families would receive nothing from the fund under the interim final regulations. DOJs formula allows for non-economic awards at only one-tenth the level paid in comparable cases, even though Congress explicitly enumerated a broader range on non-economic damages than could be recovered in any single jurisdiction. DOJs formula for non-economic damages is $250,000 for the person killed and $50,000 for the spouse and each dependent, In a wide variety of air crash and terrorism cases, judges, juries and mediators commonly have provided non-economic damage awards well into the seven-figure range. My children have to go through the rest of their life without the man that was helping to shape them into productive, honest citizens of this country. Hes no longer here to laugh and play with them, swim and vacation with them, be their soccer and softball coach. Is their pain only worth $50,000? The method that DOJ used to calculate economic damages has serious flaws also. Using outdated and inapplicable work life and life-cycle earnings data and data that tracks federal worker incomes and doesnt take into consideration the higher paying private sector career paths followed by the vast majority of the victims is just plain wrong. These employees were of above average intelligence and productivity and the calculations should reflect this. These points have been brought to your attention on several occasions by economists, attorneys and Howard Lutnik of Cantor Fitzgerald. These employees are part of the reason why America has enjoyed the prosperity we do and these calculations should reflect this. I implore you to rewrite these regulations in accordance with the original intent of Congress and the President. Please dont victimize us again. My children and I have suffered so much more than you can ever imagine at the hands of terrorists and a government that didnt fully require preventative safety and security measures of our airlines. What occurred on that day was a horror of unimaginable proportions. Therefore, we must all make the greatest of efforts to help those most affected by this tragedy. And those who are most affected are not just the husbands, wives, mothers and fathers of those lost. The parters of gay and lesbian individuals killed on Sept. 11th are just as victimized as anyone else. They built lives together, shared dreams together, and planned a future together. I urge that the regulations you promulgate and your administration of the fund ensure that all victims receive full compensation for their losses without regard to their sexual orientation. Just as those who died in the World Trade Center spanned all races, creeds, and colors, the tragedy touched lesbian and gay families as well as heterosexual families. One of the heroes of the September 11 on board United Flight 93, , was a gay man. Many of the lesbian and gay victims are survived by longtime partners. lost his partner of 17 years, , a project analyst at with whom he shared a Yonkers home. lost her partner , an assistant Vice President for accounting at on the floor of One World Trade. Their stories, and the stories of the other gay and lesbian victims of this tragedy, are as compelling as any others'. The need for support and recompense is no less real for these survivors than it is for the countless other relatives who lost loved ones. America has reached out with enormous generosity to all of the victims because our common humanity recognizes that grief and loss are not reserved to any single culture or group - they are borne by each and every one of us, whatever our race, religion, or sexual orientation. The laudable purpose of the September 11th Fund is set forth clearly in the Act: to provide compensation for the losses of those who died and those who were injured. It is crucial for the many deserving families that the regulations implementing this Section permit recovery for all deserving relatives, including the committed partners of gay and lesbian victims of the terror attacks. For those whose family relationships do not meet certain strict formal legal definitions, such as same-sex partners and non-biological children of victims, the enormity of the loss of a beloved companion and parent could be compounded by the prospect of ineligibility for compensation intended for their protection. The Department of Justice should not permit this potential inequity. I urge you to include among relatives eligible for compensation those who lost their life partners or non-biological parents, regardless of sexual orientation and marital status. Just a few days ago, Governor Pataki issued an Executive Order granting surviving same- sex partners of the World Trade Center attacks comparable benefits to those received by surviving spouses from the state's Crime Victim Board. (The Board, I note, receives a large portion of its compensation funds form the Department of Justice's Office for Victims of Crime.) In many other areas, New York state and local laws recognize that an array of people come together to form families that are emotionally and financially interdependent, and the law has been taking affirmative steps to protect those who face peril when a family member perishes. These court rulings, laws, and executive orders deserve special consideration and carry special weight because the vast majority of the victims of the September 11 attacks were killed in New York, and New York law would normally apply in compensation litigation. Our nation has come together in this time of tragedy to lend its unqualified support to all the innocent victims of the attacks. We must stand united to fulfill our moral obligation to all those harmed by this tragedy. I therefore believe that all same-sex partners and non-biological children be eligible to serve as proper representatives for claims related to individuals who died as a result of the September 11th attacks. I further encourage you to treat non-economic damages, such as loss of companionship and loss of consortium, identically for those victims who were in heterosexual and homosexual relationships. Ensuring that same-sex partners and the non-biological children of victims receive compensation permits the federal fund to be distributed with basic equality and fairness to all those in need. And it upholds the fundamental values of liberty and equality cherished by all Americans, values that we are all fighting to defend as we wage war on those who are bent on undermining our freedom. Tuesday, December 18, 2001 8:03 AM Protect Traditional Marriage Mr. Kenneth Zwick Office of Management Programs Department of Justice Washington, DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner."
