I feel these awards at our expense are nothing more than a "bail out" for the insurance companys. As you know, this Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions of the rights of the victims" relatives to recover damages from court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As it stands, Mr. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation, which was enacted. Specifically, we request that you act on our behalf and demand the following changes to the interim rules: 1. Remove arbitrary income limits. The arbitrary income limits imposed by the Special Master are not only unfair but also inconsistent with the letter and the spirit of the law. Those victims from the financial industry are specifically harmed by this limit. They were targeted and murdered precisely because of the jobs they held and where they worked-the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly; commensurate with the support they provided their families before their death. 2. Increase non-economic rewards. Mr. Feinberg has arbitrarily restricted the non-economic awards for pain and suffering, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Congressman Peter King,"Å every death is tragic. A murder is particularly tragic. But to have your love one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape fromÅ The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families' for the immeasurable pain and suffering endured by our loved ones. Saturday, January 26, 2002 12:29 PM Revised e-mail I am outraged about an article I just finished reading in the 1-26-02 edition of the Denver Post newspaper entitled "9-11 Families Recoil At E-Mails Painting Them As Greedy." In this article, AP Reporter Shannon McCaffrey notes that according to Special Master Kenneth Feinberg, the fund's "average award will be $1.6 million, although final details are still being worked out." McCaffrey's article then cites a number of examples of victims' survivors who are not satisfied with the amount of what they believe to be their entitlement. For example, McCaffrey cites the case of &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp, a widower whose husband was killed at the World Trade Center site. &nbsp&nbsp&nbsp&nbsp&nbsp&nbsp&nbsp complains because she "has figured that under the fund she would be entitled to about 1.1 million. But her husband's life insurance and supplemental policy from his employer total $1.4 million, so she fears she will get nothing from the government." (Underline added). My outrage is twofold. First, I disagree with the stated purpose behind the government's creation of the fund -- to limit the civil liability of the airlines and other entities arising from the 9-11-01 terrorist attacks. The creation of the fund for this purpose pre-determines that the airlines were negligent and therefore responsible for thousands of deaths because they did not prevent the terrorist attacks. This is an absurd conclusion. Neither the CIA, the FBI, the NSA nor the US Military, entities charged with the responsibility of preventing such attacks, saw the attacks coming. Nevertheless, by virtue of creating the fund, it is apparent that Congress feels like the airlines dropped the ball on this one and are civilly liable. ABSURD!!!!. This was a unique and hopefully one-time occurrence -- one that was impossible to predict -- BY ANYONE including the US Government!!!! It is time for all involved to get a reality check -- sometimes, bad things happen for no particular reason and because of no one's fault. My second source of outrage arises from the families' feeling of entitlement. I am quite sure that people in Bakersfield, CA, Sidney, NE, Baton Rouge, LA, Mobile AL and a number of American cities also died on 09-11-01. Where do survivors of these victims go to collect their government payoff? Better yet, since my father died when I was 11 years old and I have collected nothing from the government, where do I go to collect my entitlement? Since I am now 36 years of age, all of the interest accruing on my entitlement must have pushed the figure over 2.5 million by now? I cannot wait to get the money and take my family to Disney Land. Please do not misunderstand me. I truly feel sorry for the families who lost loved ones on 9-11-01. However, I do not feel sorry for a lady who, because she is collecting $1.4 million in private insurance proceeds, might not be able to collect her government entitlement of $1.1 million. She and others like her are GREEDY PROFITEERS whose voices do not deserve to be heard. If anyone is at fault here, it is Bin Laden and his Al Queda organization. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. I am ashamed of my country. People who were affected by 9/11 who are gay and/with families who are American citizens should be treated better than illegal aliens. Gay victims and their families are people plain and simple and should be treated no better or no less than a straight 9/11 victims and their families. What ever happened to the constitution and "All men are created equal"? We need to focus on equitable treatment and not create a scenario of dissention. This importantly should include the partners and children of same sex unions. They suffer just as grievously for their deceased loved ones as do other survivors, and their need for assistance is just as great. Please do not give in to the importuning of callous homophobic groups and individuals who would have the Department of Justice limit compensation to survivors of heterosexual unions. Why should they have a cap if the rest of us are looking at retirement now starting at age 70. b) There should be no deductions for any charity received by the victim's dependants. They are ENTITLED to their share REGARDLESS of any gifts they may have received. c) Life insurance was PAID for by the Victim and should not have any bearing on what the family has a right to. d) The right to appeal should not be denied to those who are suffering due to the tragic losses inflicted on them by this horrific event.
