American heroes - would they have committed the same acts of bravery if they would have known their partners and friends would be discriminated against by the very country they defended? I am sure they would have. By my definition a hero is just despite the circumstances. Feinberg degrades the American spirit and the power of our united strength. "This Victims' Compensation Fund is an unprecedented expression of compassion on the part of the American people to the victims and their families devastated by the horror and tragedy of September 11th," said Feinberg. "While there is no amount of compensation that can replace a human life, our goal is to aid those who have so greatly suffered as a result of this horrendous act. So far so good. The American people clearly showed their compassion when they donated Billions to charities and wanted it all to go to the families of the victims. From any accounts if that was done each family would get more than is being awarded by Mr.Feinberg and the insurance companies would still be liable to pay up what they owe the victims. Let us now be reasonable. I do not want excesses of money. Money cannot replace the joy of being with my son, however must I suffer further at the other extreme by being told that his value is $300,000? "We will also ensure that every family who lost a loved one receives, in total, at least a minimum level of compensation from all sources. For victims who were married or had children, that minimum will be $500,000 -- meaning that that they will receive a combined total of at least $500,000 from our program, other state and federal programs, life insurance and other compensation (excluding gifts from charities). The minimum for deceased victims who were single will be $300,000. My son who lived a clean life did not use drugs, did not have any babies is being awarded the paltry sum of $300,000 as an unmarried individual after the insurance part is taken off. Would you really accept that for someone so special in your life? >From what I have seen , it appears that the Government is seeking to satisfy 'big business' at the expense of the individual.The airlines and now the insurance companies are able to get money but the individual is granted very little. My son had insurance and like others in my predicament we have to suffer extra because any insurance we are due will be deducted from the sum that is awarded. I think this is a GROSS insult to families Mr. Zwick, and I request that you at least withdraw that stipulation before I can begin to even consider what is being offered. It is with much sadness that I have to say I disagree with you about whether the victims families are greedy. I truly believe some of them are, particularly people such as the representative on today's discussion. We have never compensated victims of any other disaster in this manner and I am very concerned about the prescience this may create. We did not have any special fund for the victims of the Oklahoma City bombing. We do not have special funds for the victims of natural disasters. While I realize that no amount of monetary compensation will replace a lost loved one, I do not believe that the families of these victims should be made wealthy at the taxpayers' expense. In any other situation, persons receiving compensation for lost wages would have to pay income tax on the money received. These persons will have to pay no income tax on any of the funds. Sunday, January 13, 2002 1:34 PM (no subject) To our Elected Officials: In the immediate aftermath of the tragic attack of September 11th upon our nation, Congress enacted the Victims' Compensation Fund of 2001 P.L. 107-42, to compensate the relatives of the victims of that brutal attack. As you know, the Fund was enacted as part of a comprehensive package which bailed out the airline industry and imposed restrictions on the rights of the victims' relatives to sue the airlines in court. We implore upon you, as our elected officials, to demand changes to the interim rules issued by Kenneth Feinberg, the Special Master. As i8t stands, Mr5. Feinberg's self-imposed rules fail to satisfy the letter or the spirit of the legislation which was enacted. Specifically, we request that you act on our behalf and demand the followings to the interim rules: 1. THE ARBITRARY INCOME LIMITS IMPOSED BY THE SPECIAL MASTER ARE NOT ONLY UNFAIR BUT ALSO INCONSISTENT WITH THE LETTER AND THE SPIRIT OF THE LAW. Those victims from the financial industry are specifically harmed buy this limit. They were targeted and murdered precisely because of the jobs they held, and where they worked - the World Trade Center, the Financial capital of the world, the embodiment of financial success. Those who achieved such success should see that reflected in their awards. They personified American Business and commerce, democracy and freedom. We ask that you demand that Mr. Feinberg lift the arbitrary income limits so that each family can be treated fairly, commensurate with the support they provided their families before their death. 2. MR. FEINBERG HAS ARBITRARILY RESTRICTED THE NON-ECONOMIC AWARDS FOR PAIN AND SUFFERING, no matter what the extent of the pain and suffering. This is unacceptable. In the words of Rep. Peter King, "every death is tragic. A murder is particularly tragic. But to have your loved one murdered in a burning building in full view of the world - in a scene which will be repeated in the media for decades to come - is a horror these families will never escape from ... The Special Master cannot take it upon himself to restrict the rights of the families." Therefore, we request that the interim rules be amended to more appropriately compensate the victims' families for the immeasurable pain and suffering endured by our loved ones. As Mayor Guiliani stated in his farewell address: " we have an obligation to the people who did die...Their families need to be protected just as if they had been alive, financially and every other way that we can help and assist their families... There should be no compromise about that ever..." We request that the interim rules be amended and redefined to the extent that income caps be removed when computing economic loss and that compensation for paid and suffering more accurately reflect that horror which was suffered. Sunday, November 18, 2001 9:55 PM Comments on the