She was which was hijacked and intentionally crashed into the Pentagon . was my wife, my life partner and the heart of our family. death has left a void in my life and in the lives of our two children which no amount of money can fill. My children and I represent only three of the many thousands of individuals who lost family on September 11, 2001, but I hope you will hear our voices. The chart that was published in conjunction with the guidelines strips and each of the other victims of any shred of identity they have as individuals. The cap on non-economic damages represents a harsh, un-realistic pre-determination of my family's loss. Furthermore, the notion of a cap in place before any consideration of our family's non-economic loss is an affront to the families. Death, unfortunately is individualistic to each and every family and not as the Fund wishes it to be: collective. Each individual that died on September 11, 2001, was unique and special, please do not allow the guidelines to treat them as anything less. I am also unable to understand the logic that supports an offset of collateral sources . The offset removes the incentive for families to plan ahead for their children's current and future needs. The life insurance policies, pension plans and defined benefits plans that will be deducted as collateral sources represent the hard work in the industry of the decedents and their families; the same hard work in industry that has contributed to the wealth of our government that provides the source of the Victim's Compensation Fund. This day, September 11, 2001 will NEVER be forgotten. Like it or not, this day is far greater than December 7, 1941: a day of infamy . There will NEVER be another day like that September day, I implore you to support the rebuilding of these families through the use of these government funds with the same enthusiasm and commitment the government had directed toward rebuilding the airline industry in the days that followed September 11, 2001. I understand that this was a horrible thing to have happened and my condolences go out to the victims, and in fact I made a substantial chiritable donation. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately. both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. Sent: Wednesday, January 23, 2002 7:11 AM Subject: Victims Compensation Fund I just heard on FoxNews that this was the last day we could comment; I didn't know it was open for our comment. I truly feel the American public sent more than enough compensation from the bottom of our unselfish and equally hurting hearts as a hug around each victims shoulder and a deeply broken heart. But, that was more than enough. The final victim count is about half what was expected for weeks, that means each victim will get twice as much as previously thought. And still this is not enough! I believe the take the fund money or suit with no fund money is very fair. I do not feel the taxpayers should be asked to do even more than we have so generously given. We are paying for this war, the rebuilding of New York and Washington D.C.. and Afghanistan. We are now expanding our search into other countries with much more expense and demanded. Will we have to rebuild Somalia, also, since we didn't finish the job about a decade ago? I know these families are deeply grieved but there are many more victims, such as area business owners and employees who were fortunate enough to live with no work to be done. Are these people being compensated? Every day disasters happen in this fallen world and most people have to pick up and go on, making the best of their situation. I have heard many of these victims stories and think they truly feel we are to make their lives as good as they were before, in their same home with the same level of lifestyle as they previously had. But this is not what disaster does to our lives, it changes us and makes us dig deep inside to bring out a strength of character that only such horrible adversity builds. I know many who have tragically lost homes, jobs and loved ones with no one there to help them as these people have available. I think the government is being more than fair. I think we have to let them make their choice, as you have offered, and help them realize that their lives have tragically changed forever and they need to find the way to become stronger and more appreciative for all the blessings they still have . . . not let them wallow in their self-pity and belief that their lives can somehow be made whole again. I just heard that a very anti-American member of your staff, Kenneth Feinberg, is planning on limiting what kind of compensation goes to gay and lesbian victims of the September 11 terrorist attacks. And the way the rules read, gays and lesbians will probably get nothing. I was sad to hear that you even had such an obviously unAmerican scumbag of this type on your staff. To think that there are people who would deprive any victim of 9/11 assistance reminds me of how this country does not treat everyone equally. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same. As you know, the United States has committed to uphold international human rights standards, including the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights, which prohibit arbitrary discrimination. As you consider rules for administering the relief fund, I ask that you apply basic international human rights standards, and the general principle of equality, by including among relatives eligible for compensation those who lost their life partners, as well as de facto parents or children, without regard to sexual orientation or marital status. The State of New York has already adopted such a policy, granting compensation benefits "on a showing of mutual interdependence with the victim, in recognition that anyone who shared with the victim living expenses, day to day activities and the emotional bonds of family deserves help in this time of need." Many lesbian and gay people were killed in the September 11th attacks. Since then, lesbian and gay surviving partners of those killed have had mixed results in obtaining equal treatment at the local level in the distribution of relief funds by private and state agencies. An inclusive policy on the part of the federal government would help establish an important principle for other such funds. