I am outraged that even illegal aliens are being compensated for the September 11 attacks, and our own citizens who have been in a committed relationship are not! Any relationship is worthy of compensation if illegal aliens can be compensated. These people are not even citizens, and our own citizens are being ignored. The worst part is the justification used to make this decision. Illegal aliens will not be prosecuted or sent back if they come forward. This is obviously against the law, but to do that and then turn around use the law (does your state have benefits for committed couple relationships? If not, then that victim does not qualify for benefits!) That I feel is totally wrong! Furthermore, even if the victims had no spouse or children, certainly the relatives or friends of the victims who may be in their will, are deserving of the benefits allowed to the married couples. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Wednesday, March 13, 2002 2:55 AM Compensation for Gay Partners Surely there must be a way to document the legitimacy of a gay partner's claim for compensation for the loss of his or her loved one. This event was too horrific to compound the tragedy by excluding anyone who shared the life of and lives with the loss of their own personal hero. If illegal aliens can legally claim compensation, then legal residents who were the partners of victims must also be able to qualify for compensation, perhaps along the lines of common law married couples. I urge you to do whatever you can to make it possible, regardless of state laws, to compensate gay partners who have been personally affected by this national tragedy and include them in the national program set up to help families of victims. Family is what is important, whether it be by blood, adoption, marriage, or committed love. My brother shared his life for 20 years with another man, and I consider that man my brother-in-law whether the State of Arkansas, with all of its common-law marriages, agrees or not. Sunday, March 17, 2002 7:26 PM Unacceptable A gay man is now acknowledged as a hero in the diversion of the aircraft presumably meant to strike and destroy the US Capitol on September 11, 2001. Now we learn that gay people will not be eligible for relief in the form of assistance from the September 11 Victims Compensation Fund. It is unacceptable that gay people, heroes and victims alike, should be discriminated against in the dispensation of this fund, which is both an instrument, and an enunciation, of US Compassion and benevolence for those who suffered and died. Kenneth Feinberg's reference to disriminatory State law as his guide in the fund's own discriminatory policy is a mere political dodge. When through an easy collusion with the Attorney General, illegal aliens claiming compensation are protected from prosecution and deportation, and granted eligibility for compensation by the fund (an extraordinary instance of humaneness, though certainly both politically volatile and legally questionable) it is reprehensible that American citizens who lost their lives, and in some cases sacrificed them heroically, on 9/11 should not be afforded the same consideration, simply because they are gay. For the fund, which is not beholden to State Laws, to be rhetorically held hostage to the sensibilities of state-by-state public opinion (especially given the aforementioned relaxation of immigration laws) is simply a morally bankrupt and cowardly position, driven more by efficacy than fairness, right or common sense. One might as well shape policies for the fund after the policies of the Taliban, who would certainly be offended at its equal treatment of (straight) women; not long ago effectively treated as second-class citizens within the US, in deference to putatively bread-winning men (lest we forget). Mr. Feinberg might just as well admit that fear and apathy are the reasons that gay and lesbian people are "left out of my program," as he so aptly put it on a recent edition of MEET THE PRESS. Mr. Feinberg should be reminded that not only is the world watching such uncoordinated political jockeying (embarrassing enough to Americans), but that Americans themselves are watching closely, in amazement, and that history is recording these episodes as well... an embarrassment he will one day share. And the way the rules read, gays and lesbians may get nothing. Forget that , a gay man, was one of the heroes who brought United Flight 93 down in a field in Pennsylvania instead of on top of the US Congress, where it was supposedly headed. And forget that NY Fire Department was gay, and that an estimated 10% of those who died were gay. This alleged inequity must be halted. All Americans suffered on September 11. Those who have lost partners, no matter the marital status, gay or straight, if partnership can be proven though checking accounts in common, same address, etc, then those partners need to receive the same benefits that other survivors of heros of this disaster receive. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. However, I don't believe our government should be giving the families compensation for the loss of their family. There were many millions of dollars raised for this reason. These deceased should not be treated differently than any other U.S. citizen. If I was killed on the highway on my way to work, the government is not going to give my family money. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Friday, December 07, 2001 8:51 PM Dear Mr. Zwick, I am writing in response to the Department's request for public comments regarding the forthcoming regulations for implementing and administering the "September 11 Victim Compensation Fund." I strongly urge the Department to draft regulations that ensure compensation is available to ALL victims of the attack, including the committed partners and the non-biological children of gay and lesbian victims. The Red Cross has worked closely with groups in New York City and have implemented a similar policy in compensating gay and lesbians and their families. The devastating grief and economic losses suffered by the families of gay and lesbian victims are no less than that of other families. Just as the terrorists drew no lines in choosing their victims, our country must draw no lines in compensating those who suffered the most personal of losses from these attacks. I am surprised that our governement, the government in charge of "Operation Enduring Freedom" would think of not including all the victims of the September 11 attack.
