Many gay and lesbians died in the terror attacks. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, January 23, 2002 9:37 PM (no subject) I am a member of the Families of September 11, and we represent a large group of fiancées/domestic partners. Since this fund was legislated federally and is distributing federal funds we feel we should be treated equally as spouses (since we all had set wedding dates and our fiancées had already asked us to be their wives/husbands). When this fund was set up by congressional legislation last September it was to compensate not only for earnings and pain/suffering (which we are the only ones who suffered a financial loss), but also for 'loss of companionship", "loss of domestic service" etc. This should apply to us as fiancées /domestic partners as well. We are concerned with the exclusive effect of this proposal. It appears, however, to have been the intention of the Act to limit compensation to "relatives." If this is construed to mean relatives at law, many deserving individuals with close relationships in fact (i.e., co-habiting partners, survivors of engaged couples, step-children, etc.) who are injured survivors will be excluded. The regulations should more broadly define "relative" to include de facto relatives. If we are not taken into account then the money will solely be awarded to the parents of the victim, who were not affected financially. You cannot expect that the parents will "do-the-right-thing" and share the award with their son's/daughter's fiancée/domestic partner. We have already seen many cases where people have already not taken the "morally correct" approach. We need to be recognized because our partners/fiancées had promised to take care of us forever, just as a spouse. A spouse is the first recipient of the fund, and a fiancée/domestic partner should receive the identical rights of a spouse and not be punished because they were cheated out of their wedding. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Can't begin to tell you how frustrating this all becomes when you're trying so hard to move on with your life. Initially submitted a claim in December and resubmitted in February 2002 after being advised by &nbsp that my claim was incomplete. Never received any notification thereafter and have never been issued a claim number. As I look over this new paperwork, I quickly see that I am now required to request information from the IRS concerning my son's previous year's tax returns, obtain information concerning his previous employers' address/phone number, etc., attach documentation for such things as Death Gratuity Payments, Burial Costs, end of year pay statements, etc. In short, I have just printed 33 pages of instructions and forms related to what was once a relatively simple claim process. My son was a 23 year old &nbsp in the United States Navy at the time of his death. He had been in the Navy since January 1999. He always filed his taxes via the telephone, using TELETAX and never kept any types of records. He was simply a carefree, hard working, fun loving young man who had no reason to keep any such records. He had a $250,000 government life insurance policy (SGLI) that he made payable in equal shares to his younger sister and his step brother who is presently a sophomore at . For me to adequately complete your new forms is entirely too cumbersome. I ask you to try to imagine accurately obtaining information concerning subsistence allowances, bonus information, SGLI Premiums he paid, etc. I have coordinated this claim with your office for the past three months and no one has so much as issued me a claim number or advised me as to whether my claim is now complete and accurate. I no longer desire to pursue this issue as I now intend to simply turn everything over to an Attorney and have him pursue legal action. I am confident that I can simply grant him a Power of Attorney to gather information on my behalf, alleviating me of such burdens. Sunday, January 13, 2002 1:56 PM Salaries One of my largest concerns about the victim compensation fund is the determination of income. I was fortunate to receive my husband's salary for the entire year of 2001. Consequently this was also my husbands largest salary to date. I feel that 2001 salaries should be considered if there is a way to determine what the total compensation would have been. My husband had taken on many additional responsibilities within his company and was fully compensated with his 2001 salary. Considering my husband would have continued to receive this salary in addition to annual increases, I feel that the income for 2001 should be considered. The second issue I have regarding the victim compensation, is in reference to the reduction of the award by the amount of life insurance your spouse may have had. I do not feel that my family should be penialized because my husband decided to purchase life insurance. It seems to me that the way the program is set up, only familes who do not have life insurance stand to benefit from the compensation program. If this is the case, I feel maybe the program should be changed to distribute equal shares of the compensation to the families without any salary considerations and deductions. People die EVERY day and their families don't become instant millionaires at the expense of the American taxpayer! I have no sympathy for the widows, with their $5000 a month mortgages, two BMWs in the garage, private school tuitions and stay at home moms... where is their life insurance? If the husband died in a car accident or even in his sleep - how were they planning on paying the bills then? Charity is great for those who need it, but it shouldn't be used to make families rich. Americans gave generously to charities expecting to help families with immediate expenses, not to make instant millionaires. Also, the government should not use taxpayer's money to fund the bank accounts of victim's families. If anything, pay for a few months expenses, and then expect the families do what they would do if their bread-winner died any other way, get on with it. Get a job and get on with life. Our country and all Americans have survived many, many needless deaths and tragedies without victim's families "winning the lottery". God help us all. As an attorney with offices just five blocks from the WTC site, I have offered pro bono advice to some of those who have lost loved ones in the terrorist attack. I hope that you take my comments in the spirit in which they are offered. