Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. My cousin almost lost his life in the Pentagon that day. The government is doing everything possible for him, but what if he had been homosexual? Would he and his life partner be shunned by the same government? Monday, March 18, 2002 6:18 PM Unfair Discrimination Against Gays/Lesbians for 9/11 Surviving Partners I have just read an on-line article at: http://uspolitics.about.com/library/weekly/aa031102a.htm that describes how gay and lesbian partners of survivors are being discriminated against. The article mentions that gay partners of the September 11th tragedy will not necessarily be eligble for the same compensation as heterosexual family members who lost their loved ones. The article further mentions that even illegal aliens will receive benefits! Do I understand correctly that the law is being relaxed for illegal aliens, but taken literally when it comes to persons that are gay or lesbian? If so, I want you to know that I think this is a second tragedy, perhaps worse than that of September 11th. Please let me know if this hypocrisy is real. I am a gay person living in California and have felt that I've been a second-class citizen all of my life (I'm now 46). Just as black persons were denied basic equal rights in recent history, so are gay persons today. It was wrong to discriminate against blacks then and it is wrong to discriminate against gays and lesbians today. And, giving benefits to illegal aliens proves that this isn't a legal matter. Benefits are being given to ILLEGAL residents, but are not being given to the surviving partners of gays and lesbians. This is inequitable and un-American. Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue, NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It is fair to say that this event had and will continue to have an effect on people for years to come. The terrorists were blind to the diversity among the people in the World Trade towers. They struck without regard to anything. The response of the world community and the American people has been without regard as well. I know of many of my friends who have given sacrificially to this cause. As an American citizen and a compassionate human being, I urge you to be equally as blind in the administration of this fund. ANYONE who was directly affected should be at liberty to apply for compensation, including those who lost their life partners as well as de facto parents or children, without regard to sexual orientation or marital status. Wednesday, March 13, 2002 1:13 PM the deep disgrace of the 9/11 Victims' Compensation Fund Mr. President: I am writing to voice my concern over the exclusion of same-sex partners from the 9/11 Victims' Compensation Fund. This horrible tragedy was unprecedented and affected people from all walks of American society. All the affected deserve our help. Few things in my life have angered and saddened me as much as the events of September 11th, but your administration's decision to compound the pain of those who have lost loved ones in the terrorist attacks by failing to provide them their just portion of the Victims' Compensation Fund has just re-opened that wound and driven my anger to new heights. I am a Republican, a deeply patriotic American, a committed free marketeer and a New Yorker who was downtown on September 11th, who lost colleagues in the attacks and whose apartment was filled for months with the smoke from Ground Zero. I fully expect to die an early death from lung cancer due to all the contaminants I have breathed in since September 11th. I am also proud to say I include among my friends and family a range of wonderful people who happen to be homosexual. The very IDEA that Kenneth Feinberg (Head of the 9/11 Victims' Compensation Fund) can go on TV and tell me that ILLEGAL ALIENS are going to be given taxpayer dollars for being in the wrong place at the right time, and in the same breath tell me that homosexuals (including , one of the heroes that brought down Flight 93 to prevent its crashing into the US Congress) are less-than-human in your administration's eyes is appalling. Your administration has recognized that a compassionate and effective response will entail making certain exceptions to general U.S.policy on eligibility for public benefits, such as making compensation available to undocumented aliens (and protecting their employers from prosecution should such individuals come forward). Please make sure that ALL affected families and households receive the assistance they need to cope with this terrorist attack, whether the household was counting on the income of a brother or sister, an opposite-sex but unmarried partner, a same-sex partner, or a friend. Fair rules can be devised for assisting all families and households who were directly affected by this terrorist attack. Please don't use this as an opportunity to cut out or further marginalize people whose loss and grief is no less real because they are not heterosexual. I have every confidence that you will make sure the right thing is done in this matter, Mr. President. These are difficult times in this country, and the last thing we need right now is for our President (and policy) to be influenced by a pack of disgusting bigots hell-bent on denying homosexual Americans their fair and unbiased share of all America has to offer.
