NOT to forget the families and loved ones of the

Members of the Gay, Lesbian, Bisexual and
Transgendered community have suffered as great a loss
as the general population. A Gay hero in the plane
that crashed in      , a Gay      who died at Ground
Zero      . Real people, real
situtations, real pain, real loss-needs real
compensation.
Please follow the lead of NY Governor Pataki who
granted compensation benefit "on a showing of mutual
interdependence with the victim, in recognition that
anyone who shared with the living expenses ,
day-to-day activities and the emotion bonds of family
deserves help in this time of need."
Include any relatives eligible for compensation: those
who lost their life partners as well as de facto
parents of children, without regard to sexual
orientation or marital status.

I believe
I believe that Congress wanted to help the families when they signed this
Bill.
I believe that in signing this Bill they want to protect the Airlines AND
take care of the families.
I believe that Me. Feinberg is trying to save the government money and that
perhaps he thinks he is being fair.
I believe that the current system penalizes those families that did the right
thing and put money aside for insurance, retirement and other savings.
I believe that the People of the United States want the families of the
September 11th Tragedy to be supported financially.
The way the system is currently set up the current salary of the family
member who perished would not be factored into the calculation rather an
average of the last 3 years. What about those who just received a huge
promotion?
I believe information to the public is inaccurate and therefore the public
believes our government is financially supporting the families. THIS IS WHAT
WE WANT!!!! Please do not penalize families that did the right thing. Please
make sure every family is taken care of by this fund.
Don't subtract non-economic loss. The pain and suffering these families have
endured is real. They will live with this loss for the rest of their lives.
Since it has been determined that families should be compensated for their
loss then why turn around and DEDUCT it from their economic loss? Preserve
this compensation and protect it.
The amount of $50,000 per child for pain and suffering is way too low. These
children have to live with the tragic loss of their parent for the rest of
their lives. Increase this amount.
Please recalculate your formula. Give to each family; don't subtract
anything! Make sure each family will be taken care of financially. This is
what we want, this is what we believe you are doing and this is what you
SHOULD do.
Please take care of the families!

Crisis relief payments for survivors of September 11 terrorist
attacks

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have? Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September
11th,
including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars
per
year might receive thousands of times as much compensation as the survivors of a dishwasher in one of
the
restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all
those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a
double
blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to
those
who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and
families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the
option of
marriage is unavailable, these families may find themselves in the traumatic predicament of having to
prove
that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already
announced that they will not discriminate against gay and lesbian families. The Department of Justice
should
do the same.

important
issues.

the Department's request for public comments regarding the forthcoming
regulations for implementing and administering the "September 11 Victim
Compensation Fund." I strongly urge the Department to draft regulations
that ensure compensation is available to all victims of the attack, including
the committed partners and the non-biological children of gay and lesbian
victims.
I would be very sad and angry if I or my partner of 7 1/2 years
were excluded in such compensation of loss.
It is unquestionable that the
devastating grief and economic losses suffered by the families of gay and
lesbian victims are no less than that of other families. Just as the terrorists
drew no lines in choosing their victims, our country must draw no lines
in compensating those who suffered the most personal of losses from these
horrific attacks.

Proposed Final Rule
I wish to file my objections to the current proposed final rules.
First, I take issue with the proposed cap on earnings. I, as many others,
will be unduly prejudiced by this cap. My wife,     , worked long and
hard to be successful and as a result, earned a salary in excess of the
proposed cap. As any worker, we all anticipate that the current salary will
grow as one continues a successful career. Limiting income to $231,000 not
only results in a drastic reduction of present salary, but it then prevents
the introduction of evidence that her salary would have continued to
increase over time. If the cap were removed, at least I would be enabled to
multiply her last years salary by the number of working years to get a more
just result.
Second, the final rules discriminate against those who did some estate
planning by reducing awards by subtracting pensions and life insurance
proceeds. Combined with the salary cap, this increases the chances that
individual families will receive zero, or the proposed minimum of $250,000.
The people who earned large salaries lived a more expensive life style. It's
not right or wrong, it just is a fact. It is not fair to allow the family of
a person who earned $75,000 (and lived accordingly) to receive a large
distribution and maintain their life style and then penalize the family of a
wage earner who made more than $231,000 (and lived accordingly)with a
smaller payment (or nothing) that will put the family at risk of selling
their home and moving to a smaller house and to change many of the facets of
their life pre 9/11.
The combination of the cap and the reduction for estate planning will only
work prejudice on those who earned large salaries. Those who earned less and
planned less will file claims with the fund and receive prompt payments.
Those who are at risk of receiving nothing (or the bare minimum) will be
compelled to choose the uncertainty of litigation--an end the fund desires
to avoid. By shunting the higher wage earners into the litigation, you
further harm the families because the limited insurance funds will be
insufficient to replace the lost income of all the high-wage earners forced
to sue.
Finally, I take issue with the proposed lessened payouts to deceased women.
     had already worked for 20 years by September 11 (She was 43 when she
died) and would have worked until she was 100 if she were allowed. We have 3
children and she returned to work after each was born. At the very least,
the rules ought to allow the introduction of evidence that people would have
worked beyond any fixed age and beyond the "average working life" as
computed on some 20 year old chart.

To Mr. Feinberg:
I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families.
Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place.
The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.

