Wednesday, January 02, 2002 4:25 PM Interim Final Rules While I am not in a position to question the interpretation of the legal issues involved in the classification of certain items as collateral sources, I find it quite difficult to place a number on their magnitude. If for example, New York State Workmans Compensation and Social Security Survivor payments are to be deemed collateral sources, it appears virtually impossible to determine the amount of the offset. What life expentancy tables will be used?...IRS publication 939 values?...single life annuity tables?..something else. Even establishing the appropriate annuity factor, it brings into question why life expentency is a valid criteria. If for example the surviving spouse remarries, she would lose her benefit. The same situation is relevant for benefits received under Workmans Comp, as the surviving spouse , upon remarriage, would receive a lump sum of $50, 000 and no further benefits. Many similar difficulties are not addressed in the regs. For example, life insurance proceeds paid to a single individuals sibling would not be a collateral source if the deceased died intestate in NY because that sibling would not receive anything under the intestacy laws of NY. This presents the classic case of form over substance working at variance with the stated guidelines of the regulations to provide fairness and consistency. There is also the issue of the Workmans Compensation carrier attempting to recover a portion of payments made as well as future payments. In the case of NY, this could be as much as 2/3 of said present and future payments. Unless these and a myriad of other similar issues are clarified, the tables are rendered useless in approximating a potential award. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Monday, January 28, 2002 9:44 AM Comment on 9/11 Compensation Guidelines As a taxpayer, mother, wife of an active police patrol officer, a daughter, and a former bodily injury claims insurance adjuster, I believe the current plan for Victim's compensation is overly reasonable. From the standpoint of litigation against the airlines, this is reasonable compensation for the loss of immediate family members, and the US Government goes further to compensate for loss of adult children. This is more than can be hoped for in some accidental loss cases. However, this was no accident. This was an act of war. The civilians, firefighters, police officers, and others lost in this tragedy were casualties of war. What compensation have we given to casualties of war during WWI, WWII, the Korean War, and the Vietnam War? My husband quietly leaves our home at 6 a.m. on a work day. He is a police patrol officer. He protects the public. There is always the possiblity that he may not come home. I cannot be sure he will come home, but I am certain that if he should die we have insurance and plans in place to care for our two children. This will not bring him back, but it will ease the financial burden if he should be taken from us. Thinking about and planning for possible accidental death will allow us to grieve properly should an accidental death occur. What value do you put on life or limb? No amount of money can bring a human being back. No litigious effort can be guarranteed a certain amount. Victim's families can choose to forgo the generous gift the American public is giving them through this fund. They can try there luck in litigation if they must. They will not be guarranteed any compensation in litigation. Will jurors be sympathetic to their needs in court? It seems to me that they now have a 50/50 chance at that. The American public is now aware of their complaints, and some people think the Victim's families are being greedy. Again, litigation and compensation will not bring a loved one back. Where are all the counselors and therapists? The victims need help processing their grief, and money will not do it. As a taxpayer, wife, mother, daughter, and wife of a police officer, I believe the current compensation is more than fair. Please do not change a thing. If it is not enough for some Victim's families, let them have their day in court. They are not guarranteed an award until a verdict has been reached by a jury or judge. Do they really want to take their chances with a public that is currently turning angry versus sympathetic? If congress decides to take away all collateral source deductions, then maybe ALL the families would accept the fund payouts. As it stands now, my family still recieves "zero" from the fund. I would rather use the fund but it appears that the rules will not let me. I feel that this is still unfair my family because we had life insurance & it will probably drive my family to sue. On that day, America realized that its citizens were not made of Mexican-Americans, Italian-Americans, Asian-Americans, African-Americans, or any other type of hyphenated-Americans. Instead, American realized that alll its citizens were just plain Americans. It deeply outrages me how the families and partners of gay and lesbian heroes that died on September 11th will not necessarily receive the same benefits as the families and spouses of heterosexual victims of the terrorist attacks of that day. In a land that believes that all men are created equal, an idea that our country has gone to war over and over, it makes me ashamed that the Victim Compensation Fund will not cover the partners of the gay and lesbian heroes even though FETUSES AND ILLEGAL ALIENS are covered. In fact, it is willing to overlook federal law and not arrest or deport the families of illegal aliens. How, then, does it make sense to exclude the families of gay and lesbian heroes? I am in a stable, substitute-family gay relationship with my partner of 18 years. We own a house jointly, share a car, vote, belong to a church, and take in wandering teenagers from both sides of the family as needed, teaching them life skills and humane values. There is no question in my mind that we are a stabilizing influence on society and engaged citizens of America. When the thought occurred to me that, ironically, because we are denied any kind of legal recognition by the state, that we would also be denied benefits had either one of us been a 9/11 victim, I am forced to remember how much I rely on good luck rather than thoughtful contemporary policy for the stability in my own life. Sunday, March 17, 2002 10:21 AM 9/11 compensation for gays Hello - I just became aware that gay/lesbian victims of 9/11 are not receiving the same benefits as their heterosexual counterparts, including those who are illegal aliens in this country. perhaps i have been misinformed, but if not i definately wanted to respond to this. i hope that this situation will be re-evaluated. I just read some of the bio's of the gay/lesbian victims. Some of these profile individuals who have made exceptional contributions to our country. I don't know how unmarried heterosexual survivors are being handled, but please keep in mind that in most states homosexual partners are unmarried not by choice, but because they aren't given the opportunity to marry under state law. Some of these partnerships have lasted longer than most marriages I know, and certainly more than alot of the marriaged that are being recognized by the survivor benefits. I hope that all in volved will open their hearts and minds to reconsider this situation and allow room for more fair treatment of these homosexual victims and their survivors. thank you for your consideration. Monday, January 07, 2002 7:40 AM Compensation To Whom it may concern; I am truly sorry for the loss these families have suffered. I pray every night for there comfort, but it really upsets me that they for some reason feel that the US government owes them something. The Us government did not destroy the World Trade Towers. The American public gave and gave generously to support the victims families. Now the US Government has set up a relief fund and they have the gull to complain that they are not getting enough. We are told that this war on terrorism has just begun, what will future victims family member expect for us. 9/11 was a true tragedy, lets not make it a bigger one by allowing the US Government to be held hostage by greed. These people should be thankful for the generosity displayed by the American public and the US Government and except the helping hand instead of biting it. Each and every person that lost their life in the World Trade Tower had the responsibility to provide for their family, in the event of their death, they could have been killed just as easy commuting to work. Would the government still be expected to compensated their families? Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