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already better off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are specially vulnerable when one partner is killed. Because the option of arriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. His wife shared that honor for the last six years. Now we all have the equal horror of grieving for a wonderful and respectful young man who was killed through no fault of his own, but because he went to work the morning of September 11 on the floor of the North Building of the World Trade Center. What we do not have is equal recognition under the law for the loss that we all equally have. My wife, gave birth to him. We both raised him by providing all the guidance, friendship, substance and mostly love that a child could possibly need and want. After he married, we continued to speak to him several times a week and see both our son and daughter-in-law frequently. His older sister, , was one of his best friends. In recent years they lived over one hundred miles apart, but were always together in their hearts. They spoke to each other a few times a week. We thank you for the opportunity to comment today on the Interim Final Rule. Our comments are as follows: 1 The Regulations and Guidance Should Clearly State that Parents Whose Children Were Killed on September 11th Are Presumed to be Eligible for Distribution of all Compensation Awards. Our grief for our son is as great as that of anyone's and what we ask is that this fact be recognized under the law. Our lives have turned into a living hell and we must receive equal compensation for this insurmountable loss and unending pain and suffering that we are struggling to endure. New York State law recognizes that parents are to share in the distribution of any damages awarded in a wrongful death action. Under EPTL Section 5-4.4, parents of children without children of their own are specifically named distributes, even if they are not recognized by the state as beneficiaries of the estate. The final regulations and guidance to be issued under the September 11th Victim Compensation Fund of 2001 should clearly state the same. To do otherwise will create undo confusion and pain on the part of families who have already lost far too much. If the goal of the September 11th Fund is to prevent families from feeling that their only option is to sue, The Fund should clearly provide that other options exist and that compensation to all Family members, not just spouses will result. Ambiguity and vagueness is not helpful in this case, but is instead counterproductive for both the families and the government. To neglect to provided the clarity requested here will result in excessive pain and suffering clearly not envisioned when Congress passed Title IV (Victim Compensation) of the Air Transportation Safety and System Stabilization Act (the"Act"). Finally, the regulations wisely anticipate that disputes among family members may ensue. As Special Master to the Fund, you have a unique opportunity to minimize the number of such disputes by providing as much clarity as possible up front so there are as few disputes as possible within the families over the law's intent. This is an incredibly difficult time for the thousand of families effected by the horrific events of September 11th. We urge you not to add to this difficulty by creating conflicting opinions over the intent of your own words and actions. 2 To Deduct Life Insurance and Pension Payments From the Compensation Awards is Counter To Public Policy and is Grossly Unfair to Families Whose Loved Ones Took Responsible Steps to Plan For Their Families' Futures It is not equitable that insurance and pensions be deducted from the total compensation. Simply because some of the victims had the foresight to provide for their families should not be held against them. This is why in most civil litigation life insurance is not deducted from damage awards. Nor should the fact that some had pensions be held against them. If you want to deduct the pensions that they earned, then the total of the pensions should be included in the gross compensation as part of their earning power over their expected term of employment. The liability for wrongful death should be measure by total potential earnings and pain and suffering to both the victims and their families. Should the regulations not be able to be modified due to the language of the Act itself requiring that compensation must be reduced by collateral sources (Section 405 (b)(6), perhaps an alternative would be to reduce the compensation by a percentage of the total amount of the collateral sources. Nothing in the Act Specifies that the reduction must be dollar for dollar. 3 The Claim Form Should Include a Provision Requiring Disclosure of, and to, all Living Immediate Family Members In Order to Ensure a Knowing and Effective Waiver of Suit is made. We are all at a significant disadvantage in that no claim form was provided in the Interim Final Rule to review. Thus, in the absence of such a draft form, one can only speculate what will be asked of the personal representative when making a claim. At minimum, the form should require the personal representative to disclose the names, addresses, and phone numbers of all living immediate family members. For the purpose of this regulation, immediate family members should be defined to include spouses, children, parents and siblings. In addition, the regulations should also require that effective notice of the filing of a claim (within a reasonable period of time) be given to all such relatives giving them the opportunity to opt in or out. To do otherwise would unfairly affect other relative's rights to sue by risking an unknowing waiver of the right to sue. No one should be bound by the actions of others of which they were not made aware. 