DC Dear Mr. Zwick: I want to express my opposition to any effort by the federal government to provide 9-11 victim compensation funds to "domestic partners" of unmarried survivors of the terrorist attack upon our nation. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have?Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist &nbsp&nbsp&nbsp&nbsp , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping &nbsp&nbsp&nbsp&nbsp accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." My hearts goes out to the family and friends of the victims of this most despicable act. Even though our family struggles from paycheck to paycheck like many Americans, we still felt that we needed to give assistance to the families who lost loved ones. This assistance was given by making a donation to one of the national charities that setup a fund for providing such assistance. Part of the reason for our financial struggle is we plan for the death of either my wife or myself. A reasonable person knows or should know that death can happen at any time. Thousands of people die each day in America unexpectedly from a multitude of causes. All of us as individuals need to plan for an unexpected or expected death of a husband and/or wife. My wife and I specifically budget for life insurance to compensate the survivor for loss of income. We do not expect the American taxpayer, through our federal government to come to our rescue if either one of us dies. Life insurance is affordable if you are willing to make the commitment. It is our belief that minimal assistance should be provided by our federal government to the victim's families. To provide such a huge sum of money to the victim?s families does a great disservice to the American taxpayer and families who have lost loved ones from an accident, crime, or other non-preventable cause. Millions of American?s, multinational companies, and other people around the world have given very generously to relief agencies and charities that have received more than one billion dollars in donations. We sincerely believe that these funds should be used to assist the victim's families to compensate for the loss income. It is also our belief that the victim?s families should hold responsible and seek compensation from the airline companies whose aircraft were hijacked. Wednesday, January 02, 2002 10:32 PM comment about the unfairness of the fund Dear Special Master: I think the way this fund is going to be distributed is unfair. I feel that the government should let the victims know the amount of the award before being made to sign anything. If a person settles out of court they know the amount of the settlement before they have to sign anything. All people who have life insurance have to pay monthly premiums as did my husband. Because they were cautious about their future and paid money out of their own pocket, not the governments, they are being penalized. Also everyone who has a job on the books has to pay social security, it is not just given to them, so this should not be deducted either. If the government fells that accepting workers compensation is "double dipping" I do not think the money already received should have to be given back. I also strongly believe that there should no be a cutoff age for a child when it comes to pain and suffering. A thirty year old living on their own does not have less pain than a child under the age of eighteen, if anything they have more pain because they got to spend more time with the lost one. There should not be a clause that only a dependent has pain and suffering. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. January 13, 2002 Mr. Kenneth Feinberg Special Master of the Sept 11 Victim Compensation Fund U.S. Department of Justice Main Building, Room 3140 950 Pennsylvania Ave, NW Washington, DC 20530-0001 Re: Comments on the Interim Rule of the September 11th Victim Compensation Fund of 2001 Dear Mr. Feinberg: I am writing to ask for your help to correct two inequities in the Department of Justice's Interim Final Rule for the September 11th Victim Compensation Fund of 2001 that will result in many families receiving no compensation from the fund. This is because (1) the projected economic and non-economic loss figures are unrealistically low; and (2) the Fund reduces any award by the amount of money a victim family receives from a "collateral source." When Congress passed the Air Transportation Safety and System Stabilization Act on September 22, 2001, it severely restricted September 11 victims' right to sue the airlines, which bear ultimate responsibility for the tragedy because of lax security procedures. In exchange for denying victims the right to sue, Congress provided the September 11th Victim Compensation Fund of 2001. The Fund is supposed to compensate the victims' families for the types of losses that would have been recoverable in a lawsuit, but without the burden and delay of litigation. The Interim Rule/Regulation also describes the intention of the law: "The Fund is designed to provide a no-fault alternative to tort litigation for individuals who were physically injured or killed as a result of the aircraft hijackings and crashes on September 11, 2001" {Interim Rule/Regulation, Summary Paragraph A.1.}. "The attached regulations have two objectives: (1) To provide fair, predictable and consistent compensation to the victims of September 11 and their families throughout the life of the program; and (2) to do so in an expedited, efficient manner without unnecessary bureaucracy and needless demands on the victims." {Interim Rule/Regulation, Supplementary Information.