Tuesday, January 22, 2002 9:38 AM Comments on the Proposed Rule I would like to submit the following comments on the regulations proposed as a "Victims Compensation Act": Yesterday on the news, we heard about how the US, who had already pledged $200 million some odd dollars in humanitarian aid to Afganistan was leading other countries toward contributing funds to rebuild Afganistan by pledging another $400 million some odd dollars. This morning on the news we heard that the Special Master and the Compensation Fund was limiting payouts to victims families to $1.6 million dollars. The Special Master was on the Today show this morning explaining why he would have to deduct from the $1.6 million dollar total any amounts that victim's families received from pensions/life insurance/etc. The juxtaposition of these news stories could boggle the mind. We are bargaining down the amount that we pay to victims families while at the same time pledging billions of dollars to rebuild the country that we are still in the process of destroying. The worst part about it is that Americans don't even seem to notice that a billion of their tax dollars is being spent to rebuild the damage done by billions of their other tax dollars. I think every American would prefer to have their tax money spent to compensate victims and their families. I will be copying members of Congress and the White House on this email, however, it is likely that they are too busy investigating someone shreading paper at Enron to notice. In compensating victims, real justice will be served only when all families - and all types of families - impacted by the human rights tragedy of September 11 are treated with dignity and equality. Funds disbursed through the September 11th Victim Compensation Fund of 2001 should only go to the surviving family members of those who died on 9-11. Funds must go to the widows, widowers, orphans, and other blood-related or adopted members of the family--not to unmarried sexual partners of those who died. To provide funds to "domestic partners" is to undermine the traditional definition of marriage and family to include any number of sexual liaisons between same-sex or opposite-sex unmarried couples. Many homosexuals and swinging heterosexuals, for example, engage in sex with multiple partners. Do we provide funds to each of the sexual partners? Where do we draw the line on how many "domestic partners" a person may have? Homosexual activists are exploiting the 9-11 tragedy by asking the federal government to redefine what constitutes a legitimate "family" under the law. In fact, homosexual activist , writing in Out magazine has openly called for the subversion of the concept of marriage between a man and a woman. He has urged homosexuals to fight for the legalization of homosexual marriages and once legalized to "redefine the institution of marriage completely . . . . to debunk a myth and radically alter an archaic institution. . . . The most subversive action lesbians and gays can under take--and one that would perhaps benefit all of society--is to transform the notion of 'family' entirely." If the DOJ provides funds to "domestic partners," it will be helping accomplish his goal: That of redefining marriage and altering what he calls an "archaic institution." We also oppose September 11th Funds going to the estates of the deceased instead of to their surviving family members. No one can know for certain where these funds will end up if they are deposited in the estate of a person who has died. The person may have willed his estate to a terrorist, racial hate group, or even to an organization like the North American Man-Boy Love Association. No one will know unless each person's will is examined by a DOJ lawyer. The money should go to the surviving family members of the deceased, not to the estate or to the surviving "domestic partner." It is the responsibility of each person to ensure that their loved ones are taken care of in the event of their untimely death, why should one's family be penalized by subtracting life insurance from their award when acquiring insurance is the responsible thing to do. I AM TOTALLY OUTRAGED BY THIS. I am a gay-American, and I contributed $100 of my money to help ALL Americans affected, not just the ones you see fit based upon your personal bias. If you are willing to overlook the laws regarding illegal aliens, then you must overlook the biased laws regarding partners of gay-Americans. You cannot have it both ways; that is simple discrimination, and is horrible given the times we (ALL of us) face as Americans today. In recent interviews, the head of the September 11 Victim Compensation Fund (a fund created by Congress to help the families of those who died on September 11) has made clear that the partners of gay and lesbian heroes of September 11 will not necessarily receive the same benefits as the spouses of heterosexual victims of the horrible terror attacks. EVEN FETUSES AND ILLEGAL ALIENS ARE COVERED!!! Even fetuses and illegal aliens will be receiving benefits under this problem - they've even promised to overlook federal law and NOT arrest and kick out the families of illegal aliens, nor will they punish American companies that hired illegals in violation of federal labor laws. But when it comes to gay and lesbian heroes of the day - who helped bring down the flight in Pennsylvania, who died in the line of duty when the first tower fell, and who was of the plane that crashed into the (there are many more) - we are told the law is the law and no exceptions can be made. If September 11 has taught us anything, it's that our patriotism and love of country transcend our differences and unite us all. We were told that September 11 was the day that "hyphenated-Americans" were no more, and rather than being Italian-Americans, African-Americans or gay-Americans, we were now simply Americans, all of us together as one American family. Please do what is right: distribute funds to ALL those affected by this terrible act of hatred. Please do not commit a second act of hatred by discriminating against other fellow Americans. Tuesday, January 22, 2002 2:33 PM allocated money to victims We were extremely upset when we heard about this "quiet" act to compensate the victims of the World Trade Center. This is unprecedented and in consideration of the amount of money that many of Americans sent to different organizations to help, we are wondering why the government would take more money out of our pockets - without our permission - to do this? We have heard the amount of money many are being given. On a personal note, my husband was without a job for a year because of cancer. We had bills we incurred through this, not to mention the money we lost due to his not working, which caused great hardship on us. I lost my dad who worked in the World Trade Center and my mom passed on a few years ago as well and I am an only child. Therefore I have to deal with everything myself now. So I wanted to get on your radar screen, since I have been feeling like I might fall through the cracks. Recently I got a letter from Gov. Pataki and the NY State World Trade Center Relief Fund, which was designed for us. But of all the forms they sent me, I don't fall under any category - I am not my dad's spouse, I am not a child or a child who is dependent. As a print reporter covering the television industry I