As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Wednesday, March 27, 2002 5:19 PM discrimination against gays and lesbians I am responding the the news that money collected for the victims of September 11th will be distributed differently to survivors of gay and lesbian victims than to other victims. I have read the reasoning of Kenneth Feinberg that because state law does not recognize gay and lesbian partnerships, they in turn cannot distribute support. At one time in this country slavery was legal and no one went against that law: a law that we now consider barbaric and inhuman. This exclusion of gays and lesbians; this segregation of humanity is hurting America. It justifies violence against not only those who are out, but those who are even perceived as gay/lesbian. The excuse that he has proposed is bigoted and shows no concern for the wellbeing of ALL Americans who suffered because of those attacks. I am outraged that in this year 2002 I still feel as if I need to prove that I am a human being, entitled to what is written in the constitution as an American. Searching for reasons to exclude people from the 911 fund means that we are on our way to becoming our own facist state where people who are good citizens but who don't comply with the "Moral Majority" are penalized. I read that in an appearance on the Sunday, March 10 broadcast of NBC's "Meet the Press," Kenneth Feinberg, said that gay partners of the heroes of September 11th will not necessarily be eligible for the same compensation as heterosexual family members who lost loved ones they depended on. In this release I also read 'even illegal aliens, who aren't American citizens and who are in the US in violation of federal law, will receive benefits'. How can this POSSIBLY be true?? Are illegal aliens are granted a higher status than law abiding Americans?? How is it possible that you deny a person who lost loved ones on the 9/11 World Trade Center attacks that he/she depended on? How is it possible that you deny benefiting a family they leave behind simply because they are different? My recommendations are threefold: 1.) Utilize the methodology established but eliminate the cap, i.e. using the 98th percentile. On December 17th before some 1200 victims' families, the Special Master indicated with clarity and emphasis that there would be "no cap." A few days later the Interim Final Rule was issued that a) clearly indicated a "defacto" cap by adopting a 98 percentile ceiling. This is totally inappropriate because out of approximately 3000 victims there will be some 300-400 victims who earned six figures and dozens who earned a seven figure salary. Note well that while money is being expended from public funds, these same individuals have been paying significant income taxes over the years and have been creating jobs because of their production as well as buying goods and services providing for additional jobs. A jury in a court of Law would reward the families substantial awards because of such earning capacity. What is most disturbing is the Special Master's comments that an award of over $3,000,000 would be extraordinary. This gives the families an impression that is a contradiction. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Reg. 55,901 (November 5, 2001) Dear Mr. Wick: This letter is in response to the Department of Justice's Notice of Inquiry and Advance Notice of Rulemaking (66 Fed. Reg. 55,901 (Nov. 5, 2001)) (the "Notice"), seeking public comment on the development and implementation of a program to provide compensation to victims of the September 11, 2001, terrorist attacks. is a leader in providing accounting, assurance, and information technology services around the globe, with 84,000 employees based in 130 countries. Of particular relevance to the Victim Compensation Fund, performs accounting, internal audit, claims compliance audits, and tax services for several large class action settlement funds across the country. Our comments are directed to the proposed claims process, eligibility requirements, and compensation determination methodologies. Claims Process As outlined in the Notice, the Air Transportation Safety and System Stabilization Act (the "Act") requires the Special Master to make a final determination on any claim within 120 days of its receipt, and, if an award is made, to authorize payment within 20 days thereafter. To comply with the time frame established in the Act, the Special Master may want to establish a process that expedites claims adjudication, allowing, in certain cases, for claims to be decided on the basis of a paper record (the claim form and other written evidence), without the need for a hearing. If this is the case, claims forms must be designed to provide all of the information that is needed to adjudicate the claim and to determine an award. At the same time, it must be easy for the claimant to understand and follow. To accomplish this, the individuals designing the claims process must coordinate with those designing the forms from day one. It has been our experience that such an integrated approach, in which process and form designers work in tandem, accelerates implementation and avoids potentially confusing, misleading and disjointed claims procedures and forms. Eligibility Requirements Given the large sums of money to be disbursed by the federal government as a result of the Act, there exists a high likelihood of individuals claiming rewards based on false or fraudulent information. One's presence at the World Trade Center, the Pentagon, or Shanksville, PA "at the time, or in the immediate aftermath" of the terrorist attacks may be very difficult to prove or disprove. Additionally, any regulations should clearly define terms such as "physical harm," "at the World Trade Center," and "in the immediate aftermath," to name a few. To deter bad actors, the claims forms should clearly communicate that the Justice Department will prosecute individuals who submit fraudulent claims, and require a statement, signed by the claimant or his representative, stating that all of the information being submitted is factual to the best of his or her belief and knowledge. Furthermore, provisions should be made, under the supervision of the Special Master, to verify information contained on the forms. Procedures should be designed that are both comprehensive and sensitive to the claimant, and allow for random auditing of claims, with special emphasis placed on exceptionally large awards. Finally, potential claimants should be advised that their forms might be selected for audit. Nature and Amount of Compensation Section 405(b) of the Act indicates that the Special Master shall determine the amount of compensation based on "the harm to the claimant, the facts of the claim, and the individual circumstances of the claimant." As the Notice suggests, this will be difficult to accomplish in a detailed, consistent fashion given the potentially large number of claimants and the short 120-day period in which determinations must be made. We believe that a fair and consistent methodology for determining compensation can be developed using statistical and actuarial techniques. Matrices set up to determine compensation based on the information provided in the claims forms would serve many purposes, including: treating each claimant consistently within the guidelines as determined by the Special Master, reducing the emotional subjectivity that could arise by providing a framework for fairness, and expediting the process in light of the time constraints established by Congress. Several large class action suits have used this methodology very successfully in determining claimant awards. Publication of such matrices would further assist potential claimants in determining whether to apply for compensation from the Fund. Use of a matrix system for determining compensation would not unduly limit the Special Master's flexibility. Even with such matrices, hearing officers would need to weigh individual factors when making a compensation determination. Moreover, after notifying a claimant of an initial determination, a claimant could request a hearing to present additional information. We appreciate the opportunity to submit these comments.
