I am outraged that gay and lesbian partners of those who died on September 11 are not automatically going to receive the same benefits as heterosexual spouses. Even fetuses and illegal aliens will be receiving benefits under this problem. But when it comes to gay and lesbian heroes of the day - &nbsp who helped bring down the flight in Pennsylvania, &nbsp who died in the line of duty when the first tower fell, and &nbsp who was &nbsp of the plane that crashed into the &nbsp (there are many more) - we are told the law is the law and no exceptions can be made. If September 11 has taught us anything, it is that our patriotism and love of country transcend our differences and unite us all. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Tuesday, November 06, 2001 3:53 PM Victims Funds This is a subject that I believe I can address with some sense of experience. In the months following the bombing of the Murrah Federal Building in Oklahoma City I served as of the Junior League of Oklahoma City. The Jr. League, along with many other agencies received a tremendous amount of money which was donated to us to ultimately benefit the victims' families and survivors of the Murrah Building bombing. We attended meetings with other agencies' representatives to allocate our donated funds. Each FEMA case was presented and we would "ante" up "X" number of dollars for each case. $2,000 toward the purchase of a van for a victim who lost a leg in the bombing, $50 to purchase clothing for 2 children to wear to their parents funerals, etc. It was very obvious to us what expenses should be covered and what expenses should not. We paid for a lot of home renovations to accommodate handicapped victims. We paid for a lot of funeral expenses and medical expenses. We did not pay for everything that was requested. We did not pay for new televisions or in one case an automatic lawn sprinkler system. I would think the September 11th tragedy is too large in scale for any group of people to sit in a room and hear all the FEMA cases presented one at a time. There might, however, be just such a group of people organized to work in that manner. I would guess that everyone affected by the tragedies on September 11 would have received a FEMA number. In any event, I feel from my experience with the OKC bombing donations and the conversations I have heard in my office since September 11th, leads me to believe that no one wants the victims or their families to become wealthy because of this tragedy. I have donated money to two different September 11 funds. My intention and the feeling of everyone I have talked to is to be sure the families are assured that they have medical expenses covered, burial expenses covered, current physcial needs met; wheel chairs, ramps, vans, etc. and future education expenses met. Additionally, we should pay for counseling expenses not covered by health insurance for a number of years. At the same time, we have no interest in buying larger, upgraded color tvs for anyone. I would strongly support a decision to reduce the payments from the unlimited fund to victims' families by the amount of charitable donations they received. The government's balance sheet is ALSO partially my money - my money sent to the government in the form of taxes. This is a question of wise money management. Period. It should not be politicized as it appears to have become. Additionally, there is a tremendous concern for the children that are now orphans due to losing both parents or perhaps being the child of a single parent and losing that only parent. I can understand that concern too as I am a single parent. I adopted my daughter in China last year. We need to spend as much money as necessary to adequately staff a group to disperse these funds. Please do not let this become a political issue that is decided by the loudest voices. The loudest voices may not speak with the greatest wisdom. I strongly urge the Department to draft regulations that ensure compensation is available to all victims of the attack, including the committed partners (which can likely be proven by the performance of a variety of ?commitment ceremonies? that are not currently recognized by law, but likely one day will be) of gay and lesbian victims. It is unquestionable that the devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Friday, November 30, 2001 4:48 PM Comments Dear Attorney General Ashcroft: My brother &nbsp&nbsp&nbsp was killed in the word trade center attack. At the time of his death &nbsp&nbsp&nbsp was engaged to be married to a wonderful woman. In dealing with the various charities and victim assistance organizations since this horrific event I have found that there is very little assistance available for my brother's fiance. We were told by the Red Cross and the NYS Victims' Assistance Bureau that if &nbsp&nbsp&nbsp and his fiance had made the decision to live together prior to marriage then she could make a claim for loss of support. However, since they chose to live separately prior to their wedding date, she is not entitled to assistance. &nbsp&nbsp&nbsp fiance has suffered a horrendous loss and indeed her future has changed forever. Her life will never be the same. Unlike the widow of a victim, however, she has no standing to claim anything. That is simply not fair, and I hope this injustice is not continued with this victim fund. It is my strongly held view that the lives of those victims who are unmarried should not be treated as though they are worth less than those who were married. My parents, siblings and my brother's fiance have had our hearts ripped from us and stomped on by these events. Please do not make matters worse by enacting rules and regulations that make &nbsp&nbsp&nbsp life worth less than those who were further along in their life plan. To us, we not only lost my dear brother, but we lost all of his future progeny. Although &nbsp&nbsp&nbsp loved children greatly and planned to have several, due to these horrible events he has no descendants that will carry on his legacy. This loss will always be with us. My brother's fiance should be entitled to loss of consortium and his parents and siblings should be entitled to damage for loss of love and affection. In addition &nbsp&nbsp&nbsp lost wages should be recoverable even though he was not currently actively supporting individuals. His future wages certainly would have been used to do just that. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. The reasoning that their relationships are not legally recognized is pure and simple discrimination against gay Americans, because we are not afforded the right to marry. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Thursday, March 14, 2002 4:24 PM 9/11 Fund to Discriminate Against Gays Reading the article "9/11 Fund to Discriminate Against Gays" by at About.com, (http://uspolitics.about.com/library/weekly/aa031102a.htm), left me shocked, upset and angry that an opportunity to respond with a gesture of goodwill and charity to all the unfortunate victims of the 9/11 tragedy and their survivors was consciously lost by the administrators of the 9/11 fund. By denying domestic partners of gay and lesbian victims of the 9/11 tragedy an equivalent distribution of the charitable funds given for all victims, the September 11th Victims Compensation Fund and the Department of Justice sullies and denies their profoundly meaningful acts of courage, bravery and altruism. I'll be certain that all my friends and acquaintances, regardless of sexual orientation, know about this most recent act of cowardice and do all that is possible to inform their Congressional representatives to bring what collective voting and funding power we have to bear upon changing this misguided and ultimately immoral policy decision.
