You have created an open door that will now force this policy to be applied to virtually any and every natural or man made disaster in the years ahead. Nothing can compensate a person for the death of a loved one, I know. My father died at age 42 and the VA rated it a "Service Related" Death - My Mom does receive some benefits but no where near the $1.6 Mil. being offered to these families, perhaps the life of a 22 year veteran of the United States Navy is worth less to them than the civilians who perished - And if the 9/11 victim families get the $1.6 Mil, what about the families of the service men and woman who are dying Overseas to fight Terrorism? what do they get? I am sorry for their loss but I really think my Tax dollars should be used for the nation, not a few thousand family members claiming they are owed. Did none of them have life insurance? Tuesday, March 19, 2002 6:13 PM Eligiblity Laws To whom it may concerned: I am outraged at how an organization who is supposed to be helping the ones most gravely affected by the tragedies of Sept. 11th can make such allowances as to ignore federal and state laws in order to help the illegal aliens, to make funds available to fetuses, who in all actuallity can not be 100% tested as being child to one of the departed, but not to gays and lesbians who in some cases were one of the very men who saved the DC target. Who in some cases lost their lives giving the last rites to those already gone in the towers. Who in some cases were flying the planes that crashed. To make allowances for so many things that are not accepted and not legal and not recognized by the whole of society but then to turn your heads to one group of people who are not accepted and not legal (ie:marriages) and not recognized by the whole of society. Where is the definition that the other groups where special allowances were made over society and over the laws of our country and states are better than the group of gays and lesbians whose same rights are being denied. Sept 11th I had thought had brought our country together despite all the arguements we've had within our nation. Despite our differences and color lines, sex lines, orientation lines, political lines, etc. we learned that our nation as a whole was more important than all of our petty bickering amoungst ourselves. Now I am not so sure that we have all learned that. I guess it is left to what I have always known. The gays and lesbians will have to support each other and look to within our "family." I am proud to say that so far there are 4 gays/lesbians out of my family of 7 brothers and sisters and not one of them is any less important or any less needed as part of my family than the ones that are straight. Nor do I consider any gay/lesbians in society any less important or any less needed than the ones who are heterosexual. Sadly I cannot change the minds of those who already so closed and blind to building peace and acceptance amoungst all of society. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. When I gave blood and financial donations to the Red Cross, I didn't designate favorites for who would and wouldn't qualify. In fact, the thought of doing so is repugnant. (I don't think that's what Jesus would do.) Like Americans everywhere, I just wanted to help people who needed help. The concern is felt especially deeply where child victims are concerned. Some were orphaned by September 11 events. Others lost a parent's employability to injury. It doesn't matter whether their parents are straight or gay -- these children are just children, and they need help. They did not choose their parents, let alone their parents' sexual orientation. I hope the Department of Justice will draft regulations that ensure compensation is available to ALL victims. Too many American's are hurting for the government to take time and taxpayer resources) to determine the sexual preferences of deserving victims.