Implementation of the Victim's Compensation Bill To the Department of Justice: I am writing on behalf of my sister, , whose husband was killed in the World Trade Center on September 11t. Like many others worked as a bond trader at on the 103rd floor. now has three small children ages 3, 5, and 7 to care for and support alone. I cannot begin to describe the anguish, sorrow and exhaustion that she is enduring and will endure for many years to come. I understand that some of your constituents have written to say that the people affected by the attack "should not get rich from this tragedy." People also seem to believe that individuals like (brokers, traders, etc) were quite well off before this event and do not really need any help. I cannot tell you how hurtful and unjustified these views are to all the victim's families. People also assume that these families are receiving tremendous about of aide from the various charities. I have seen first hand the tremendous effort, paperwork and humiliation that has accompanied small amounts of aide. I know my sister is ready to give up on receiving help from this source because of what is involved. My sister and the other survivors are having to worry and endure so much right now, that they should be spared this terrible uncertainty about their future. The Victim's Compensation Bill was a wonderful ease the worries of the survivors, compensate them for their losses, and prevent costly and protracted legal battles. However, the victims' losses should be fully analyzed and their long term needs be carefully considered. While my sister received sufficient life insurance to cover her family's needs for the next 2-3 years, she has a lifetime in front of her to support them . Since her children will need tremendous support and attention for years to come, she will for not be able to seek full time employment for some time. And even when she does, her earning potential will never reach that of her husband. All these issues need to be considered in determining how much each family is entitled to receive. I urge you to consider the current pain and long term worries and needs of the survivors as you implement the Victim's Compensation Bill. If there is any cap placed on compensation, it needs to be much more than one million dollars. To many people that sounds like a lot of money, but it will certainly not support a family for all the years in front of them. Also, I urge you not to subtract any charitable contributions to these families. The time and energy alone that survivors have put in to "earn" this money should be sufficient sacrifice. He was one of the many whose access route out of the building was cut off after the aircraft crashed into the floors below where he worked at WTC 1. 1) Please ensure that there are no caps on earnings or the awards issued. Her husband worked hard to achieve where he got and his accomplishments should not be belittled. 2) Give due consideration to earnings made in 2001 in your calculation of the award. This can be extrapolated from the 9 months of salary actually earned. Her husband, like most of the victims, was young and just reaching the prime of his career. 2001 earnings would be more indicative of his salary going forward. 3) Where possible minimize or eliminate collateral source deductions. For example, the future stream of social security payments terminates once a spouse starts working. This outcome may be inevitable given the size of current presumptive awards. 4) Compensate adequately for a victims childs economic and non-economic loss. It should be noted that just deducting social security payments received by one of her children, the combined economic and non-economic award attributable to that child would be more than eliminated, i.e. the child will owe the government money. 5) If it is at all possible, provide a fairer non-economic loss amount. The amount that is currently offered does not begin to take into account the immeasurable pain and suffering endured by my friend, her late husband and her children. 6) Finally, make the compensation amount known to families prior to requiring them to waive their rights to sue. The government in passing legislation after the event has limited the ability of families to seek redress from airlines and other potential defendants. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. It is in the best interest of the victims families that compensation be disbursed on the basis of objective, equitable formulas that take into the number and ages of dependents, future educational expenses for children, and regional costs of living. We have two young children, and I also work full-time. My husband's salary as a civil servant was modest, and he needed to work a second job to supplement our incomes in order to live in the New York City area (we reside in the Bronx). Despite his low salary, he took great comfort in knowing that his benefits were outstanding. He paid the maximum into optional life insurance, deferred compensation retirement, and disability programs. He planned very well "for the future," with the knowledge that something adverse could happen to him. I am very concerned that compensation from "collateral sources" that my husband procured on our behalf, through the very hazardous nature of his work and good financial planning, will be subtracted from funds awarded to our family. My children are 6 and 8, and there is a long road ahead of us with unforeseeable expenses. I expect all families to be treated fairly, and not penalized for benefits they earned prior to the tragic events of September 11. Section 405(b) of the statute indicates that the Special Master shall determine the amount of compensation based on "the harm to the claimant, the facts of the claim, and the individual circumstances of the claimant." Yet each of the perhaps thousands of determinations must be made in a very short period of time. Moreover, such determinations should be founded on consistent and clear principles that treat each claimant fairly. The Department invites comments that identify the practical means to achieve these results all within the very short time period that Congress has permitted. How could they possibly be anything less than equal in the eyes of God? I donated to a 9/11 fund, the one that was advertised on television with all the musicians last fall.