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Special Master Dear Mr. Feinberg: In an interview with Wolf Blitzer on CNN, you were asked whether you would make the decision to enter the compensation fund if you lost a loved one in the September 11th terrorist attacks. You hesitated before you answered. Your first response was that you could not, try as you might, place yourself in that position. Your final answer was that you guess - with a pause guess you would choose to enter the fund. This was not exactly a ringing endorsement of the fund. We understand your hesitation. As difficult as it may be for you to place yourself in our position, it is your responsibility and your obligation to do so. Place yourself in the position of the newly single parent who must wake up each morning and deal first with the immense and sick sense of dread and loss, the realization that another day without your loved one must be endured, and in many cases the knowledge that you will never even have the solace of burying their your loved one. Then consider the challenge each widow or widower must face as they meet each demand placed before them that day, taking care of children who are experiencing a tremendous loss, and all of the daily responsibilities that accompany the raising of children, jobs, bills to pay, and more. These challenges often must be faced after sleepless nights and horrible nightmares. Think of the parents who have faced the most difficult challenge any parent can, the loss of a child. Their lives will never be the same. Consider the person who was about to get married to one who perished and whose dreams and future were dashed to the ground in seconds. Consider those who are domestic partners, who suffer the profound loss of a loved one but are also not contemplated in your program . Now try to imagine how these individuals will answer the question posed to you, an attorney, when they do not have your experience or skill and when they are suffering in a most extraordinary and unrelenting way. Their private grief is coupled with an enormous burden of public grief. There is no relief. There is only paperwork, persistent publicity, and now the burden of appearing ungrateful, a burden which has been imposed by a government that now appears to be more concerned about protecting airlines and insurance companies than holding these bodies legally responsible for their failure to provide secure travel and freedom from this kind of tragedy. I lost my brother, a firefighter, in this terrible attack. I am not in the position of those described above, although my parents and my brothers fiancée are in those positions. My grief is deep and I suffer daily as I experience my own pain and observe that of my parents, my brothers fiancée, my siblings, our spouses and children. We siblings will get nothing for our pain under your plan and I realize that it would be impossible to compensate everyone. I also know that is our responsibility as family and as a nation, and especially your responsibility as the special master, to protect and care for these very vulnerable victims. You cannot abandon your responsibility by saying that you will never be able to put yourselves in the victims shoes. As special master, you have a choice to make. You can truly try to compensate the victims or you can hide behind rhetoric suggesting that because it is impossible for you to stand in our shoes and because no amount of money will ever compensate for the loss of our loved ones, that somehow you are relieved of your obligation to accomplish this task. You have made the decision to offer victims an insulting amount for non-economic pain and suffering. You have permitted the public to be misled into thinking that all families were going to receive a substantial amount of money when this is simply not true. You have created an untenable situation for victims who must now become active, in a time of great distress and grief, to fight for something that is clearly deserved freedom from financial worries which are a direct result of the failure of this country to adequately protect its citizens. This rule amounts to an abandonment of your duty to provide the fair and just compensation that Congress intended to offer these victims. As special master, you can make a choice not to try to reduce the cost of a fund that was originally supposed to compensate 6000 victims. As special master, you can choose to consider the true cost of raising a child beyond age 18 rather than reducing the award by consumption factors. Realistically, most parents are financially responsible for their children through age 21. As special master, you can choose to tell the American public and these families, by awarding appropriate economic and non-economic compensation, that these firefighters, police officers and other rescue workers are indeed national heroes and that their families will be taken care of by the government. Otherwise, you will leave a legacy of disenchantment with public service for who would encourage their child to choose such a career when these heroes lives are so devalued? I am an attorney and one thing is clear to me. No one in our profession was prepared to deal with the extraordinary and catastrophic results of this type of terrorist attack and its aftermath. That is why the American Bar Association put a moratorium on lawsuits. Highly experience lawyers were not sure how to proceed in this situation. How, then, is the average lay person, without the benefit of legal expertise, supposed to make a decision in this situation? As you clearly displayed by your reaction to Mr. Blitzers question, it is a terribly difficult position for a victim. Your job is a difficult one and I do believe you want to do the right thing. You still have the opportunity to do so. Please do not abandon these victims! Feinberg September 11th Victim Compensation Fund U.S. Department of Justice 950 Pennsylvania Avenue NW Washington, DC 20530 To Mr. Feinberg: I am writing to urge you to ensure fair treatment for all surviving families of the tragedy on September 11th, including the children and families of low-wage workers and gay and lesbian families. Under traditional rules based on lost wages, the survivors of a bond trader earning millions of dollars per year might receive thousands of times as much compensation as the survivors of a dishwasher in one of the restaurants destroyed. Justice requires looking far beyond the last paycheck to the inherent worth of all those killed, so that a high minimum compensation level is set to lessen the disparities. It would be a double blow to the survivors to first lose their loved one and then watch as most of the taxpayer money went to those who were already well off in the first place. The second major issue has to do with recognizing the legitimacy of gay and lesbian relationships and families. Gay and lesbian families are especially vulnerable when one partner is killed. Because the option of marriage is unavailable, these families may find themselves in the traumatic predicament of having to prove that their union is legitimate. Fortunately, both the Red Cross and the State of New York have already announced that they will not discriminate against gay and lesbian families. The Department of Justice should do the same.