Comments on the Department of Justice?s Rulemaking Regar ding
the September 11th Victim Compensation Fund of 2001
We urge the Department to include among relatives eligible for compensation those who lost their life partners or de facto parents or children, regardless of sexual orientation and marital status.
The federal Fund should likewise vest in the personal representative the duty to act as fiduciary on behalf of all those who consider themselves to be survivors, seeking compensation in proportion to their losses and distributing the awards accordingly.
Those eligible for compensation as a survivor of a deceased victim should include individuals who can show that they had (1) a family relationship of mutual interdependence with the victim, including as a de facto parent or child, and (2) suffered losses of the sort identified in the Act at §§402(5) and (7). Where the individual does not share a blood or legal tie with the victim,1 mutual interdependence is shown if the claimant shared a residence with the victim and was emotionally and financially intertwined in a familial relationship.

awards to victims of Sept. 11
I feel that victims of Sept. 11 should not be awarded money from both the government fund and charities. The purpose for giving money to the victims is to compensate them for potential income they have lost and once the amount of money that a victim should be awarded is determined that amount should come from either the government fund or charities or a combination of the two. But a victim should not be able to collect money for the same purpose from both sources. If this means victims have to keep records of money they have received from different sources then that might be one of the unfortunate aspects of the system. And I also feel that money donated to charities should be distributed first and then money from the government fund used when the charitable contributions have been exhausted.

The september 11 th fund
I have heard that although illegal aliens, the unborn children of parents and
spouses of those who died will get funds but that that gay and lesbian
partners of those
who died on September 11 are not automatically going to receive the same
benefits as heterosexual spouses. I disagree with this position if it is
true.
3000 people died that day, including Gay firemen and policemen and just plain
Americans who happened to be gay. If illegal aliens are getting paid why
aren't American Citizens who have partners not getting anything?

Protect Traditional Marriage

I
want to express my opposition to any effort by the federal government to provide
9-11 victim compensation funds to "domestic partners" of unmarried
survivors of the terrorist attack upon our nation.
Funds
disbursed through the September 11th Victim Compensation Fund of 2001 should
only go to the surviving family members of those who died on 9-11. Funds must go
to the widows, widowers, orphans, and other blood-related or adopted members of
the family--not to unmarried sexual partners of those who died.
To
provide funds to "domestic partners" is to undermine the traditional
definition of marriage and family to include any number of sexual liaisons
between same-sex or opposite-sex unmarried couples. Many homosexuals and
swinging heterosexuals, for example, engage in sex with multiple partners. Do we
provide funds to each of the sexual partners? Where do we draw the line on how
many "domestic partners" a person may have?Homosexual
activists are exploiting the 9-11 tragedy by asking the federal government to
redefine what constitutes a legitimate "family" under the law. In
fact, homosexual activist      , writing in Out magazine
has openly called for the subversion of the concept of marriage between a man
and a woman. He has urged homosexuals to fight for the legalization of
homosexual marriages and once legalized to "redefine the institution of
marriage completely . . . . to debunk a myth and radically alter an archaic
institution. . . . The most subversive action lesbians and gays can under
take--and one that would perhaps benefit all of society--is to transform the
notion of 'family' entirely."
If
the DOJ provides funds to "domestic partners," it will be helping
     accomplish his goal: That of redefining marriage and altering what he
calls an "archaic institution."
We
also oppose September 11th Funds going to the estates of the deceased instead of
to their surviving family members. No one can know for certain where these funds
will end up if they are deposited in the estate of a person who has died. The
person may have willed his estate to a terrorist, racial hate group, or even to
an organization like the North American Man-Boy Love Association. No one will
know unless each person's will is examined by a DOJ lawyer.
The
money should go to the surviving family members of the deceased, not to the
estate or to the surviving "domestic partner."

Compensation for gay's loved ones
To whom it may concern, please wake up! Equal rights, is the higher
choice. It means giving up judging others, who have a natural attraction
to same sex. It means loving, and excepting everyone. It means
celebrating diversity, and admitting that we are all different, and that
is a positive thing, with many positive results. How we love, is not
important, but that we love is. All the feelings of separation, come from
hate, not love. Fear of what is, we are all different. The solution is to
focus on commonalities, then the boggy man will go away. The fact that
gay hero survivors, are not being compensated, is a great injustice.

Dear Mr. Kenneth Zwick,
I write as a member of Amnesty International, a worldwide human rights
movement committed to ensuring respect for the basic human rights of people
without discrimination, in support of equal access to benefits under the
September 11 Victims Relief Fund for all victims, regardless of sexual
orientation or marital status. As you know, the United States has
committed to uphold international human rights standards, including the
Universal Declaration of Human Rights and the International Covenant on
Civil and Political Rights, which prohibit arbitrary discrimination.
As you consider rules for administering the relief fund, I ask that you
apply basic international human rights standards, and the general principle
of equality, by including among relatives eligible for compensation those
who lost their life partners, as well as de facto parents or children,
without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
Thank you for considering my concerns. I look forward to hearing from you
about your efforts to ensure that all surviving victims of the September 11
attacks have equal access to the relief fund.

without regard to sexual orientation or marital status. The State of New
York has already adopted such a policy, granting compensation benefits "on
a showing of mutual interdependence with the victim, in recognition that
anyone who shared with the victim living expenses, day to day activities
and the emotional bonds of family deserves help in this time of need."
Many lesbian and gay people were killed in the September 11th attacks.
Since then, lesbian and gay surviving partners of those killed have had
mixed results in obtaining equal treatment at the local level in the
distribution of relief funds by private and state agencies. An inclusive
policy on the part of the federal government would help establish an
important principle for other such funds. In compensating victims, real
justice will be served only when all families - and all types of families -
impacted by the human rights tragedy of September 11 are treated with
dignity and equality.
