Many lesbian and gay people were killed in the September 11th attacks. In fact, illegal aliens are going to receive benefits and the government is going to look the other way regarding their illegal status. This importantly should include the partners and children of same sex unions. Seeing a television story recently about the continuing financial and emotional hardships of the families of the Americans who lost their lives in the terrorist bombing in Kenya at the U.S. Embassy, it seems to me that fairness dictates that the law be amended to provide that these families, those of other terrorist assaults (other embassies, USS Cole, Oklahoma City, and others) be afforded comparable relief as the families of those who perished on Sept. 11. I might add that this same sentiment should govern compensating innocent victims of crime (Federal, State, and local). If some in America (and the world) hadn't realized it before September 11, we are all one family in this world, and at least as a nation, we have the responsiblity to take care of each of our own in a fair and equitable manner. The Biblical phrase "God is no respecter of persons" can, I believe, be nearly universally accepted in most religions around the world -- certainly in the USA. U.S. policies should incorporate that concept in its compensation policies so that all innocent victims of terrorism and other innocent victims of crimes to American citizens are treated evenly and fairly. Further, groups such as the Red Cross should consider embracing the same philosophy and be open to assist devasted families of innocent victims of other comparable crimes, as long as the plea for donations clearly indicates the various classifications of victims in their appeals. We know that often the best advocates of funding for research into diseases are Senators and U.S. Representatives who themselves or their families have suffered with a particular disease. Senators and U.S. Representatives don't hestitate to provide funding for police and courts to try criminals, but rarely balance that with victim compensation funding for the same crime (or require the criminal to pay some of the costs). Celebrities, such as Michael J. Fox and Mary Tyler Moore are strong advocates for funding of the diseases with which they struggle. However, those with less strong voices need to be heard and represented equally in Federal policymaking. 2. Much has been said in the media already about the unfairness of deducting insurance and other benefits from the calculation of compensation for each individual victim. At the outset, I admit that I have not read the entire act of the guidelines. I would hope that at least the families would be reimbursed for all the premiums that were paid by the victims and their families (and employers) for such insurance and other benefits. However, there should be some recognition that people with the foresight and personal responsibility to take out insurance were thinking about their futures and that they should be rewarded in some way for that planning. 3. I believe new hearings should be held to review the comments to this regulation, and that even if some compensation is paid from this fund, that it not be final until everyone is heard and there is an opportunity for revisions that are acceptable to those most affected. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." We both hold full-time jobs, pay our taxes and go about our daily lives in the same capacity as our heterosexual peers. Although we cannot legally marry in our state (Ohio), we are forever committed to each other emotionally, financially, and spirtually. If I were to lose her to tragedy, my life would be devestated and forever changed in the same way as the lives of my heterosexual friends and family members. I was outraged at the comments made on Meet The Press 3/10/02 in regards to compensation for the victims of the 9/11 tragedy. It is a travesty that surviving partners/families of gay/lesbian couples will not be recognized and compensated in the same capacity as that of heterosexual survivors. This is truly discrimination at its worst. Please stop hiding behind the smokescreen of justifing this decision based on discriminatory state laws. The 6 months that have passed since 9/11 have been incredibly difficult and trying for ALL Americans. However, as a result of this tragedy, we have seen our country come together and unite in a way that has been absent for a very long time. Patriotism is now at the highest level that I have seen in my lifetime. ALL people have come together in unity regardless of race, creed, or sexual orientation. At best, the decision to not extend financial aid to surviving partners of gay/lesbian 9/11 victims in un-fair. At worst, it is an assault on the basic human rights and integrety of our nation and serves to nullify the foundation of our Constitution as it applies to ALL Americans. I am very thankful that none of my friends or family members were directly affectted by the 9/11 tragedy. However, my heart goes out to all the victims and their surviving husbands and wives, sons and daughters, mothers and fathers... My heart especially bleeds for the survivors of , , and all of the other gay and lesbian people that lost their lives or were affected by the attack that are now experiencing a second tragedy at the hands of our government and our current conservative and discrimatory political climate. Persons: After considerable reflection on the various options and competing interests regarding the fund, the solution, in my opinion, should be one of proportional fairness - including to taxpayers. Immediate family (this should include domestic partners and those in common law marriages) and dependents should be made financially sound but not made rich by a compensation plan. This compensation should be extended to family members in foreign countries. Awards should be made taking charitable contributions into account e.g. set a cap of 40-50K depending on how long the fund takes to actually begin the compensation. Compensation should be proportional so that the earning potential of a surviving spouse who is well educated and could eventually have a good paying job and perhaps where the mortgage on the family's home is being paid by mortgage life insurance should receive proportionally less than the not well educated or trained surviving spouse of of a dishwasher formerly @ WOW. The proportional nature of the awards should also take into account benefits to be received from Social Security Survivors Insurance. Here again, those without "legal" marriage may have difficulty getting the necessary documentation to prove eligibility for survivors benefits for themselves and their children. I do not think that nondependent relatives (other than adult children in higher education), should qualify for compensation other than funeral or memorial service costs. Lastly, there should be several "Special Masters" to oversee the fund. I would like to see a mix of legal, social security and not for profit overseers. Monday, November 12, 2001 8:42 PM Comment on fund To Whom It May Concern: I am a resident of the Gateway Plaza complex, which is the residential building complex that is closest to the World Trade Center. My daughter and I have lived in this community for ten years. It has been a special place for us and many other families. Our neighborhood is now devastated. Having survived a traumatic attack, we are now coping with lack of access, air that has provoked many respiratory and eye problems (including my own), disruption of schools, and the continual grief that our unavoidable proximity to the site brings us. Yet we are a strong and resilient community, and many of us want to rebuild and stay on. I hope that the Victims Fund will take seriously our needs as a neighborhood, and will help us obtain the infrastructure--particularly transportation and coordination with police checkpoints-- that we desperately need to get back to our daily lives. I also hope that on a case by case basis individuals with real needs will be able to get some help in continuing with their lives either in our community or elsewhere. In particular our schools and youth need funds made available. has been a very important person in our community, as far as Youth Programs go, and I hope funds will be made available both to him and to our other neighborhood organizations. has discussed establishing an independent authority to deal with the WTC-related community issues, and I hope the Fund will assist this effort. Actual data that provides levels of various contaminants measured -- asbestos, glass, heavy metals, volatiles-- should be posted and available for review at a site similar to a library. Vague general statements of safety are inadequate. Additionally, measures that can be taken to mitigate the effects of contaminants should be implemented and continuing services should be provided for residents to help cope with negative health effects.