4 A clear definition of "dependent" as used in the section "presumed non-economic loss" should be given. At a recent meeting attended y Special Master Feinberg the definition of dependent was given to be not limited to that used by the Internal Revenue Service, but intended to include the relatives to who support was or was intended to be given by the victims. In our case this should include the support given to my wife when she was ill with cancer and the support given to me when I had by-pass surgery. In both cases our son was there with us constantly, being of both physical and emotional help to us. Our daughter recently told us of a conversation that she had with our son, that if we would be in need of long-term care they would both contribute to it. These are but a few cases of what should be included in the definition of dependent. The people of this great country have put in your hands the means that will help us begin to shape our future. Zwik, Director Office of Management Programs U.S. Department of Justice, Civil Division Email: victimcom.comments@usdoj.gov November 16, 2001 Dear Mr. Zwik: As a relative of one of the victims of the September 11th terrorist Attacks, I trust that the regulations for the Victims Compensation Fund ("The Fund") can be fashioned in such a manner to bring equity and closure This most awful chapter in American history. Towards that end, the Fund must be structured to encourage victims' families to surrender their rights to sue because they believe they will be treated fairly and promptly. To send such a compelling message I respectfully submit that the regulations must contain following elements: 1. Do not reduce the award from any collateral source funds collected, including insurance, pension benefits, death benefits, and governmental payments (which we understand are being considered as offsets). Such offsets should be disallowed for, among other reasons, the same reason the IRS exempts life insurance proceeds from taxation (i.e., to encourage citizens to plan for their heirs). Such offsets would penalize those victims who sacrificed and saved for their families' futures and unjustly transfer these assets, thereby representing a lifetime of work, to insurance companies and other corporate entities that may share the blame for the consequences that resulted from the tragic events of 9/11. In a nutshell, these assets have nothing to do with the damages that flowed from 9/11, and therefore there should be no offset to damages based on the net worth of the victims' families. It would also result in awarding more in damages to those who did not sacrifice and save for their families' futures, which would be an inequitable result. 2. Provide the victims' families with the right to appeal the award, as doing so would undoubtedly increase participation in the Fund. 3. Should the Department of Justice decline to offer victims' families the right to appeal, then at a minimum they should have input regarding the selection of the mediator who would decide the award. The government should provide a list of potential mediators with their background (e.g., educational, work experience, prior award history, etc.), which would allow victims' families to make an informed choice. 4. There should be set parameters for calculating damages (i.e., mathematical formula factoring lost future earnings, pension benefits, number of children, and other pecuniary benefits that would have been earned taking into consideration life expectancy tables), that would provide a floor for calculating damages and provide assurance to victims' families as to what they could expect to receive, at a minimum, if they elected to opt into the Fund. I believe this has been referred to in the press as the development of a "grid." In short, the victims' families should be able to calculate, with some certainty, the minimum amount of money they could expect to be awarded prior to participating in the hearing. That should serve as a powerful inducement to opt into the Fund. 5. Determine pain and suffering at the hearing. 6. If the mediator deviates for the guidelines the victims' families should be able to appeal the decision. 7. The regulations should include a scheme that would afford the victims' families one that is similar to the one they would enjoy in a wrongful death case. The amount awarded, as damages should include all funeral, burial and estate administration expenses incurred. Importantly, the amount should compensate the victims' family for contributions they would have received between the time of his death and the end of this life expectancy, such as future lost wages. His gross earnings, including all fringe benefits between the date of his death and his life expectancy must be factored in. Additionally, all monies the victim would have spent for or given to his family for such items as shelter, food, clothing, medical car, education, entertainment, gifts and recreation, taking into account his salary and age must also be considered. The amount awarded should also consider the comfort and friendship that he would have given to his family had he lived and such other elements as work around the home and provision of society and comfort. 8. Since the amount awarded would be intended to restore the victim's family's loss, it should not be considered as "income." Therefore, it should not be taxable by the federal or state taxing authorities. In closing, I understand that the DOJ is suggesting that the victims' families surrender their right to sue without advising them what they can anticipate by way of award and without the ability to appeal such award. This is, to be kind, unacceptable. The above suggestions would encourage attorneys and families alike to opt into the Fund, thereby forgoing their right to sue. This would bring closure to an American Tragedy and reassure victims' families that our government has their best interests at heart. We only want to place them in the financial position they would have been in had their loved ones not been taken away in the worst terrorist attacks in American history which may have been avoided. But that is another story. Thank you. Thursday, December 20, 2001 12:54 AM Crisis Relief Benefits December 20, 2001 Dear Mr. Kenneth Zwick, I write as a member of Amnesty International, a worldwide human rights movement committed to ensuring respect for the basic human rights of people without discrimination, in support of equal access to benefits under the September 11 Victims Relief Fund for all victims, regardless of sexual orientation or marital status. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality.