don't make that much money, so my dad had to help subsidize me with some money each month for living expenses here in L.A. I called the 800 number for the NYS WTC Fund and the worker said I don't get anything. Now I am working with Red Cross to help me. I have many bills, including lawyers I had to hire in NY State to help me with everything out there. I also have to pay back some loans my dad had, which is not legally my problem, but in a sense there is no one else to deal with my dad's estate except me. I am the only next of kin, as I said. So I did get a $5,000 check from United Way of L.A. and the told me I had to wait till they heard further word from the Sept. 11 Fund they set up, because I told them I had to help pay for a loan my dad took out, could they help me further...So last week they had the press conference with George Clooney and the United Way people and NYS Attorney General Elliott Spitzer, they said they were opening up $78 million of the total money raised for us victims. That day I called my L.A. Chapter of United Way, spoke to the woman I had dealt with, who was professional, but could have been kinder and more compassionate to my plight, esp. since they are supposed to be a humanitarian organization. She said I didn't qualify for the $10,000 they said on the press conference, because I am not totally dependent on my dad. But the people of America donated that money to go to people like me and it is a frustrating process. I guess if my dad had life insurance it wouldn't be such a big deal, but after my mom died, he and jointly made a decision to cancel the life insurance to go to other more important living expenses. I just want also to make sure that your office knows my name and that in the future I and my dad will not be forgotten, when time comes to do a memorial as well. Even though I want to remain low-key, I do want representation from your office. Being 3,000 miles away from ground zero, it has been hard even to get my dad's mail forwarded, with all the anthrax scare and I found my address was even written wrong by some of the NY offices. I do have a contact in NYS Gov.'s office, but I find them all in NY state very overwhelmed and swamped. I have always admired you and felt that you really speak on behalf of the people in our state. I had to hire and will have to pay for NY lawyers to help me with everything. When I first called , she said they wouldn't know any more info until the Sept. 11 Fund was opened up. I called her last week, the day George Clooney held the press conference to ask her if I can qualify for that $10,000 they announced. Firstly, I want to say she was professional, which should be a given. But it wouldn't hurt your organization to have more compassion and kindness in the tone of your workers, since you are supposed to be a charitable and humanitarian organization. While the $10,000 would help me greatly, $41,000 would help me just break even to be honest, since the equity loan is big, and I have proof of how much it is on paper from the bank statements, if you need (the equity loan off the house is actually more than $41,000). After my mom died, my dad and I jointly made the decision to cancel his life insurance policy to put that money into more important living expenses. So you can imagine I have many things to deal with on my own and help from your Sept. 11 Fund would be greatly appreciated. had said I might not qualify because I was not totally dependent on my dad. But he did help me with living expenses just to help be be able to live in L.A. So I was partly dependent. I find it tough to look at Mayor's Guiliani's decision to open the Twin Tower Fund to just give families of NY firefighters $100,000. For those of us who lost innocent loved ones whose only fault was reporting to work on Sept.11th. I've have had to actively seek out help at a time when I am just trying to get through life day by day. My dad wasn't a cop or firefighter, so he wasn't in a brotherhood to speak out for him, as they do for themselves. It's not a question of becoming rich from this awful tragedy I have been through, it's merely that the funding would help me deal with debts and other hardships that I didn't even think about until Sept. 11 and just break even. It is especially frustrating when the Sept. 11 Fund was opened up in the name of the tragedy and supposed to help us, the victims left with this mess we have to deal with, and the American people wanted it to go to us. Since the purpose of the fund is to make survivors of victims insofar as possibly financially whole, and not to make the survivors of the foresightful better off than the survivors of the less prepared, this argument is without merit. However, to assuage their sense of unfairness I recommend that the formula be altered so that for those who are the named beneficiaries of life insurance policies, their award include the cost of premiums paid. Tuesday, January 22, 2002 11:21 PM Comments to Sept 11 Victim Comp Fund Dear Special Master Feinberg; I am very much interested in the Sept 11 Victim Compensation Fund. My husband was killed while at work on the floor of World Trade Center Building II on that dreadful day. I have reviewed the interim rules and procedures for claim submission to the above referenced fund and submit the following comments. I am pleased that our government has made an attempt to compensate victims and families of deceased victims to the September 11th tragedies and to do so as painlessly and expeditiously as possible. While I commend these efforts I am dismayed at 1) the amount of the 'presumed noneconomic loss', 2) the offset of the award by collateral sources and 3) the requirement that claim submission waives the right of the claimant to file a civil action for damages sustained. 1) In light of this horrific tragedy - one most unimaginable - an award of $250,000 for noneconomic losses seems paltry and an insult to the heroic and patriotic efforts of the victims. Nothing less than 1 million dollars should be considered. 2) Reducing the amount of the total award by collateral sources such as life insurance policies and pension plans is unfair. These benefits were of course provided in the event of death but should in no way be considered a source of compensation in settling wrongful death suits or claims. Individuals who had the forethought to provide for their families after death should not be penalized for doing just that. Congress and the President should amend the Act to do away with reducing the award by these sources. 3) It was my understanding that this legislation was enacted to help bailout the airline industry. Why on earth then would legislation prohibit civil suit against other potentially negligible parties, such as the owner(s) of the World Trade Center Buildings, the City and State of New York, the Port Authority of New York and New Jersey and Omar Bin Laden? If in fact the legislation was intended to bailout all of these entities, then the award should be far greater than the estimated minimum of $500,000 to families of deceased victims. Finally, I'm sure it is the objective of the Fund to have a great number of the victims and families of victims submit to the Fund. I think however that the rules and procedures of this Act as they are currently written will have the exact opposite affect. Thank you for the opportunity to present my views to you.