}. The Interim Final Rule fails to meet the intent of Congress, however, because many victims's families will net nothing after collateral source funds are subtracted from the already undervalued economic and non-economic loss projections. The Interim Final Rule understates economic loss by underestimating the lifetime earning potential of victims at all economic levels. Noted economists at the National Association of Forensic Economists showed that the Interim Final Rule uses outdated statistics and inappropriate methods to arrive at low estimates of our loved one's future earnings. An analysis done by one of these economists showed that the actual earnings growth for firefighters is 27% higher than the DOJ estimate, the actual earnings growth of all college educated workers is 30% higher than DOJ indicates, and actual earnings growth for financial professionals is more than 100% higher than the DOJ estimate. The Interim Final Rule also falls short of Congress's goals for non-economic loss. The figure for presumed non-economic loss compensation of $250,000 plus an additional $50,000 for the spouse and each dependent is rationalized as being roughly equivalent to the amounts received by public safety officers who were killed while on duty, or members of the military who are killed in the line of duty while serving our nation. With all due respect to such public safety officers and miliary personnel, they choose to go into harm's way and their loss is not the result of corporate negligence. On the other hand, the September 11 victims are victims of negligent airline security. Perhaps more realistic guidance as to the value of non-economic loss can be found in other air crash disaster awards. For example, non-economic losses recovered in other air crash and terrorism cases commonly result in awards of between $2 million and $5 million. A more reasonable projection of non-economic loss is probably somewhere between the current proposal and the historical litigation result. The Interim Final Rule reduces any compensation awards by the amount of any funds received from collateral sources, including life insurance. The Interim Final Rule does this because Congress included such a provision in the Air Transportation Safety and System Stabilization Act. That does not make it fair; that does not make it right. In many states, the law on "the collateral source rule" has been well settled for over one hundred years. Under that rule, damages recoverable for personal injury or death, caused by the negligence of another, cannot be reduced because of compensation received by proceeds of an insurance policy. This is because the wrongdoer owes full compensation for the injuries inflicted by them and any payment by a collateral source in no way relieves the wrongdoer of their obligation. In this instance, the airlines and others at fault owe full compensation for the injuries resulting from their negligence. Any payment by a collateral source in no way relieves the airlines and others at fault of their obligation. This collateral source rule, which has been a fundamental part of tort victim compensation for over a hundred years, needs to be incorporated into the September 11 Victim Compensation Fund. The Interim Final Rule needs to be adjusted to provide fair, balanced and acceptable economic and non-economic loss projections. The economic loss charts need to be increased and expanded depending upon the deceased's job field. The non-economic loss amounts also need to be increased into a range that accounts for the tragic way in which these innocent victims died and the shattered lives they left behind. Collateral source recoveries need to be excluded from consideration by the Fund. Without these changes, the intent of Congress will not be fulfilled because there will be no reason for many of the September 11 victim families to participate in the Fund. Without these changes, it will be better for many victim families to take a chance at litigation rather than sign on to a Fund through which they will receive nothing but a waiver of their right to sue. Please rectify these inequities. Give the victim families a reason to participate in this Fund rather than litigate. Change the Interim Final Rule to provide economic and non-economic amounts at fair, balanced and acceptable levels; do not offset Fund awards by collateral source recoveries; establish a fair appeal process. Finally please include the specific calculation formulas, statistics and assumptions within the rule or the explanatory materials. Zwick, Department of Justice: In the immediate aftermath of the tragic attack of The United States, on September 11, Congress enacted the Victims "Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr.Feinberg's self imposed rules failto satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"Severy death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape from The Special Master cannot take it upon himself to restrict the rights of the families." It is an outrage that the administrators of the 9/11 Fund have chosen to perpetrate such discrimination. Discrimination against lesbians and gays is wrong under any circumstances, but is made all the more aggregious by the hypocricy here: as Americans put aside differences to unite around American ideals of freedom, justice, democracy, and equality, government administrators deny benefits to the grieving partners of some of the dead on the basis of those differences. This is a wrong and unjust policy. The 9/11 terrorists did not discriminate among the passengers and workers in the planes and buildings who were killed in the attacks, nor should the 9/11 Fund discriminate in its distribution of benefits to those whose loved ones were murdered. I am aware that legalities are being consciously overlooked to provide benefits to the families of illegal immigrants and even to fetuses (which to my knowledge do not enjoy the rights of personhood under the law). The decision to grant benefits to the families of illegal immigrants is just, as all victims' families deserve compensation. While certain legal sticking points are being cited to justify the denial of benefits to gay and lesbian partners, the extension of benefits to the families of illegal workers undercuts this argument. Full benefits must be extended to the gay and lesbian partners of those Americans killed in the terrorist events of September 11th. To deny these Americans the same rights, privleges, and benefits extended to other Americans (and in fact other non-citizens) undermines the most basic American principles of equality under the law. Worse yet, to make these biased and discriminatory distinctions among Americans now creates precisely the kind of division which weakens our country against its fundamentalist attackers. Divided from within, we will easily fall. As fractious a nation as we are, we unite not around a motherland or a shared lifestyle or a common racial identity or a single religion, but around the ideals of freedom, justice, democracy, and equality under the law. These ideals must be upheld now, or we ourselves continue the work of our attackers.
